Extension of Time Request - Poe Hiking Trail Plan and Schedule
Dear Secretary Bose:
This letter requests an extension of time to meet order paragraph E of the Federal Energy
Regulatory Commissions (FERC) February 28, 2022, Order Modifying and Approving
Recreation Plan Under Article 404 (Order). This Order concerns Pacific Gas and Electric
Poe Hydroelectric Project, FERC No. 2107. In this Order, FERC directed
PG&E to file a plan and schedule for construction of the Poe Hiking Trail within six months of
the date the Order was issued. PG&E filed a request for rehearing for the Order on March 30,
2022. The rehearing request was operationally denied on May 2, 2022; however, FERC
stated,
As provided in 16 U.S.C. § 825l(a), the request for rehearing of the above-cited order
filed in this proceeding will be addressed in a future order to be issued consistent with
the requirements of such section. As also provided in 16 U.S.C. § 825l(a), the
Commission may modify or set aside its above-cited order, in whole or in part, in such
manner as it shall deem proper.
FERC has not yet issued the future order, which may modify or set aside the requirement to
file a plan and schedule. PG&E respectfully requests an extension of time to meet the
requirements in order paragraph E until 90 days after FERC issues the future order or
December 31, 2023, whichever comes first.
