CALLTOORDER Pledge of Allegiance Observation of a Moment of Silence Rules of Decorum The Board of Supervisors welcomes the public to its meetings and encourages and appreciates public engagement. The Board of Supervisors expects members of the public to act in a courteous, civil, and respectful manner. Individuals who address the Board shall not make personal, impertinent, slanderous, or profane remarks to any member of the Board, staff, or general public. The Board of Supervisors will not tolerate loud, threatening, personal or abusive language, or disorderly conduct which disrupts, disturbs, or otherwise impedes the orderly conduct of Board meetings. Violation of these rules of decorum will result in the meeting being recessed. 2. CORRECTIONS AND/OR CHANGES TO THE AGENDA. 3. CONSENTAGENDA 3.01 Acquisition of Real Property Abutting the Neal Road Recycling and Waste Facility from Nance Canyon Partners, L.P. — As a result ofspace constraints and increased recycling requirements, the Department of Public Works requires additional land abutting the Neal Road Recycling and Waste Facility (NRRWF). The Departments of General Services and Public Works recommend that the Board of Supervisors approve acquiring additional land, spread over three parcels, under two agreements with Nance Canyon Partners, L.P. The Donation Agreement specifies a donation of approximately 70 acres identified as Assessor's Parcel Number 040-600-032 and a donation of approximately 56 acres identified as Assessor's Parcel Number 040-600-063, with a close of escrow by December 14, 2021. The Option Agreement specifies acquisition of approximately 118 acres identified as Assessor's Parcel Number 040-600-084 for a total of $708,000 of which $250,000 will be paid on or around December 7, 2021, and the balance due at close of escrow by February 8, 2022. The total property acquired is approximately 244 acres at approximately $2,902 per acre when considering the combined parcels. In addition, it is recommended that the Board of Supervisors adopt the related Resolution and authorize the Director - General Services to Page 1 BUTTE COUNTY BOARD OF SUPERVISORS AGENDA - DECEMBER 6, 2021 execute any and all documents necessary to accept the donated land, exercise the option to purchase, close escrow on all three parcels and execute the certificates of acceptance for each parcel. Funding is included in the NRRWF Enterprise fund budget. —ACTION REQUESTED —1) APPROVE AGGREMENTS (TWO) AND AUTHORIZE THE CHAIR TO SIGN; AND 2) ADOPT RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN; AND 3) AUTHORIZE THE GENERAL SERVICES DIRECTOR TO EXECUTE ALL NECESSARY DOCUMENTS TO ACQUIRE THE THREE PARCELS. (General Services) 4. REGULAR AGENDA 4.01 Butte County 2021 Redistricting Draft Maps - Every ten years following the federal census, the boundaries of the supervisory districts of the County must be adjusted so that the districts are similar in population. Redistricting Partners, the consultants hired to manage the 2021 redistricting process, have publicly presented at six Board of Supervisor's meetings as well as three community outreach meetings, with the intent of educating and informing the community on the redistricting process, and garnering public input. In addition, during the first publicly held meeting on July 20, 2021, Redistricting Partners outlined the processes under the Fair Maps Act, the State and Federal Voting Rights Act, and discussed other requirements associated with the redistricting process. On October 12, 2021 the consultants presented initial draft district maps where additional public input and Board testimony was provided, and returned on November 9, 2021 and November 22, 2021 with additional draft district maps. Consistent with Board direction, the consultants are returning to present three additional draft maps (A8, A9 and A10) that contain the following criteria: two valley districts (a north and a south), a city split in Chico that includes the school district lines, a split in Oroville that utilizes the Feather River, that Forest Ranch and Cohasset stay together, Cohasset and Forest Ranch may or may not be in the same district as the Town of Paradise, North of the City of Oroville/Feather River shall be included in the Town of Paradise District, consider public comment that has been received (including not dividing up Mechoopda), Chico maybe divided into 4 districts, Oroville may be divided into 3 districts, and the district that the Town of Paradise resides in maybe underpopulated similar to what has been considered previously. In addition, at the request of Supervisor Kimmelshue and with the concurrence of Supervisor Teeter, staff have placed Consultant drafted map AS as well as publicly submitted maps "A5 - B" and "A5 -C" on the agenda for review and consideration. And at the request of Supervisor Lucero and Supervisor Ritter, staff have placed publicly submitted map "Chico N/S, Foothills E/W" and map "A7" on the agenda for review and consideration. All maps submitted by the consultants follow all legal requirements, including the Federal Voting Rights Act, Fair Maps Act and the Constitution. — ACTION REQUESTED - DIRECT STAFF TO BRING ONE OR MORE OF THE EIGHT AGENDIZED MAPS BACK AT A FUTURE BOARD MEETING FOR ADOPTION AS THE FINAL MAP; OR DIRECT CONSULTANTS TO MAKE AMENDMENTS TO ONE OR MORE OF THE EIGHT AGENDIZED MAPS TO BE BROUGHT BACK AT A FUTURE BOARD MEETING FOR FURTHER CONSIDERATION OR ADOPTION; OR TAKE NO ACTION ON AGENDIZED MAPS AND DIRECT CONSULTANT TO RETURN WITH NEW OR REVISED MAPS; OR TAKE ANY OTHER ACTION RELATED TO REDISTRICTING. Consent Agenda: These items are considered routine and are handled by one motion and vote of the Board. If Services: you wish to discuss any item on the Consent Agenda you can either fill out a speaker card (located in the back of Shelby Boston the board room) and give it to the Clerk of the Board (sitting to the right of the Board) or, when the Chair asks if Fire Chief: there is anything anyone would like to remove from the Consent Agenda, stand and approach the podium and John Messina request the item be removed. The removed items are discussed at the end of the Regular Agenda. 3. Regular Agenda: this is where presentations to the Board and items that require full discussion are heard.
