WHEREAS, the applicants, Michael and Leslie Mann, have requested approval for aTentative Parcel Map (TPM19'
0007)&osubdividetwoexisting|otsof2.5mmd4.4acrexintothreenewparce|uof3.45acres(Parce|1), 2.35acres (Parcel
2), and 1.0 acnes (Parcel 3), located at 4114 Keefer Road, approximately 1 mile east from State Highway 99 and J miles
north of the City of Chico, in an unincorporated area of Butte County; Aasessw/s Parcel Numbers 047-250-185 and 047-
250-196; and
47'250-196;and
WHEREAS, the Tentative Parcel Map includes consideration of an Agricultural Buffer Unusual Circumstances
Review (UCR) to providean exception and reduce the 300 -foot Agricultural Buffer setback from the northern property line
along Parcel 3 to a 141 -foot setback, in accordance with Butte County Code section 24-8,4 (Exception to Agricultural Buffer
Setback); and
WHEREAS, on June 24 and ]uk/ 22, 2021, the Butte County Planning Commission considered evidence and
testimony for TPKn19'O0O7atadaly-nuiticedpublic hearing, and approved the Mitigated Negative Declaration and Project
by a vote of3'1'1; and,
WHEREAS, mnJuly 3O 2QZ1,the Butte County Farm Bureau (Appe0ant) filed mnappeal, imaccordance with Butte
County Code (BCC) section 24-265 et seq., of the Planning Commission's July 22, 2021, approval of Tentative Parcel Map
TPM19'0007, Agriculture Buffer Unusual Circumstances Review and Exception Request, and adoption of the Mitigated
Negative Declaration; and
WHEREAS, at a duly -noticed public hearing on September 28, 2021, the Board of Supervisors considered the
appellant's appeal, evidence, and testimony mnthe proposed project.
NOW, THEREFORE, BE IT RESOLVED, that the Butte Couinty Board of Supervisors hereby takes the following actions and
makes the following findings:
L Denies the Agricultural Buffer Unusual Circumstances Review to reduce the 3O01-foo�tAgricultural Buffer Setback
for Tentative Parcel Map TP&419'Q0@7,subject tothe following findings:
2. The Agriculturally zoned property (APN: 047-250-044) located north and directly adjacent to the subject
property is actively used for commercial livestock grazing/rangeland operations.
I APN:847-ZS0-0W4bcurrently enrolled under aWilliamson Act (Land Conservation Act) contract.
3. The proposed design of the Parcel 3, with a total depth of 221 feet, does not meet Butte County's 300 -
foot Agricultural Buffer standard, thereby creating a need to reduce the buffer through the application of
anAgricultural Buffer Unusual Circumstances Review,
4. The U[R lacks sufficient evidence to support the rationale and justification that physical and natural
features exist on or near the project site that reduces potential negative effects posed by reducing a 300 -
foot agricultural buffer.
Denies Tentative Parcel Map TPM19-0007, subject to the following findings:
A. The project site is not physically suitable for the type and density of the proposed development.
Application of a 300 -foot Agricultural Buffer from the northern property line along Parcel 3 would prohibit
future residential dwelling development permitted under the project site's zoning designation.
PASSED AND ADOPTED by the Butte County Board of Supervisors this 28th day of September, 2021, by the
following vote:
AYES: Supervisors Lucero, Kimmelshue, and Teeter
NOES: Chair Connelly
ABSENT: Supervisor Ritter
NOT VOTING: None
