HomeMy WebLinkAbout21-186WHEREAS, the County of Butte ("County") acquired a small piece of real property for road purposes as evidenced
by theGrant Deed from Jack H. Betz and Connie Ann Betz to the County of Butte recorded on February 23, 1977.in Book
2146 at Pages 372 and 373 of the Official Records of the County of Butte; and
WHEREAS, the real property consisting of approximately 4,531 square feet was originally a portion of Assessor's
Parcel plumber 055-019-048 and is located adjacent to Clark Road in Paradise, California ("Property"); and
WHEREAS, State of California Streets and Highways Code, Section 83 ("SHC §83"), provides that if the Property is
within the boundaries of a state highway, the State of California, Department of Transportation ("Caltrans") has the
authority to acquire the property "without any compensation being paid therefor", and Caltrans "shall have jurisdiction
thereover and responsibility for the maintenance thereof"; and
WHEREAS, the Property is adjacent to and within the boundaries of State Highway 191 also known as Clark Road
in Paradise and therefore subject to SHC §83; and
WHEREAS, Caltrans has requested that the County convey the Property to be used for public roadway purposes
to Caltrans by execution of a Quitclaim Deed without any compensation or other written contract.
NOW, THEREFORE, BE IT RESOLVED, that the Butte County Board of Supervisors do hereby:
1. Approve the conveyance of the Property to Caltrans pursuant to the State of California Streets and
Highways Code, Section 83.
2. Authorize the Director, General 'Services to execute all documents necessary to facilitate the conveyance,
including, the Quitclaim Deed.
