3.55 ACRE EASTERN PORTION OF APN: 040-030-104 ADOPTING ANAMENDMENT TO THE LAND USE MAP OF THE
COUNTY'S GENERAL PLAN FROM VERY LOW DENSITY RESIDENTIAL TO INDUSTRIAL; FOR LANDS IN THE
STS. 110115KOITILW
WHEREAS, Jim Miller (Project Applicant) is proposing a General Plan Amendment (GPA21-0001) and. Rezone
(RE21-0001) in accordance with Butte County Code Chapter 24, ArticleVI, Division, 4 (Zoning Ordinance Amendments),
and Division 5 (General Plan, Amendments); and
WHEREAS, the project encompasses a 3.55 -acre eastern portion of a parcel (Assessor Parcel Number 040-030-104)
located at 200 Speedway Avenue, south of the City of Chico within its sphere of influence, in the unincorporated area of
Butte County; and
WHEREAS, GPA21-0001 amends the County's General Plan, Land Use Map on the 3.55 acre eastern portion, of
parce'I with APN 040-030-104 from Very Low Density Residential (VLDR) to Industrial (II); and
WHEREAS, REZ21-0001 amends the County's Zoning Map on the 3.55 acre eastern portion, of the parcel identified
as APN 0401-030-104 from Very Low Density Residential (VLDR) to Light Industrial (LI) ); and
WHEREAS, an Initial Study / Negative Declaration was completed pursuant to California Environmental Quality
Act (CEQA) guidelines Section 15073 (a); and
WHEREAS, at a noticed public hearing on September 23, 2021, the Planning Commission recommended that the
Board of Supervisors adopt the CEQA Initial Study/ Negative Declaration, and approve General, Plan Amendment GPA21-
0001 (Miller) and Rezone REZ21-0001 (Resolution No. PC 21-11); and
WHEREAS, the Board of Supervisors held a noticed public hearing on November 9, 2021; and,
WHEREAS, said applications were (referred to various affected public and private agencies, County departments,
and referral, agencies for review and comments.
NOW, , THEREFORE, BE IT RESOLVED, that the Butte County Board of Supervisors hereby takes the following actions and
makes the following finding:
1. Adopts the Initial Study and Negative Declaration with the following findings:
'r. An Initial' Study was completed' in compliance with CEQA. Said study identified no significant
environmental effects.
ii. The Board of Supervisors has considered the Negative Declaration, together with comments
received during, the review process.
iii. On the basis of the whole record before the Board of Supervisors, including the Initial Study and
any comments received, there is no substantial evidence that the General Plan Amendment
GPA21-0001, Rezone REZ21-0001 would have a significant impact on the environment. The
custodian of the record is the Department of Development Services. The location of the record is
7 County Center Drive, Oroville CA 95965.
iv. The Initial Study and Negative Declaration reflects the independent judgment and analysis of
Butte County, which is the Lead Agency.
v. The collection of fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 is required
prior to filing a Notice of Determination for the project, unless verification from the California
Department of Fish and Game is provided that the project is exempt from the fee requirement. If
a required fee is not paid for the project, the project will not be operative, vested or final and any
local permits issued for the project will be invalid (Section 711.4 (c) (3)).
2. Adopts General Plan Amendment (GPA21-0001) amending the General Plan Land Use Map from Very Low Density
Residential to Industrial, asset forth in Exhibit A, and subject to the following findings in Butte County Code Article
VI, Division 5, section 24-282:

E The proposed General Plan Amendment is in the public interest.
The proposed General Plan Amendment is a change from Very Low Density Residential to Industrial
designated land. The subject parcel would serve the needs of the, surrounding community and the
County at large with the potential to increase the Ll zoning designation.
ii. The proposed General Plan, Amendment is consistent and compatible with the rest of the General
Plan.
The project is consistent with the Goals and Policies of the General Plan based upon a consistency
review in the staff report.
iii. The potential effects of the proposed General Plan Amendment have been evaluated and have
been determined not to be detrimental to the public health, safety, or welfare.
The proposed General Plan Amendment will allow for Light industrial uses. Project analysis has
determined that the project will not create a detriment to the public health, safety, or welfare.
iv. The proposed General Plan Amendment has been processed in accordance with the applicable
provisions of the California Government Code and CEQA.
The proposed project was reviewed and found to be in accordance with the California Government
Code. Staff recommends adoption of the Initial Study Negative Declaration pursuant to CEQA.
