SUBJECT: Encroachment Permit Application No. 19522
DearMr. Sandhu:
The review of your application, to authorize a new 50-foot by 20-foot agricultural building, has
been on incomplete status for an extended period due to the lack of requested information. The
request for more information was due to the scope of work, initially described as repairs to an
existing building, which does not reflect the actual work performed. The “existing building” was
completely rebuilt, down to a new slab foundation, which does not fit the “repairs” or
“improvements” request. Therefore, a new structure constructed within the Sacramento River
Designated Floodway needs to be permitted. A response to the original request for additional
information occurred on August 23, 2021, in which you noted that your representative at the
time, Jim Minto, left the project without notice and you would be proceeding with processing the
permit application. Afterwards, Mr. Minto started contacting the Board but since he had left the
job, we requested confirmation that he was still your representative on this project. We sent
several requests to confirm that Mr. Minto was indeed representing you again, but it was never
confirmed. The Board will not share applicant information with unauthorized personnel.
It was requested that a revised permit application, to permit a new building, be submitted. In
addition, it was requested that an additional $1,400 be submitted to complete the $2,000
review fee for a new structure encroachment review. The information and fee are required
before the review of your application can continue.
If the requested information regarding your application has not been received within 30
calendar days from the date of this letter, your application will be administratively closed and
referred to the Board’s Enforcement Section. If you choose to move forward with your
application at a later date, the submittal of a new encroachment permit application, including
current applicable fees, will be required.
Please be advised that projects built without a valid permit within the jurisdiction of the Central
Valley Flood Protection Board may lead to an enforcement action, which could require removal
of the encroachment and may subject you to penalties. Unauthorized encroachments may be
subject to administrative penalties of no less than $500 and no more than $50,000 per
California Water Code Section 8704.1. Please see Section 8704 of the Water Code for other
penalty provisions.
