Good evening, Board members!
I know there has been some interest in our effort to prepare a Request for Proposals (RFP) for
the use of the newly acquired property adjacent to the landfill to support wildfire resiliency
and fuels management.
With the assistance of Administration and General Services, Public Works has prepared a draft
th
RFP that is scheduled for circulation this Thursday, May 5. In advance of advertising this
RFP, I wanted to share this draft document with you so you are aware of our upcoming efforts.
As discussed at a prior meeting, the scope of this RFP is relatively broad and focuses on
possible land uses and partnerships that best support our efforts to improve community safety
through the sustainable utilization of available forest fuels. I would encourage anyone
interested to read sections 3-4 of the RFP. These sections outline the project background and
scope of services and should give you an idea of the proposed approach.

1) RESPONDENT ADMONISHMENT

2)INTRODUCTION
The County of Butte is seeking a firmthat can best utilize available unimproved land
adjacent to the Neal Road Recycling and Waste Facility (NWWRF) to support countywide
efforts to improve wildfire resiliency and fuels managementfor the County of Butte
Department of Public Works (“Public Works”).
Butte County intends to award a contractto or enter into an agreement with a firm that
will meet our qualification criteria and has successfully performed services on similar
projects in the past. Recognizing the unique nature of this RFP, Respondents should
include their intended contract or agreement processes as part of their proposal.
Generally, the terms of the contract or agreement mayincludebut are not limited to: (1)
completion of the project within the timeframe provided; (2) no additional work authorized
without prior written approval; (3) no payment without prior written approval; (4) funding
availability; (5) termination of the contract under certain conditions; (6) indemnification of
the County; (7) approval by the County of any subcontractors; and (8) minimum
appropriate insurance requirements.
3) BACKGROUND
Wildfire
Persistent drought, catastrophic wildfires, and climate change are impacting forests at an
extraordinary pace and scale. According to the Forestland Steward, more than 6.5 million
acres have burned in California in the last two years – an area roughly the size of
Massachusetts. Focusing on Butte County, there have been 400,000 acres burned and
20,000 structures destroyed due to wildfire in the past 20 years. The majority of the
destruction occurred during the 2018 Camp Fire and the 2020 North Complex Fire. These
fires were among the deadliest, most destructive, and costliest wildfire events in
California’s history. The unprecedented pace atwhich these fires spread throughout the
impacted communities was exacerbated by many factors including roadside vegetative
fuels.Butte County's high fire-prone areas continue to pose a serious and persistent risk
to the safety of residents who live in those areas.
These incidents have fundamentally affected the County and resulted in increased
awareness and vigilance regarding dangerous vegetation fuels that could spark the next

major wildfire event. In particular, the removal and utilizationof overstocked forest
biomass fuels and dead and dying fuels due is imperative to developing defensible space
and improving wildfire recovery and resiliency. Recognizing that there is no one-size-fits-
all approach to mitigatethese threats, an extraordinary and sustained response by a
myriad of engaged stakeholders from all sectorsis necessary. With this in mind, the
County recognizes that it can play a significant role in support of these ambitious goals.
NRRWF History
The NRRWF is located on Neal Road approximately one mile east of State Route 99. The
NRRWF is owned and operated by Butte County Public Works and relies primarily on
user fees to fund ongoing operations. Based on the remaining available capacity and
annual usage under its current configuration, the site is expected to exhaust its remaining
capacity in 25-30 years.
In recent years, the State of California has adopted additional regulations and diversion
targets that have significantly impacted landfill operations at the NRRWF and throughout
the State. One recent and significant example of these regulations is the passage of
Senate Bill (SB) 1383 -Reduction of Short-Lived Climate Pollutants. SB 1383 established
statewide organic waste reduction targets of 50% in 2020 and 75% in 2025 for the
disposal of organic waste that isdesigned to support the State's effort to reduce emissions
of short-lived climate pollutants in California. Butte County is in the process of adopting
significant operational changes to comply with SB 1383 but is struggling to find cost-
effective options to comply with processing the expected increases in organic materials.
The NRRWF continues to play a significant role in the removal and processing of debris
from recent fires by supporting ongoing community efforts to clear vegetation and trees
and improve community resilience. In 2021, the NRRWF kicked off a Wildland Urban
Interface Residential Green Waste Program to support these efforts. The Board of
Supervisors voted in 2022 to make this program permanentat an ongoing cost to the
NRRWF enterprise fund. Currently, the NRRWF utilizes an air curtain burner permitted
through the Butte County Air Quality Management District to dispose of green waste
generated by the program.
The NRRWF has a prior history ofutilizing resources to generate energy. In the mid-
2000s, Butte County received corrective action from the Regional Water Quality Control
Board to remove excess landfill gases (methane) from closed landfill modules. As the
County developed methodologies to remove methane, officials expressed interest in
monetizing the removal of excess methane. The County solicited proposals to utilize the
energy potential and produce financial benefits for the County in compliance with
applicable federal, state, and local regulations. In 2008, the County entered into a contract
with Ameresco to construct a power generation plant and the necessary transmission
facilities to nearby PG&E facilities on the northeast corner of the landfill site. Commercial
power generation began at the site in December 2012 and continues today.
Increased efforts to divert organic materials away from the landfill will likely help the landfill
extend its remaining capacity, while the successful utilization of these materials may help

