The BOF put out a new draft of the Fire Safe Regulations late last week that is a substantial
revamping of the proposed regulations. In essence the new draft removes many of the items we
have been concerned about. However, there are still concerning pieces to this latest draft. It reverts
back in many instances to the 2016 regulations. Reverting to the 2016 Fire Safe Regulations takes us
several steps backwards.
There is no relief for rebuilding structures that were destroyed during wildfires.
There is no exemption for ADUs and/or JADUs.
There are no provisions for the alternative design for existing roads.
The ability of some minor Use Permits to rely on Agriculture Roads has been eliminated.
We are working with others across the state to review these thoroughly and will be bringing a
recommendation to your attention in the near future.
