This report summarizes the March 31, 2022 meeting between the Pacific Gas and Electric Company (PG&E, or Licensee) and the United States Department of Agriculture, Forest Service, Plumas National Forest (Forest Service) on measures to ensure the protection and utilization of National Forest resources affected by the Poe Hydroelectric Project, Federal Energy Regulatory Commission (FERC) No. 2107. This meeting satisfies the Forest Service 4(e) Condition No. 3: Consultation, which states, Each year between March 15 and April 15, the Licensee shall consult with the Forest Service with regard to measures needed to ensure protection and utilization of the National Forest resources affected by the Project. Within 60 days following such consultation, the Licensee shall file with the Commission evidence of the consultation with any recommendations made by the Forest Service. Generally, measures to ensure the protection and utilization of National Forest Resources affected by the Poe Project are required either by requirements in the license or commitments of management plans. In this report, these requirements and commitments have been organized into four sections: ongoing, conditional, pending, and completed measures. Ongoing measures are actions that PG&E or the Forest Service are currently taking or actions PG&E, and the Forest Service, are required to discuss during this meeting as outlined in the license or management plans. Conditional measures are actions PG&E, or the Forest Service, will take under certain circumstances outlined in the license or management plans. Whether those conditions are applicable for specific construction projects havebeen discussed during that section. Pending measures are actions that PG&E will take once FERC orders approval of a management plan (see Appendix A for a Resource Management Plan Status Update table). Implementedmeasuresare actions taken or one-time actions to protect National Forest Resources. This format is to facilitate efficient discussion and focus on relevant topics, while not losing what has been done or will be done to ensure the protection and utilization of National Forest resources affected by the Poe Hydroelectric Project. Poe Hydroelectric Project, FERC Project No. 2107 Condition No. 3 Report Figure 1 – Project Map Poe Hydroelectric Project, FERC Project No. 2107 Condition No. 3 Report Ongoing Measures Condition No. 5: Hazardous Substances Plan Plan Requirement: Each year during the term of the License, the Licensee shall annually consult with the ForestService to discuss hazardous materials on NFS land within the FERC Project Boundary. At this time, the Licensee will report on spills of hazardous materials on NFS land in the previous calendar year, if any, and list any work planned on NFS land in the upcoming calendar year that will require the development of a project-specific spill prevention and control plan. This meeting is intended to occur as part of the Annual Forest Service Consultation, Condition No. 3. The Licensee will maintain a record of the meeting for inspection by FERC. Actions completed in 2021: A Hazardous Substance Plan was approved by FERC on January 12, 2021. In 2021, no hazardous materials were spilled on National Forest Service lands. Proposed actions for 2022: The plan will continue to be implemented as written. More information on specific proposed construction projects can be found in the section titled ”2022 Anticipated Construction Projects” under the Conditional Measures section. Condition 11: Riparian Monitoring Proposed revision from November 15, 2021, letter to Forest Service: T his plan requires PG&E to assess the potential changes in riparian vegetation in response to flows and evaluate trends over time. Monitoring will occur every 10 years. Currently, the plan allows PG&E to reduce flow in years where fish and BMI monitoring occur at the same time; however, over the life of the license, there will be instances when riparian monitoring occurs independently. In these years, PG&E requests approval to modify stream flows consistent with the Fish and BMI Plan. Proposed actions for 2022: Once the revised plan is approved by the Forest Service and SWRCB, PG&E will file the revised plan with FERC. As written in the Riparian Monitoring Plan, if PG&E does not adopt a particular recommendation, the filing to FERC will include the reason for not doing so. Poe Hydroelectric Project, FERC Project No. 2107 Condition No. 3 Report Condition No. 23: Streamflow Part 1. Minimum Streamflows Potential Revision: Awaiting revised 4(e) to revise minimum streamflow language to match SWRCB 401 Certification flow condition language. Another section to consider revising is the outage notification requirements. It states that, Licensee shall provide written notification to the Forest Service 90 days prior to any planned or scheduled maintenance outages that would affect stream flows in the Poe Project bypass reach. The Licensee shall schedule the timing of maintenance or other planned outages to the extent possible, avoiding negative ecological effects from the resultant spills. Notification shall include a description of Project and coordinated measures the Licensee plans to take to minimize the magnitude and duration of spills into the Project reach. The Licensee shall not proceed with the planned maintenance outage without the formal written approval of the Forest Service. The Forest Service will respond in a timely manner. PG&E