support Statewide efforts to reduce Greenhouse Gas (GHG) emissions.
Property Purchase and Potential Uses
In response to a myriadof emerging needs and concerns, Public Works recently acquired
three adjacent parcels to the NRRWF totaling approximately 244 acres for $708,000 (see
Figure 1 Parcels 1-3). Public Works has also embarked on an ambitious Master Plan
process to evaluate existing landfill operations and make recommendations on future
operations and capital improvements. The Master Plan is currently in the beginning
phases, and potential alternatives for use of these additional properties won’t be fully
developed until the draft Master Plan is completed in early 2023. Until this analysis is
complete, it is unclear what potential uses of these properties may be.
In recent months, staff has been in conversation with organizations expressing interest in
operating various commercial facilities that would utilize forest biomass fuels in support
of defensible space and wildfire resiliency. Many of these organizations have expressed
interest in the potential sale or long-term lease of one or more of the aforementioned
parcels. These parcels are strategically located along Neal Road adjacent to the NRRWF
and provide nearby access to State Route 99 and areas with significant woody biomass.
The Board of Supervisors recognizes that one or more of these parcelsmay provide
opportunities for engaged stakeholders to develop sustainable solutions to support the
pursuit of improved wildfire resiliency and fuels management. While the current Master
Plan process includes effortsto develop potential alternative site uses, the Board has
also indicated that improved wildfire resiliency and fuels management efforts are a high
priority and cannot wait for the completion of the Master Plan processfor further analysis.
Recognizing that these parcels can potentially provide considerable benefit to the County
and the community, the Board of Supervisors has directed staff to issue a Request for
Proposals (RFP) for the potential use of these properties in support of fuels management
and wildfire resiliency efforts.
4) SCOPE OF SERVICES
The County anticipates that the firm selected for this work shall recommend sustainable
project(s) that can utilize one or both of the aforementioned properties based on several
criteriato support sustainable fuels managementand wildfire resiliency efforts in Butte
County.
In light of the tremendous destruction wrought by recent catastrophic wildfires,the
primary goal of this RFP is the highest and best use of the aforementioned parcel(s)
to process and/or utilize woody biomass fuels to improve wildfire resiliency and
support fuels reduction efforts in Butte County. Numerous secondary goals include –
but are not limited to - the project’s economic benefit to Butte County, reduction in GHG
emissions, opportunities to develop sustainable sources of renewable energy, direct and
indirect job creation, and compatibility/integration with NRRWF goals and objectives such
as compliance with SB 1383.

