As a long time Butte County resident, and one that was gerrymandered 10 years ago, prior to the Fair Acts Maps, I find it disheartening and yes, embarrassing, watching the blatant disrespect for the will of the people and most important, the law. Please, do the right thing by adopting Map A-7. You'll be better people for it in the end. And please don't drag your constituents through a lengthy and costly lawsuit. Caitlin DalbySubmitted At: 10:57am 12-06-21I am a voter in Forest Ranch and urge you to approve map A7. Map A7 checks the boxes for fair representation among all citizens of subrban Butte County, including 3 primarily rural districts and 2 primarily urban districts. Map A7 does the things that are most important to ensure fair representation to all: a majority of half the citizens of Butte County live in Chico, and so Chico should be kept in tact "to the greatest extent possible". Additionally, Ororville should also be divided as little as possible. Map A7 divides Chico into 3 of the 5 districts, and Oroville into 2. Any further division will unfairly dillute the votes of the people whose needs and concerns, that of a more urban nature, differ greatly than those of us living in rural parts of the county. I also urge you to not dilute the vote of our agricultural region, which spans the western portion of the county, by splitting our primarily agriculturallands into two. Having one solid agricultural district and two solid mountain/foothill districts, we can ensure that there will be good representation for folks that have experiences outside the influence of our urban centers such as surface and ground water, soils, wildfire, timber, outdoor recreation, fisheries/wildlife, etc. Dividing Chico into 4 or more and Oroville into 3 or more districts goes against the Fair Maps Act, and chosing to draw lines in this way (such as Map A8, A9, ad A10) is a violation of your duty to follow the law and failure to uphold your oath of office. As a Forest Ranch resident, I urge you to move forward with map A7. As an elected school board trustee of Chico Unified School District, I urge you to not dilute the vote of our county's most densely populated urban center and to do your governance duty to follow the law. As a natural resources specialist, I urge you to keep strength in the voting population of our rural areas by keeping one agriculturecentric district and two mountain-forest-foothill districts. Map A7 is the best option for ALL Butte County citizens. Thank you for your consideration. The criteria set forth in recent meetings by the supervisorial majority ignores communities of interest and prioritizes the power and financial benefit of seated members of the Board of Supervisors over the voices of Butte County citizens. Supervisor Kimmelshue has been voting for his own financial gain regarding the Tuscan Water District, and should not be allowed to demand two representatives for a handful of wealthy big agribusiness owners in the sparsely-populated valley. As I mentioned in my comment for the previous meeting, the excessive list of line-drawing demands from the Supervisorial majority is intended not to ensure communities can organize together, but rather, to ensure they cannot. Their main goal is to demand so many useless things as to make it appear necessary to split Chico apart into four districts, so that our voices are fractured and diluted, allowing for the wealthiest ag landowners to continue dominating our County and its water resources. Please adopt Map A7, or as a second choice, the publicly-submitted map "Chico N/S, Foothills E/W". Thank you. Agriculture has been and will continue to be the driving force of Butte County's economy that effects the whole County and its residents. Butte County was founded by agriculture and still is its main economic stability. This should be recognized in leadership decisions. Thank you for your time and consideration on this matter. All districts for County Supes should be a mix of urban and rural for the very reasons that the Supervisors are a county government, and should not be dominated by Chico politics. Chico residents should acknowledge they are part of a rural county, and they can exert their political influence in Chico through the City Council. The map "requirements" of Mr Teeter are ridiculous and I do not see how redistricting partners can possibly make a map with his specifications and follow the FAIR Maps Act. I have confidence in the consultant that he will not do this...and so expect that the Board will not come to any conclusion on the 6th. My understanding is that the Map drawing will then go before a judge. What a great example of incompetence by this Board that they are unwilling to follow the law and create a Fair map. Hopefully the better angels within these men will come forward to accept a Fair Map such as A7, or 86812. Map A7 checks the boxes for fair representation among all citizens of suburban Butte County, including 3 primarily rural districts and 2 primarily urban districts. Map A7 does the things that are most important to ensure fair representation to all: a majority of half the citizens of Butte County live in Chico, and so Chico should be kept intact "to the greatest extent possible". Additionally, Ororville should also be divided as little as possible. Map A7 divides Chico into 3 of the 5 districts, and Oroville into 2. Any further division will unfairly dilute the votes of the people whose needs