HomeMy WebLinkAbout22-001— ------------ ECONOMIC DEVELOPMENT ADMINISTRATION VVHEREAS,U`e County of Butte ("County") isowner in Fee ofthe real property identified as Assessor's parcel numbers 013-310-008, 013-310-024, 013-310'027,U13-310-0138,O13-310-O37and O13'3OO-08Qwith astreet address mf 2959 Lower Wyandotte Road, Orovflle, California 95966 ("Property"); aind WHEREAS, the Ecomomlc Development Administration ("EDA") made a Financial Assistance Award under the Public Works and Economic Development Act of 1965, in the amount of $1,500,000, EDA Project No. 07'01+04814 ("Federal Share/Award"), to assist in financing the construction of a Community Center consisting of approximately 23,903 square feet, commonly known as the Southside Oroville Community Center ("SOCC"); and WHEREAS, as momclbion of accepting the Award, the EDA required that the County record a statement of EDA's interest. ACovemuntofPurpose,Useamd0m/nersh|pvvasrecordedonMayZ5\2O01asdocummmtnurmberZ0O1-OOI2379 of the Official Records of the County of Butte ("Recorded Statement"), that in part, restricted the conveyance of the Property for a period of2Oyears, the Estimated Useful Life; and WHEREAS, the Estimated Useful Life of the 5OC[expired nmMay 29,2O22and pursuant toTit|eI3ofthe[4deof Federal Regulations Part 314-Property("13 CFR.),Section 314.1O onNovember 5,2O21,the General Services Department on behalf of the County made a formal request to the EDA to release the Property from all Federal Interest without repayment ofthe Federal Share; and WHEREAS, upon approval bythe EDA to therel�ea,se of the Property, the EDA will require the County to execute and record anew Covenant mfUse prior tothe Release ofthe Recorded Statement bvthe EDA. The new Covenant nfUse shall contain the following deed restrictions: 1. Pursuant to13CFR §314,10(e), the Property is and shall henceforth be subject to and encumbered by these stated restMctko�ns: (o) at no time shall the Property be used for explicitly religious activities in violation mfapplicable Federal law, and (b)atnmtime shall the property beused for any purpose that would violate the nondiscrimination requirements set forth in 13 CFR §302.20^ as may be amended from time to time. 2. The foregoing restrictive covenants constitutes reasonable restraint on alienation of use, control and possession ofnrtitle tmthe Property given, the federal interest expressed herein, 1 The foregoing restrictive covenants shall run with the land and shall bind the County ainid its successors intitle inand to the Property.
