WHEREAS, the Board of Supervisors established the Butte County Master Fee Schedule by Resolution on March 24, 2009 and has amended the Fee Schedule over time; and WHEREAS, pursuant to the provisions of the California Constitution and the laws of the State of California, the County of Butte is authorized to adopt and implement fees for services, provided however, that such fees do not exceed the estimated reasonable cost of providing such service; and WHEREAS, the County strives to increase and maintain clarity, consistency, and transparency of the fee process; and WHEREAS, County Code section 3-331 allows periodic adjustments to user fees based on an increase in the cost of providing services; and WHEREAS, pursuant to County Code section 3-331 an increase in, the cost of providing services for userfees is calculated by the net percentage increase in the Employment Cost Index (ECI) (Not Seasonally Adjusted, Total Compensation, State and Local Government, Index Number, All Workers) as published by the United States Department of Labor, Bureau of (Labor Statistics; and WHEREAS, on November 10, 2020 the Board of Supervisors approved a resolution amending the Master Fee Schedule based on the net percentage increase in the ECI through the second quarter of 2020; and WHEREAS, the ECI in the second quarter of 2020 was 142,9 and the ECI in, the second quarter of 2021 was 145.8, with a net percentage increase of 2.03%; and WHEREAS, the Department of Agriculture, Department of Development Services, Fire Department, Department of Public Health Environmental Health Division, and Department of Public Works requests to apply the ECI increase of 2.03% to fees in their fee schedules; and WHEREAS, pursuant to County Code section 3-331, a fee mandated by another jurisdiction will be automatically adjusted to reflect the adjustments made to the fee by the other jurisdiction; and WHEREAS, the Department of Agriculture is applying State mandated fee increases to 17 Weights and Measures fees and adding one Weights and Measures fee pursuant to the amended device administration - inspections and fees regulation in California Code of Regulations Title 4, sections 4070 through, 4075 effective April 28, 2021, and is applying changes for the purpose of general cleanup of fees to their fee schedule; and WHEREAS, the Department of Agriculture, Department of Development Services, Fire Department, Department of Public Health Environmental Health Division, and Department of Public Works list land use fees in their fee schedules, and WHEREAS, pursuant to Government Code section 66017(a) land use fees shalll be effective no sooner than 60 days following the final action on the adoption of the fee or charge or increase in the fee or charge, and WHEREAS, a public hearing was noticed ten days prior to the date of this Resolution to allow consideration, of the proposed fee adjustments prior to adoption of this, Resolution.
