HomeMy WebLinkAbout21-137RESOLUTION APPROVING THE INTENT TO PARTICIPATE IN THE DEFERRED MAINTENANCE PROJECT TO RECEIVE STATE FUNDS UNDER THE SECTION 6.10 OF SENATE BILL 826 WHEREAS, the Legislature and Governor of the State of California have provided funds for the program; WHEREAS, the Department of Water Resources has been delegated the responsibility for establishing the necessary procedures for the administration of this program; and WHEREAS, said procedures established by the Department of Water Resources require a resolution certifying the approval of Intent to Participate Letter by the Applicant's governing board before submission to the State; and WHEREAS, the Applicant, if selected, will enter into a Project Agreement with the State of California to implement the project, and NOW, THEREFORE, BE IT RESOLVED that the Butte, County Board of Supervisors hereby: 1. Approves the filing of the Intent to Participate Letter for the Deferred Maintenance Project -Phase 2 Rehabilitation project (2021-DMP-NA03-01); and 2. Certifies that Applicant understands the assurances and certification required; and 3. Certifies that Applicant will have sufficient funds to operate and maintain the project(s) consistent with the land tenure requirements; or will secure the resources to do so; and 4, Certifies that Applicant will comply with all applicable provisions of Labor Code section 1720 et seq. ; and 5. Certifies that the Applicant will comply with all applicable laws and regulations including, but not limited to, the California Environmental Quality Act (CEQA), state or municipal building codes, health and safety codes, disabled: access laws; and, prior to commencement of construction, Applicant wiilll obtain all applicable permits; and 6. Delegates authority to the Director of Public Works or their designee to serve as Applicant's agent in the negotiations, execution andl submission of all documents including, but not limited to applications, agreements and payment requests, which may be necessary for the completion of the aforementioned project.
