AN ORDINANCE OF THE COUNTY OF BUTTE REPEALING SECTION 2-25 OF THE
BUTTE COUNTY CODE RELATING TO BOUNDARIES OF THE SUPERVISORIAL
The Board of Supervisors of the County of Butte ordains as
follows:
Section 1. Findings.
A. The government of the United States of America perforins a
general census every ten (10) years.
B. California Elections Code sec. 21500 requires that a Board of
Supervisors, elected by Districts, "shall, by ordinance or
resolution, adopt boundaries for all of the supervisorial districts
of the county so that the supervisorial districts shall be
substantially equal in population as required by the United States
Constitution."
C. Section 2-25 of the Butte County Code is amended every ten
(10) years to replace legal descriptions of all five (5)
Supervisorial Districts.
D. This Ordinance would repeal the entire section listing legal
boundaries of the Supervisorial Districts.
E. The Board of Supervisors shall pass a resolution adopting new
boundaries, which will be available to the public at the Clerk of
the Board's office.

F. The Board of Supervisors may subsequently adopt an ordinance
adopting the new boundaries of Supervisorial Districts in an
addition to the Butte County Code.
Section 2. Section 2-25 is repealed in its entirety from the Butte
County Code.
Section 3. Severability. If any provision of this Ordinance or the
application thereof to any person or circumstances is for any reason
held to be invalid by a court of competent jurisdiction, such
provision shall be deemed severable, and the invalidity thereof shall
not affect the remaining provisions or other applications of the
Ordinance which can be given effect without the invalid provision or
application thereof.
Section 4. Effective Date, Operative Date and Publication. This
Ordinance shall be operative and in full force on and after December
9, 2021 or the effective date of a resolution adopted by the Board
of Supervisors establishing new supervisorial boundaries, whichever
is later, as long as the date is more than thirty (30) days after the
date of its passage. The Clerk of the Board of Supervisors is
authorized and directed to publish this Ordinance before the
expiration of fifteen (15) days after its passage. This Ordinance
shall be published once, with the names of the members of the Board

of Supervisors voting for and against it, in a newspaper of general
circulation published in the County of Butte, State of California.
PASSED AND ADOPTED by the Board of Supervisors of the County of Butte,
State of California, on the 9th day of November, 2021 by the following
vote:
AYES: Supervisors Lucero, Ritter, Kimmelshue, Teeter and Chair
Connelly