Butte County Public Works is open to various ideas and interpretations of this RFP to best
meet the goals and objectives of the stated project and strongly encourages anyone with
interest to submit a proposal. Respondents may include – but are not limited to –
corporations, non-profit organizations, quasi-governmental, governmental, and other
entities. The Department also encourages partnerships and relationships that can fully
take advantage of the available parcel(s) resources and infrastructure. While these
partnerships may be preliminary at the project proposal stage, the Department would
expect these partnerships to be well-defined before contract or agreement execution.
Although the potential opportunities to utilize the available parcel(s) and infrastructure in
support of fuels reduction and wildfire resiliency are numerous and diverse, some
potential options for the project site may include one or more of the following:
General waste-stream diversion
Reduce, re-use, recycle, recapture services
Organics diversion / processing
Green waste processing / composting
Municipal solid waste processing
Biomass conversion / utilization
Biochar, biocarbon, soil blending production
Alternative energy generation
Forest product manufacturing
General manufacturing
Wildfire recovery and resilience services
Education and training
With this in mind, applicants should develop a robust project proposal that best supports
these goals and objectives. Some areas of focus may include – but are not limited to –
the following items:
Overall project feasibility and sustainability
Proof of concept examples of other similar proposals or sites in California and/or
the western United States
The expected annual woody biomass that will potentially be utilized by the project
within Butte County and elsewhere (if applicable)
Identify whether woody biomass feedstock will be sourced within Butte County or
expand more regionally to include other nearby areas
Sustainable woody biomass feedstock partnership(s) and transport to and from the
project site as applicable
Project timeline and the expected date of project completion and implementation
Ability to identify and comply with all applicable federal, state, and local regulations
Ability to identify and secure all applicable licenses and permits
Ability to identify and secure all necessary financing to construct and operate the
project; and any funding expenditure deadlines
Ability to prepare all necessary reports and studies and solicit stakeholder support
for the project

Ability to navigate and secure environmental (CEQA & NEPA) clearance as
applicable
Ability to identify necessary improvements and mitigation measures necessary to
support project development
Ability to identify, create, and maintain sustainable partnerships with public, quasi-
public, non-profit, utility, and private entities in support of the proposed project
Understanding of and ability to successfully navigate the county’s development
and permitting process
The project’s short-term and long-term investment and economic impact, with a
specific focus on overall financial investment in the project, annual operating
budget, direct and indirect jobs, economic output, etc.
The recommended arrangement to secure the use of the subject properties(i.e.
purchase, lease agreement, etc.), the process to establish an agreement between
the applicant and Butte County to secure the necessary property rights, and the
length of the desired agreement if applicable
Thoroughly outline and describe the relationship between Butte County and the
applicant, including the use of Franchise Agreements orother revenue-based
agreements, necessary Memorandums of Understanding or Agreements, etc.
Describe any potential indirect or direct revenues that Butte County may expect
from the project if applicable, including annual revenue projections, franchise fees,
etc., and any contingencies
The project’s ability to reduce GHG emissions in alignment with the Butte County
Climate Action Plan, General Plan, and other applicable plans and programs
The ability to develop a sustainable source of renewable energy in alignment with
the Butte County Climate Action Plan, General Plan, and other applicable plans
and programs
The ability to integrate with and/or coexist with the NRRWF
The ability to accept and process other organic materials (in addition to residential
green waste) currently processed by the NRRWF
The ability to support and integrate the NRRWF’s Wildland Urban Interface
Residential Green Waste program into operations
The project’s ability to support the NRRWF’s ability to meet SB 1383 requirements
The ability (if applicable) to mix technologies and combine uses to maximize the
utilization of woody biomass and/or diverted landfill organics.

5) FORMAT FOR PROPOSALS
Responses to the Request for Proposals must be made according to the requirements
outlined in this section, both for content and for sequence. Failure to adhere to these
requirements, or inclusion of conditions, limitations, or misrepresentations in a response
may be cause for rejection of the submittal. Use 8-1/2” x 11” sheets (foldouts are
acceptable for charts, etc.). Type size must be large enough to be easily legible, but shall
not be smaller than 10-point. The County shall receive all Submissions no later than June
21, 2022, at 5:00 PM.
a) The response shall include a cover letter, a table of contents, and all items listed
below and shall be in the following format:
Submissions shall contain 1 (1) signed, unbound original and three (3) hard copies,
printed material on 8-1/2” X 11” paper.
One (1) electronic copy shall also be provided in CD or thumb drive format.
Submissions shall be in the order noted below.
Submissions may also include color and fold-out charts and graphs.
Mandatory Content and Sequence of Submittal:
i)The cover letter shall be a maximum two-page cover letter and introduction and
shall include the name and address of the respondent submitting the proposal,
together with the name, address, and telephone number of the contact person
who will be authorized to make representations for the respondent, the
respondent's federal tax ID number and a list of subcontractors, if any. The
cover letter shall include a statement that the proposal is valid for 90 days after
receipt.
ii) Table of Contents shall be a detailed Table of Contents and shall include an
outline of submittal, identified by sequential page number and by section
reference number and section title as described therein.
iii)Respondent’s Experience Summaryshall be a maximum of eight pages (not
including resumes) in length and shall describe the respondent’s experience.
Experience and focus in the public sector are of vital importance. The County
is looking to partner with a firm that has years of experience supporting wildfire
resiliency and fuels management. Resumesshould be included for any key
personnel to be assigned to this project. The proposal shall also include the
timeline for completing all required tasks. Describe related past projects
completed along with a discussion comparing similarities with this proposed
project. Please provide a comprehensive narrative history of the firm and its
experience in providing similar services to government municipalities, counties,
and departments.

