HomeMy WebLinkAbout21-138R., 1% N , il MUD SYCAMORE CREEK LEVEE SYSTEM WHEREAS the County ofButte is a political subdivision of the State of California with responsibility for levee and flood facility maintenance mf the Mud -Sycamore Creek Levee System which ispart ofthe State Plan ofFlood Control and is willing to participate in, coordinate, and collaborate with other interested parties in the maintenance and resiliency of County ofButte flood management; and WHEREAS The Z037Central Valley Flood Protection Plain update recognized that the operation and maintenance of the State Plan of Flood Control facilities has been chronically underfunded. In response to this meed, the Legislature and Governor of the State of California have provided funds for the Deferred Maintenance Project under Section D.1Qof Senate Bill 836 (STATS. 2816, CH. 23). It is the Department of Water Resources" intent 1nwork in collaboration with the Central Valley Flood Protection Board tmallocate a portion ofthe funds toLocal Maintaining Agencies /LMAs\,a,nd WHEREAS, the Department of Water Resources performed inspections on culverts penetrating levees in the Mud- Sycamore, WHEREAS, the County ofButte is and LIVIA and eligible to enter into an agreement with the Department of Water Resources and the State of California to fund and assist in maintenance activities; and WHEREAS, program eligibility requires that the County of Butte approve resolutions and execute e project agreement with the Department of Water Resources; and NOW, THEREFORE, BE IT RESOLVED that the Butte County Board of Supervisors hereby accepts pursuant and subject to all ofthe terms and provisions of the Control Section 6.10 of the Budget Act of 2016, funds awarded to the County of Butte by the California Department of Water Resources for a State -Federal Flood Control System Modification Program project tided °20I1 -DMP -N403'01" , and as a condition of accepting these funds the Funding Recipient committed to signing an additional agreement with the Central Valley Flood Protection Board, or successor thereto, whiich requires the County of Butte to assume responsibility for operation, maintenance, repair, replacement, and rehabilitation of"Z021-DMP-NA03-01°; and the Butte County Board of Supervisors directs the Director ofPublic Works to sign am operation, maintenance, repair, replacement and rehabilitation agreement with the Central Valley Flood Protection Board, orsuccessor thereto.
