Dear Secretary Bose:
Pacific Gas and Electric Company (PG&E) is writing to seek approval for an extension of
time to install a cap at Milk Ranch Conduit Diversion No. 8 for PG&E and City of Santa
(Licensees) Bucks Creek Hydroelectric Project, Federal Energy Regulatory
Commission (FERC) No. 619.
FERC issued a new license for the Bucks Creek Hydroelectric Project on June 16, 2022
(License). Subsection (b) of Article 401 of the License requires Licensees to submit a Milk
Ranch Conduit Diversions (Modifications) Management Work Plan for FERC approval 90
days prior to starting work. State Water Resources Control Board (SWRCB) Water Quality
Certification Condition 2 (Condition 2) and Forest Service (Forest Service) 4(e) Condition
No. 32 (Condition No. 32) of the License requires the Licensees to install a cap or cover
that will completely close and secure the diversion pipe into the Milk Ranch Conduit, thus
allowing full natural flow to enter Bear Ravine within 60 days of license issuance. PG&E is
further required to screen air vents to prevent wildlife from entering them. Prior to any
modifications, Condition 2 and Condition No. 32 also require PG&E consult in the field with
the Forest Service, United States Fish and Wildlife Service, California Department of Fish
and Wildlife, and State Water Board staff. Following consultation, PG&E must submit
proposed modifications to the Forest Service and State Water Board for review and
approval prior to filing for authorization with FERC.
Licensees will cease diverting from Bear Ravine into Milk Ranch Conduit at Milk Ranch
Conduit Diversion No. 8 by closing the diversion gate by September 1, 2022. However,
Licensees need to develop the Work Plan to cap the diversion pipe and screen the air
vent, as described above. Per Condition 2 and Condition No. 32, this requires:

Construction must avoid the winter limited operating period of November 1 through April 15
for in-water work included in the Sierra Nevada Yellow-legged Frog Management Plan (the
diversion structure would likely be inaccessible due to snow at this time in any case), and
otherwise avoid impacts to Sierra Nevada Yellow Legged Frog. Based on the steps
required to develop this work, obtain required approvals, and complete the construction
PG&E respectfully requests until October 31, 2023 to complete this work.
