Please see additional information and timeline regarding the situation that Mr. Mento spoke about.
This is a code compliance case for building without permits since March of 2020.
In March 2020 we received a complaint that a storage building was being converted into living
space. A code enforcement officer visited the site on 3/11/20 and observed the contractor
and an employee working on a new structure. He informed them that they were to stop work
and contact our department to obtain the necessary building permits.
The Building Division Manager made contact with Mr. Minto and scheduled a meeting for the
following day (3/12/20) to discuss construction requirements within a special flood hazard
area and help direct the contractor as to the review process.
At that meeting Mr. Minto indicated that he did not intend to stop work as directed so a
formal complaint was submitted to the Contractor’s State License Board (CSLB).
An incomplete permit application was received and a site visit completed by the Building
Division Manager on 3/23/20 to better understand the extent of the work and to advise the
contractor accordingly. The conclusion of the site visit was that this was not a simple repair
project as described by the contractor but rather a complete demo and rebuild of the
structure from the foundation up including a small living area (see attached email sent
3/25/20). The contractor continued work in violation of the stop work order so another order
was posted and another communication was sent to CSLB.
The contractor then complained to Supervisors Ritter and Lucero resulting in a meeting that
included the CAO, DDS Director, Building Division Manager, and Mr. Minto where information
was again provided including another follow up email dated 4/8/20 (see attached). This email
was slightly amended from the original list based on the contractor stating that they would
revise the scope to eliminate the apartment.
We have yet to receive any revised plans or permit application for the work which was started
in 2020. The code enforcement case was recently reassigned to a new officer who sent a
follow-up notice in an attempt to gain compliance which brings us to the conversation today.

re-build.
Flood Elevation certificate will be required since this is 100% new construction from the
foundation to the roof and located within a FEMA flood hazard area
Due to the proximity of this to the floodway, this project must be approved by the Central
Valley Flood Protection Board (CVFPB). We suggest that you reach out to them in advance of
submitting application to be sure this project will be approved. Upon receiving a full
application, plans, and fees we will forward all documents to the CVFPB for their approval.
Complete Hazmat form
Foundation Plan:
o Plans state existing foundation plan but per the site visit and your comments, a new
foundation was poured
o The foundation detail does not appear to match what you have stated regarding the
existing slab remaining. Please revise
o Note, per our as-built policy you will be required to obtain a third party special
inspection of the foundation and slab to verify size and rebar in accordance with the
plans
o This detail was cut and pasted from another plan and is referencing additional details
and plan sheets that have not been provided
Floor Plan:
o Provide an existing and proposed floor plan. You had indicated that the bathroom area
has changed
o Label all rooms and code compliant details for the fire barrier between the two
separate occupancies
o Provide full electrical plan including locations of all outlets
o Provide location of all mechanical equipment
o Provide braced walls per code or engineered shear walls as your detail indicates
o What appears to be a bedroom has no egress window.
o Verify minimum natural light and ventilation to all rooms
o Provide Attic ventilation, calculations, and attic access location
Provide complete framing details including all connections to complete the load path from the
roof to the foundation, insulation, wall/ceiling coverings, etc.
Provide Energy Calculations
New or Re-built dwellings require PV solar per energy code
Provide Calgreen Checklist
Provide details and notes to reflect compliance with the CA Building, Residential, Electrical,
Plumbing, Mechanical, Cal-Green, and Energy codes as well as applicable state laws.
Provide the owner’s and designer’s contact info on Cover Sheet and the designer’s signature
on all plan sheets

prior to submittal

Jim,
I have attached the flyer that is also located on our Building Division Webpage explaining how we are
conducting business and providing all building permit services during this very serious COVID-19
time we are facing. We will be available for your permit needs via electronic documents or paper if
you choose, however you must know as we discussed paper plans, checks etc. are quarantined for a
period of time so we encourage electronic methods to expedite permits.
Here is a revised list of what is needed for this to be considered a complete submittal for the re-
construction of an Agricultural Building in a flood zone based on your recent comments there is no
residential space. The level of detail specified below is reflective of the plans and application
documents you had previously submitted to us electronically.
Application not complete:

improvement by County Code and FEMA standards. The appraisal submitted does not satisfy
the criteria for determination of substantial improvement since the entire structure has
been re-built from the foundation to the roof.
Note: Due to the proximity of this structure to the floodway, this project must be approved by
the Central Valley Flood Protection Board (CVFPB). We suggest that you reach out to them in
advance of submitting application to be sure this project will be approved. Upon receiving a
full application, plans, and fees we will forward all documents to the CVFPB for their
approval.

