RESOLUTION AUTHORIZING THE NEALROAD RECYCLING AND WASTE FACILITY TO SUBMIT ANOTIFICATION OF
INTENT TO COMPLY WITH SENATE BILL 1383 - SHORT-LIVED CLIMATE POLLUTANTS: METHANE EMISSIONS. DAIRY
AND LIVESTOCK: ORGANIC WASTE: LANDFILLS
WHEREAS, Ca|Recvde in consultation with the California Air Resources Board, has adopted regulatory requirements
(RegmUatimns),eonsistemtvviththemunda%eofSenateBi||1383(Lara,ZO16),thataredes' nedtnachievetheorganicwaste
reduction goals established in Section 39730.6 of the Health and Safety Code through a 50 percent reduction in, the level
ufthe statewide disposal oforganic waste from the 2O14level bv2O20 and a75percent reduction Kmthe level ofstatewide
disposal mforganic waste from the 2U14level by2825;and
WHEREAS, Butte County is a local jurisdiction required to comply with the regulations, and the County is or expects to be
facing continuing violations of the Regulations commencing during the 2022 calendar year; and
WHEREAS, Senate Bill 619(Laird,202I),through amendments to, Section 426S2.5of the Public Resources Code (51atute),,
created a mechanism called a Notification of Intent to Comply through which a local jurisdiction may secure administrative
civil penalty relief from any continuing violations of the Regulations for the 2022 calendar year and may be eligible for a
broader and longer-term regulatory compliance path, including suspended administrative civil penalties, thrnugb
corrective action plan; and
WHEREAS, Butte County is a local jurisdiction authorized by the Statute to sobmft a Notification of Intent to Comply
attached asExhibit °A";and
WHEREAS, Calshall approve a Notification of Intent to Comply that is duly adopted bvthe jurisdiction by formal
written resolution and meets the requirements of the Statute; and
NOW THEREFORE, QE[TRESOLVED that the Butte County Board mf Supervisors bvand through its Chair hereby formally
adopts the Notification of Intent to Comply attached as Exhibit "A"; and authorizes and directs the Director of the
Department of Public Works, or designee, to submit the Notification of Intent to Comply (attached hereto as Exh:ibit "A")
toCa|Recydefor aipprmwm|pursuant tothe Statute; and
NOW, THEREFORE, BE IT FURTHER RESOLVED that bvs,ubnmhtingthe Notification ofIntent &o Comply pursuant 1oand
subject to the above referenced requirements, the County mfButte represents and certifies that it will implement the
proposed actions to remedy the violations according to the proposed schedule as approved by Ca|Recyde and in
accordance with the Statue and Regulations; and
NOW, THEREFORE, BE[TFURTHER RESOLVED the County of Butte by and through its Chair also acknowledges and agrees
to comply with a,ny maximum compliance deadline in, any corrective action plan that Ca|Recyc|e, in its sole discretion,
determines to be necessary and appropriate under the circumstances for the correction ofany wio|atiom(s)ofthe Statute
of Regulations identified in its Notification ofIntent to Comply.