does not always have 90 days prior to planned outages. This happened in February, where there was an outage that was informally communicated during the January 19, 2022 Rock Creek Cresta ERC meeting, but 90 days prior notice was not available due to shifting resource concerns. This outage occurred during winter; consequently, it had no potential to negatively impact the environment or biology. Proposed actions for 2022: PG&E will maintain releases from Poe Dam as outlined in Table A-1. There are no planned outages in the remainder of 2022. Flows will be modified as written in various biological plans. Part 6. Tributary Access Actions completed in 2021: After consultation the plan was approved by Forest Service on March 6, 2020, filed for FERC approval on March 27, 2020, and approved by FERC on July 23, 2020. The Tributary Access Monitoring Plan required PG&E to install a permanent reference stage pin at Flea Valley Creek and a temporary reference stage pin at Mill Creek between August and October 2020. Drone photos were also required, however due to the Claremont - North Complex Fire airspace restrictions, these activities could not be completed. The PG&E biologist and surveying team was able to safely access Flea Valley Creek on November 5, 2020. During this site visit photos were collected with a handheld camera, Poe Hydroelectric Project, FERC Project No. 2107 Condition No. 3 Report the permeant reference pin was installed, and stage height was calculated at Flea Valley Creek. At Mill creek the temporary stage pin could not be installed, and drone photos could not be collected due to ongoing road and culvert construction. A second site visit was performed on November 20, 2021, to capture photos at Mill Creek with drones. No attempt was made at Mill Creek due to the construction activities. During a consultation meeting with PG&E, the Forest Service and the SWRCB on December 11, 2020, it was determined that monitoring at Mill Creek should not start until after 2022 since construction is not expected to be completed until June 29, 2021. This work has been deferred for safety reasons and because it would be best to capture conditions after the construction is completed. Proposed actions for 2022: As discussed in the agency meeting in February, PG&E will implement monitoring this year; however, PG&E will submit a Tributary Access Plan for revision to the agencies. PG&E expects to revisit Mill Creek in the October - November 2021 timeframe to install a permanent stage pin, take initial stage measurements, and photos. Per consultation with the Forest Serve on February 9, 2022, PG&E will begin monitoring in 2022 per the schedule in the study Plan. Condition No. 24: Recreation River Flow Management Plan Requirement: To meet the Forest Service consultation requirements in Condition No. 24, Part 2, the \[proposed recreation release schedule\] schedule will be discussed during the annual consultation with the Forest Service (required under Section 4(e) Condition No. 3). Proposed actions for 2022: Per the March Water Year Type, 2022 is currently classified as Dry. Per the Recreation Management Plan, In dry and critically dry water years, scheduled boating flows will be provided the second weekend in October between the hours of 9am and 3pm. The releases will be 1,400 cfs on Saturday and 1,400 cfs on Sunday. However, due to an outage upstream at Cresta, PG&E is looking into having recreation flows the first weekend in October instead. PG&E will submit a formal proposed recreation release schedule to the SWRCB, Forest Service, and RTRG by May 1, 2022. Poe Hydroelectric Project, FERC Project No. 2107 Condition No. 3 Report Condition No. 25: Poe Reach Biological Monitoring Fish and BMI Monitoring Plan Actions completed in 2021: In 2021, BMI sampling occurred September 20 – 21 and Fish sampling occurred September 22 – 24. Because of safety concerns from recent fires, no BMI reference sites were sampled. Proposed actions for 2022: PG&E submitted the draft Fish and BMI Monitoring Reports to the Forest Service on March 7, 2022, for a 60-day review. PG&E will file with FERC by May 31, 2022, after comments received have been addressed. PG&E will schedule flows of 55 cfs to perform surveys from the afternoon of September 18, 2022, to the afternoon of September 28, 2022. Flows will be returned to baseflow earlier than scheduled if data collection is completed ahead of schedule. PG&E will seek a flow variance to decrease flows to 55 cfs during these surveys. Forest Service to modify 4(e) condition to allow flow decrease without variance. PG&E will seek a variance to the Plan to incorporate the following changes: 1) sampling for fish and BMI at the Flea Valley Creek site instead of directly below the dam (as was done in 2022); 2) backpack electrofishing at the Bardees Bar site will be omitted and this site will solely be surveyed with snorkeling; 3) PG&E is going to attempt to collect BMI at Yellow Creek as a reference site instead of Stag Creek. In addition, PG&E will coordinate with the CDFW Aquatic Bioassessment Lab (ABL) to have an audit of 2022 BMI sampling at Bardees Bar to ensure that the SWAMP methodology is used appropriately for this deep site. Recommendations that result from the audit will be proposed to the Forest Service and Waterboard. Ultimately all of these changes will be incorporated into an amended Plan. Amphibian Monitoring Plan. Actions completed in 2021: PG&E performed monitoring