our previous meeting, a new foundation was poured. Revise plans for accuracy
o The foundation detail does not appear to match what you have stated regarding the
existing slab remaining under the new slab and foundation. Please revise

inspection of the foundation and slab that was poured without the benefit of County
inspection to verify size and rebar in accordance with the plans
o The footing detail was cut and pasted from another plan and is referencing additional
details and plan sheets that have not been provided, please revise detail for accuracy
or provide additional plans and details as referenced
Floor Plan:
o Provide an existing (prior to the demo) and proposed floor plan. You had indicated that
the bathroom area has changed and that is all but the plans do not show what was
changed.
o Label all rooms. The room with a refrigerator, counter and sink are not consistent with
a U occupancy. Be sure to classify this space in accordance with the current Ca
Building Code
o Provide full electrical plan including locations of all outlets, wiring type used, and
applicable notes specific to the occupancy in which the electrical is installed in
accordance with CA Electrical Code
o Provide location of all mechanical equipment and sufficient notes depicting
compliance with the current CA Mechanical Code
o Provide braced walls as required by code or provide engineered shear walls as your
detail currently indicates and provide engineered calculations
o Verify minimum natural light and ventilation to all rooms based on minimum code
requirements for the specified occupancies
o Provide Attic ventilation, calculations, and attic access location if there is to be a ceiling
separation installed
Provide complete framing details including all connections to complete the load path from the
roof to the foundation. Include insulation, wall/ceiling coverings, shear or braced wall
components,etc.
Comply with Ca Energy Code requirements for the specified occupancies and show compliance
on plans and/or calculations as required
Provide Calgreen Checklist
Provide details and notes to reflect compliance with the CA Building, Residential, Electrical,
Plumbing, Mechanical, Cal-Green, and Energy codes as well as applicable state laws.

Building Division Update as of 3/20/2020
In accordance with the order for Statewide Shelter in Place, construction has
been deemed to be essential critical infrastructure.
Permit Center
Butte County Building Division is moving quickly to adapt to Novel Coronavirus (Covid-19). We have
implemented procedures to ensure we are able to maintain our normal turnaround times on plan
review and permit issuance. We are experiencing higher call volume and temporary delays while we
mobilize staff to work remotely.

Permit Submittals–We are accepting digital submittals via DSBuilding@buttecounty.net or by

obtain an application (DBP-01) or any other applicable documents relevant to your submittal.
Permit Issuance – Once your permit has been approved, we will issue the permit and send you the
approved plans digitally so they can be printed for future inspections.

Plan Review
Building Division staff and consultants will continue to review and approve your
building plans during the period of our office closure.
Digital Plans:
•Building Division staff and consultants will be reviewing digital plans remotely. Our office closure
will not impact the time spent completing reviews.
•If your original plan submittal was in the form of paper plans, you may resubmit in a digital
format to expedite approval of your project. Be sure to submit complete sets of plans,
calculations, supporting documents, etc. for review.
•Once approved, permit staff will work with the applicant to get the permit issued and a copy of
the approved digital plan set will be emailed to the applicant. The applicant will then need to
print the plans and have them available during all inspections.
•Digital plan submittals can be done through email at dsbuilding@buttecounty.net or for large
set of plans through our UShare at

Paper Plans:
•New paper plan submittals will be accepted at this time by appointment.
•Current projects using paper plans that are in the process of being issued may work with the
permit center to convert to a digital format or schedule an appointment to obtain their
approved set of plans.
Please Note: Submission of paper plans is a less efficient option resulting in longer permit processing
and plan review timeframes.
Inspections
We are currently providing inspection for all permits. You may schedule an inspection via our
automated IVR system at 530.538.4365, online via etrakit at https://permits.buttecounty.net/eTRAKiT/,
or by phoning the permit center at 530.552.3699
We ask that you help us reduce the spread of illness through the following safety measures:
Actively encourage sick employees to stay home
Provide adequate washing facilities for staff in accordance with Cal/OSHA guidelines
Limit the number of personnel on site during the time of inspection
Please respect and maintain a minimum of 6’ for social distancing for work crews and inspection
staff when possible
**If inspection of occupied portions of dwelling or business are required, please coordinate with your
inspector to complete the inspection via facetime, photo, video, or other approved options. If approved
alternative options are not provided by the owner/contractor, inspections will not be provided.