This section shall also contain a comprehensive list of references preferably
including municipalities or government agencies wherein similar services were
performed. At a minimum, the following information must be included for each
client reference:
Client name, address, contact person name, telephone number, fax
number, and email address.
A detailed description of services provided similar to the services outlined
in the Draft Scope of Work, and dates of services performed
iv)Firm Capabilitiesshall be a maximum of six pages entitled “Firm Capabilities”,
and shall include a description of the proposing Respondent’s resources for
successfully developing and completing this project.
v) Costshall detail the cost or revenue portion of the proposal. Respondent shall
provide pricing based on the project scope of services. Respondent shall
provide an itemized breakdown of all costs or revenues associated with the
project. Prices or revenues quoted shall be valid for at least ninety (90) days
following the proposal submission deadline.
If an hourly rate is quoted, the anticipated total number of hours should be
included along with a not-to-exceed price for the project.
vi)Draft Scope of Workshall be identified as “Attachment III – Scope of Work” for
incorporation in the contract or agreement between the Respondent and Butte
County. This is the document in which the proposing Respondents are
requested to describe the work they will perform to complete this project. If
there are any tasks to be performed by the County, these tasks should be
clearly described as County tasks in the Draft Scope of Work. If the proposing
respondent included cost or revenue information in the proposal, the proposed
rates should be included in the Draft Scope of Work.
6) SELECTION PROCESS
The selection committee may include representatives from various departments of the
County. The criteria for selecting the firm areprovided below:
a. Relevant Experience and References. Does the Respondent have sufficient
similar experience in the kind of work required? Does the Respondent have a
reputation for being reliable, delivering on schedule, and performing tasks to the
satisfaction of its clients?
b. Project Understanding and Approach. Does the Respondent have an
understanding of the primary and secondary project goals and the project scope

of services? Does the Respondent have the ability to propose a project or
approach to meet those goals? Does the Respondent understand and account for
potential project issues or concerns? Does the Respondent have sufficient stability
and ability to meet the needs of the County both now and in the future? Does the
Respondent thoroughly understand the regulatory environment, CEQA/NEPA
project, permitting requirements, and other project milestones?
c. Ability to Meet Project Primary Goals.Does the proposed projectbest meet the
primary goals of wildfire resiliency and fuels management?
d. Ability to Meet Project Secondary Goals. Does the proposed project best meet the
second goals that include – but are not limited to the project’s economic benefit to
Butte County, reduction in GHG emissions, opportunities to develop sustainable
sources of renewable energy, direct and indirectjob creation, and
compatibility/integration with NRRWF goals and objectives?
e. Fiscal Impact or Benefit to the County.Does the proposed project thoroughly
outline and account for potential fiscal impacts and/or benefits to the County per
the scope of services? Does the project generate direct and/or indirect revenue?
Are those revenues sustainable? Are they contingent upon project variables?
f.Project FeasibilityDoes the proposed project have a strong likelihood of long-term
success? Does the proposed project adequately address potential issues and
provide specificity on solutions to those issues? Does the Respondent have a track
record of sustained project success in other communities, particularly in the state
of California?
g. Project Schedule Does the proposed project schedule include a reasonable
timeline to project implementation? How quickly can the proposed project begin
utilizing woody biomass fuels in Butte County?
The County may discuss the proposals and negotiate modifications of the proposal, draft
scope of work, terms and conditions, and pricing with the prospective firm as a part of the
selection process.

Selection may consist of two levels of review. Level I will consist of evaluating the
proposals to establishthe most qualified respondents. Level II will be used to select the
finalist. This level may include a request for a presentation/demonstration from the
finalists, proposal fact-finding, and negotiation of contract or agreement terms and
conditions at no cost to the County. The presentation/demonstration may be web-based
(i.e. Zoom) or in-person. The County may discuss the proposals and negotiate
modifications of the proposal, draft scope of work, terms and conditions, and pricing or
revenue structures with the prospective firms as a part of the selection process.