and concerns, that of a more urban nature, differ greatly than those of us living in rural parts of the county. I also urge you to not dilute the vote of our agricultural region, which spans the western portion of the county, by splitting our primarily agricultural lands into two. Having one solid agricultural district and two solid mountain/foothill districts, we can ensure that there will be good representation for folks that have experiences outside the influence of our urban centers such as surface and groundwater, soils, wildfire, timber, outdoor recreation, fisheries/wildlife, etc. Dividing Chico into 4 or more and Oroville into 3 or more districts goes against the Fair Maps Act, and choosing to draw lines in this way (such as Map A8, A9, ad A10) is a violation of your duty to follow the law and failure to uphold your oath of office. As a Forest Ranch resident, I urge you to move forward with map A7. As an elected school board trustee of Chico Unified School District, I urge you to not dilute the vote of our county's most densely populated urban center and to do your governance duty to follow the law. As a natural resources specialist, I urge you to keep strength in the voting population of our rural areas by keeping one agriculture-centric district and two mountain-forest-foothill districts. Map A7 is the best option for ALL Butte County citizens. Thank you for your consideration. The transmittal states that “[a]ll maps submitted by the consultants follow all legal requirements, including the Federal Voting Rights Act, Fair Maps Act and the Constitution.” I express no opinion as to whether the maps comply with the Federal Voting Rights Act. However, the statement is clearly wrong as regards the Fair Maps Act, and is likely wrong regarding the United States Constitution. Those maps submitted by the consultants, at the express request of the Republican members of the Board, that contain “two valley districts” or “two ag districts” cannot, given the demography of Butte County and the requirements of the Fair Maps Act, comply with that law. The requests are barely disguised political requests, deliberately made to favor Republican candidates and disadvantage Democratic candidates, and to dilute the votes of City of Chico voters. As explained in my November 29, 2021 letter on this topic, the majority’s pretextual instructions are in direct conflict with the Fair Maps Act, due to (a) splitting of communities of interest, (b) over- division of the City of Chico and sometimes Oroville, (c) favoring distant populations over nearer populations, and (d) the political motivation for gerrymandering such districts. Under both the United States Constitution and the Fair Maps Act, districts must be of nearly equal population. Given the census results, the average population of a newly drawn supervisorial district will be about 42,500. In the portion of Butte County west of Hwy. 99, and excluding the City of Chico, there are nowhere near 42,500 residents. The Tuscan Water District, which covers a great deal of this territory including much of Durham, but not Biggs, Nelson and Gridley, has only about 6,500 residents. Given where people live, the ag lands alone on the west side of the county do not merit even an entire supervisorial district, let alone two. This is why, in maps drawn by anyone actually attempting to comply with the Fair Maps Act, there is a single district on the west side that picks up some population from Thermalito, and from around populated areas near, but outside, City of Chico city limits. The “community of interest” criterion for drawing supervisorial district boundaries is that residents who share communities of interest should be kept together (subject to district size limitations) so that they may be effectively represented; to prevent line-drawers from dividing those who share common interests among two or more districts. The fact that a community of even 20,000 people wishes to be divided for purpose of gaining political power is an illegitimate 2 basis upon which to base district lines—it violates both Elections Code §§ 21500(c)(2) 1 and 21500 (d). (“The board shall not adopt supervisorial district boundaries for the purpose of favoring or discriminating against a political party.”) The gerrymandering instructions first drawn up by Republican consultant Josh Cook to create two “ag” districts have threefold political objectives: first, to secure representation, outsized in relation to population, to agricultural industry voters, who tend to vote Republican; second, to distribute right-leaning rural voters into more heavily Democratic districts, and third, to target Supervisor Lucero, who has come to be unfairly viewed by Republican campaign contributors from the agricultural industry to be “anti-ag.” The local Republican party has been grooming Peter Durfee as a candidate to run specifically against Supervisor Lucero. The maps earlier proposed by Redistricting Partners were likely unacceptable to the Republican partisans on the Board because, lacking political motive and applying objective criteria, Redistricting Partners proposed maps that had Supervisor Lucero and candidate Durfee in different districts. As noted in my November 29 letter, the Supreme Court’s interpretation of the state Constitutional language from which the Fair Maps Act is drawn makes clear that the Board cannot select, at its discretion, from among a number of maps the proponents claim