This is a code compliance case for building without permits since March of 2020. In March 2020 we received a complaint that a storage building was being converted into living space. A code enforcement officer visited the site on 3/11/20 and observed the contractor and an employee working on a new structure. He informed them that they were to stop work and contact our department to obtain the necessary building permits. The Building Division Manager made contact with Mr. Minto and scheduled a meeting for the following day (3/12/20) to discuss construction requirements within a special flood hazard area and help direct the contractor as to the review process. At that meeting Mr. Minto indicated that he did not intend to stop work as directed so a formal complaint was submitted to the Contractor’s State License Board (CSLB). An incomplete permit application was received and a site visit completed by the Building Division Manager on 3/23/20 to better understand the extent of the work and to advise the contractor accordingly. The conclusion of the site visit was that this was not a simple repair project as described by the contractor but rather a complete demo and rebuild of the structure from the foundation up including a small living area (see attached email sent 3/25/20). The contractor continued work in violation of the stop work order so another order was posted and another communication was sent to CSLB. The contractor then complained to Supervisors Ritter and Lucero resulting in a meeting that included the CAO, DDS Director, Building Division Manager, and Mr. Minto where information was again provided including another follow up email dated 4/8/20 (see attached). This email was slightly amended from the original list based on the contractor stating that they would revise the scope to eliminate the apartment. We have yet to receive any revised plans or permit application for the work which was started in 2020. The code enforcement case was recently reassigned to a new officer who sent a follow-up notice in an attempt to gain compliance which brings us to the conversation today. Flood Elevation certificate will be required since this is 100% new construction from the foundation to the roof and located within a FEMA flood hazard area Due to the proximity of this to the floodway, this project must be approved by the Central Valley Flood Protection Board (CVFPB). We suggest that you reach out to them in advance of submitting application to be sure this project will be approved. Upon receiving a full application, plans, and fees we will forward all documents to the CVFPB for their approval. Complete Hazmat form Foundation Plan: o Plans state existing foundation plan but per the site visit and your comments, a new foundation was poured o The foundation detail does not appear to match what you have stated regarding the existing slab remaining. Please revise o Note, per our as-built policy you will be required to obtain a third party special inspection of the foundation and slab to verify size and rebar in accordance with the plans o This detail was cut and pasted from another plan and is referencing additional details and plan sheets that have not been provided Floor Plan: o Provide an existing and proposed floor plan. We will be available for your permit needs via electronic documents or paper if you choose, however you must know as we discussed paper plans, checks etc. are quarantined for a period of time so we encourage electronic methods to expedite permits. The room with a refrigerator, counter and sink are not consistent with a U occupancy. Curtis Building Division Update as of 3/20/2020 In accordance with the order for Statewide Shelter in Place, construction has been deemed to be essential critical infrastructure. Permit Center Butte County Building Division is moving quickly to adapt to Novel Coronavirus (Covid-19). We have implemented procedures to ensure we are able to maintain our normal turnaround times on plan review and permit issuance. We are experiencing higher call volume and temporary delays while we mobilize staff to work remotely. If approved alternative options are not provided by the owner/contractor, inspections will not be provided.