Questions:
Questions and requests for clarification may only be submitted through the Public
Purchase website. Verbal and phone inquiries will not be answered. All questions and
requests for clarification shall be submitted no later than June 9, 2022, at 5:00 PM The
County will provide answers and clarifications by posting an addendum(s) through the
Public Purchase website by June 15, 2022, so all Responders receive consistent
information. It is the responsibility of all interested firms to access the website for this

information. Questions received after June 9 may not be answered.
9) COUNTY NOTICES
All proposing firms responding to this RFP should note the following:
a) All work performed for Butte County, including all documents associated with the
project, shallbecome the exclusive property of Butte County.
b) The selected firm is expected to perform and complete the project in its entirety.
c) All costs including travel, arising from the development and delivery of a response
to this RFP incurred by any proposing firm shall be borne by the firm without
reimbursement by Butte County.
d) The selected Respondent shall remain an independent Contractor, working under
his/her supervision and direction, and is not a representative or employee of Butte
County. The Respondent agrees to file tax returns and pay all applicable taxes on
amounts paid according to this contract or agreement.
e) The opening of proposals in response to this Solicitation is not subject to
attendance by the general public. This restriction is necessitated by the factthat
the final contract or agreement is subject to negotiations, and it would be unfair for
competing companies to know the prices quoted by one another.
f) The successful Respondent must be prepared to begin work promptly following
contract or agreement execution and is expected to complete the project in its
entirety.
g) Issuance of this Solicitation in no way constitutes a commitment by the County to
award a contract or enter into an agreement. If the County determines it is in its
best interest to do so, no Respondent may be selected.

h) Upon acceptable negotiations, the Respondent shall be required to execute a
contract or agreement and comply with County insurance and indemnification
requirements.
i) The County reserves the right to request additional information from Respondents
that have submitted a response to this Solicitation and to enter into negotiations
with more than one Respondent should a contract be awarded or to award a
purchase order or contract to the Respondent(s) with the most favorable quotation
without conducting negotiations. The County reserves the right to award more
than one contract if it is in the best interest of the County.
j)The County reserves the right to reject any or all submittals received if the County
determines that it is in its best interest to do so. Further, the County may cancel
or amend this Solicitation at any time and may submit similar solicitations in the
future.
k) The County may reject any submittal that does not meet all of the mandatory
requirements of this Solicitation, is conditional, or is incomplete.
l) The County may request clarification of any submitted information and may
request additional information on any or all responses provided and may waive
minor inconsistencies deemed to be irrelevant.
m) Firms that submitted a proposal in response to an RFP but were unsuccessful in
their attempt to obtain a contract or recommendation for a contract or agreement
may request a debriefing to learn the general reasons for selection of a competitor
for contract award. Requests for debriefings shall be directed to the Public Works
Department, 7 County Center Drive, Oroville, CA 95965, telephone 530.538.7681.
Debriefings may be conducted via telephone, email, or during a face-to-face
meeting at the County offices in Oroville, California.
n) Firms that have received a debriefing, but continue to feel aggrieved in connection
with the solicitation or award of a contract or agreement may submit a protest to
the Director, Public Works, 7 County Center Drive, Oroville, CA 95965. All protests
must be made in writing, signed by an individual authorized to sign the submitted
proposal, and must contain a statement of the reason(s) for the protest: citing the
law, rule, regulation, or procedure on which the protest is based. Respondent’s
capabilities, project characteristics, and/or pricing features that were not included
in the firm’s proposal shall not be introduced during the protest process. The
protest shall be submitted within seven (7) working days after such aggrieved firm
knows or should have known of the facts giving rise thereto or within seven working
days following the debriefing.
o) The withdrawal of any submittal must be made in writing before the required
submission date and time and must be signed by an authorized representative of

the firm. An error in the submission may cause the rejection of that submittal.
However, the firm may reissue a new or modified submittal before the date and
time required for submission.
10) DISCLOSURE OF INFORMATION
All information and materials submitted to the County in response to this RFP may be
reproduced by the County to provide copies to authorized County personnel involved in
the evaluation of the proposals, but shall be exempt from public inspection under the
California Public Records Act until a contract or agreement is executed. Bid awards are
a matter of public record. Once a contract or agreement is executed, proposals submitted
in response to this RFP are subject to public disclosure as required by law. Your
submission of a proposal is considered your consent to the County’s disclosure of the
proposal. The County shall not be liable for disclosure of any information or records
related to this procurement.