satisfy the Fair Maps Act. The way the law is structured, if there is one best map, that is the only legally compliant map. If there are several maps that are equally maximally compliant, any one of those would satisfy the Act. Put another way, if a map can be drawn that meets the statutory criteria better than a proposed map, the proposed map does not satisfy the Fair Maps Act. A better map shows that the proposed map does not meet the criterion “to the extent practicable.” “Unlike former article XXI, section 2, or the judicial decision on which that provision was based, however, the current version of article XXI, in section 2, subdivision (d), expressly ranks the criteria in order of priority, stating explicitly that a lower-ranked criterion is to be followed only when doing so does not conflict with a higher-ranked criterion or criteria.” Vandermost v. Bowen (2012) 53 Cal.4th at 446, 448. The Vandermost Court rejected a proposed map on the ground that other, more criteria-compliant maps were available: “[I]nsofar as this alternative map is concerned, petitioner has provided us with no basis upon which we can conclude that it respects the constitutionally specified criteria at least as much as any of the other proposed maps . . .” Id. at 476 (emphasis supplied). The various maps included in the meeting notice published last week fare as follows under the Fair Maps Act: 1 “To the extent practicable, the geographic integrity of any local neighborhood or local community of interest shall be respected in a manner that minimizes its division” Cal. Elec. Code §21500(c)(2) (emphasis added). “The social and economic interests common to the population of an area which are probable subjects of legislative action, generally termed a "community of interests" (cf. Gov. Code, § 25001) should be considered in determining whether the area should be included within or excluded from a proposed district in order that all of the citizens of the district might be represented reasonably, fairly and effectively. Examples of such interests, among others, are those common to an urban area, a rural area, an industrial area or an agricultural area, and those common to areas in which the people share similar living standards, use the same transportation facilities, have similar work opportunities, or have access to the same media of communication relevant to the election process.” Reinecke, Legislature v. Reinecke (1973) 10 Cal.3d 396, 412 (footnote omitted and emphasis added). 3 Public Map 86812 (most compliant): Falls within acceptable population deviation Keeps agricultural community of interest intact; respects public input as to community of interests on the Ridge (Cohasset in same district as other Ridge communities); greater Oroville area (Berry Creek, Palermo, Honcut with most of Oroville); does not divide Mechoopda; keeps CSU residential area with Chico district; keeps Chico airport area with Chico Draws lines along designated census place and city boundaries with two exceptions: Chico in three districts; Oroville in two. Given Chico’s population and the population of supervisorial districts, dividing Chico into three districts is unavoidable. Boundaries are easily identifiable – e.g., follows creek in Chico. Compactness: high density areas in Oroville and Chico are kept associated with other high density areas in those cities. Because this was the first time this criteria was mentioned, can you clarify which boundary the consultant used (high school or elementary or both), and why. The high school boundary seems appropriate for using the same street level splits that align with a major community of interest. The elementary boundaries would confirm neighborhoods. I think both should be used for purposes of street guidance. Because the consultant maps don't show streets it is very difficult for the public who live there to verify. In fact it has been the most frustrating part of the process. So I support using those maps for alignment with the right street jigs and jags. Or to confirm where all neighborhoods are around the elementary schools (and not just the neighborhoods a few citizens have mentioned). Because of the limited time due to COVID, the more existing resources you have the better this will hold up. With that, if the school map is used to draw borders for continuity to the County and be easily identifiable to residents, why not use the District maps drawn for the other Chico elected officials? The CUSD Trustee map and the Chico City Council District map? This is how we vote in Chico. It should align! It wasn't a big deal two years ago when these were "member at large" elections. But now everything is Districted. It is actually confusing and people are still getting .ATTENTION: This message originated from outside Butte County. So if you really mean you want continuity, minimize the division by using existing maps! They get reviewed with the census, are based on the same criteria and laws, and are now accepted and understood. Right now I think the County needs an additional way to show faith within the City of Chico so using their other two elected maps would be a great start. I don't know why this isn't a standard part of the process, and my first stated COI was my Chico District boundary. So I strongly encourage using the elected official maps for the City of Chico and the CUSD to align with the elected official map for the County. Also, for the public record, if you want FOUR Board members to divide Chico, that means you have changed philosophy radically. Past comments and voting patterns have proven that the Rural Supervisors don't want or need to be concerned with Chico because of City Councils. Four suggests you want Chico to have LESS voice, or that you truly commit to changing philosophy and want to partner MORE on Chico's urban needs. Which one is it? Over the past year, the Rural Supervisors (Teeter and Connelly) have consistently voted against the urban needs of Chico (regardless of politics). I have heard them say "I don't care about Chico", "Chico can do what it wants", "Chico's homeless problem is not my problem":, etc etc. I thought it was personal but now I don't know. Teeter and Connelly voted against the committed $1.7M for an emergency shelter in Chico "they can wait for whatever stimulus we get next year" or "why do they get an emergency shelter when Paradise doesn't". THE HOMELESS IN CHICO COME FROM PARADISE AND OROVILLE. And you know it's an emergency. And when you flip/flopped on the vote after a quick bathroom break, it confirmed that it was politics and nothing else. ARE YOU BEING HONEST TO THE PUBLIC? Do leaders of rural areas intend to change and more closely support the needs or the urban centers? Obviously this puts MORE PRESSURE on the relationships between the five supervisors. How are we to believe things will change for the better if we live in Chico? I think this is lip service. Communities in the unincorporated areas North and Northwest of the City of Chico are considered local neighborhoods of Chico. The residents in these areas share a community of interest with the City of Chico because they share common social and economic interests with residents in the City of Chico. The Fair Maps Act states that to the extent practical, communities of interest shall be respected in a manner that minimizes its division. Therefore, unincorporated areas of North and Northwest Chico should be connected to a Chico district. Map A7 is in violation of the Fair Maps Act as it divides unincorporated North and Northwest Chico away from the City of Chico. The Fair Maps Act also states that supervisorial districts shall be drawn to encourage geographical compactness in a manner that nearby areas of population are not bypassed in favor of more distant populations. Map A7 directly violates this section of the Fair Maps Act as the unincorporated areas of North and Northwest Chico have been drawn into a district that stretches all the way down to the southern border of Butte County. In order to encourage geographical compactness and be in compliance with the Fair Maps Act, unincorporated areas of North and Northwest Chico should be combined with a City of Chico district and not bypassed as Map A7 suggests. The Fair Maps Act is the law and we need to follow the law. Proposed maps which do not follow the law could lead to costly litigation. I do not think that it is fair to approve something which is illegal and will cost the County even more money than we have already spent. We the people of Butte County have hired mapping experts who were approved by the Board of Supervisors at a cost to the tax payers of $80,000. They have drawn up a map A7 at the last supervisors meeting which meets all of the legal requirements and fulfills the requests of the people of Butte county who are interested enough in this process to take the time to contact the Board with their requests. I want to see passed a map which doesn’t cut up Chico into more than 3 districts of similar interest. I also feel that Oroville shouldn’t be cut up into more than 2 districts. Map A7 does these 2 things plus keeps areas of interest in the county together. Foothill area with fire and rebuilding, agricultural area with water and perhaps need for crop changing, the large metropolitan area of Chico with Bidwell Park and Oroville area with concerns about the Dam.. Of the 8,898 U.S. deaths reported as of November 19, 20% occurred within 24 hours of vaccination, 26%occurred within 48 hours of vaccination and 56% occurred in people who experienced an onset of symptomswithin 48 hours of being vaccinated. The criteria set forth in recent meetings by the supervisorial majority ignores communities of interest and prioritizes the power and financial benefit of seated members of the Board of Supervisors over the voices of Butte County citizens. Supervisor Kimmelshue has been voting for his own financial gain regarding the Tuscan Water District, and should not be allowed to demand two representatives for a handful of wealthy big agribusiness owners in the sparsely-populated valley. As I mentioned in my comment for the previous meeting, the excessive list of line-drawing demands from the Supervisorial majority is intended not to ensure communities can organize together, but rather, to ensure they cannot. Their main goal is to demand so many useless things as to make it appear necessary to split Chico apart into four districts, so that our voices are fractured and diluted, allowing for the wealthiest ag landowners to continue dominating our County and its water resources. Agriculture has been and will continue to be the driving force of Butte County's economy that effects the whole County and its residents. Butte County was founded by agriculture and still is its main economic stability. This should be recognized in leadership decisions. Thank you for your time and consideration on this matter.