for foothill yellow-legged frog in 2021. Monitoring included egg mass surveys and one reach-wide survey in October. Two additional young-of-year reach wide surveys were scheduled to be performed in August and September of 2021; however, they were cancelled due to the Dixie Fire. Smoke-caused air quality issues, road closures and subsequent Forest Service lands closures prohibited safe access to the watershed. Assessments of potential breeding habitat identified outside of designated breeding sites, which was scheduled to be completed during fall reach-wide surveys, were not completed because of the cancellation of two of the three scheduled reach- Poe Hydroelectric Project, FERC Project No. 2107 Condition No. 3 Report wide surveys. Habitat assessments for any potential breeding habitat will be completed in fall 2022. PG&E submitted the draft 2021 foothill yellow-legged frog monitoring report to the Forest Service on March 15, 2022 for 60-day review, and will file with FERC by May 31, 2022. Proposed actions for 2022: PG&E will continue foothill yellow-legged frog monitoring, in accordance with the Amphibian Monitoring Plan, in 2022. Assessments for additional potential breeding habitat will be completed for the remainder of the reach during the fall reach-wide surveys. Condition No. 26: Recreation Plan Plan Requirement: For the facilities on Forest Service land, the results of the annual inspection will also be included in the annual Condition No. 3 Forest Service meeting. If observations are made that indicate heavy maintenance or operational changes are needed in order to maintain site integrity, stakeholder consultation will be completed prior to implementation. Actions completed in 2021: Enhancement and management requirements for Sandy Beach and Poe Beach, the two recreation sites located on federal lands, are described in Forest Service Condition No. 26. The final design and supporting information for Poe Beach Trail were transmitted to the Forest Service and FERC for approval concurrently. Progress on the Sandy Beach design was delayed by the ongoing Caltrans SR70/Mill Creek Bridge project. Caltrans work has been completed and Sandy Beach designs are in progress. Proposed actions for 2022: PG&E will continue working towards finalizing design, developing project descriptions, and obtaining necessary authorizations for the improvements identified in the Recreation Management Plan. More information on construction can be found in the conditional measures section below under the section titled “2022 Anticipated Construction Projects.” Poe Hydroelectric Project, FERC Project No. 2107 Condition No. 3 Report Condition No. 30: Revegetation of the Bardees Bar Tunnel Spoil Pile Actions completed in 2021: A phased plan was approved by FERC order issued in January 2021. The phased approach includes the following: (1) a Stability Plan, including post-construction slope stability monitoring and reporting, and (2) a short-term Revegetation Plan to manage existing invasive weeds and support growth of appropriate native species. Per the January 2021 order, the outstanding plans are to be submitted for approval in 2022 and initiated in 2023. Proposed actions for 2022: Finalize approved Stability and Revegetation Plans per January 2021 FERC order. Submit the approved Stability and Revegetation Plans to FERC for final approval per Article 401 to Forest Service for approval. Condition No. 32: Special Status Species Actions that occurred in 2021: PG&E has reviewed the current lists (Federal Endangered and Threatened, Forest Service Sensitive, Plumas National Forest Watch lists) of special status plant and wildlife species. There has been no new listed species included in the lists that may be affected by project operations. Currently there is no data related to the other species of concern that PG&E has collected. Conditional Measures 2022 Anticipated Construction Projects PG&E currently anticipates the following construction projects in 2022 and will follow the license requirements below, as applicable. In instances where the Forest Service has issued a letter of approval for construction, the applicable license conditions have been satisfied. Poe Powerhouse Recreation Improvements completed in 2021. Final Construction Report will be filed with FERC. Poe Beach Recreation Enhancement Project for 2022 (Forest Service approved November 4, 2021). Poe Reservoir Improvementsconstruction scheduled for 2022. This project will be inside the FERC No. 1962 boundary. Poe Dam Toe Void Project dive in2022, and Toe Void repairs are currently at the 50% design level. Poe Pedestrian Bridge construction project anticipated construction in 2023. This project is entirely within the project boundary and won’t impact Forest Service lands. Poe Hydroelectric Project, FERC Project No. 2107 Condition No. 3 Report Per FERC’s February 28, 2022, order, PG&E will submit an updated plan and schedule to forSandy Beach and Bardees Bar recreation enhancements by December 31, 2022. Condition No. 2: Approval of Changes License Requirement: Notwithstanding any license authorization to make changes to the project, when such changes directly affect National Forest System lands the Licensee shall obtain written approval from the Forest Service prior to making any changes in any constructed project features or facilities, or in the uses of project lands and waters or any departure from the requirements of any approved exhibits filed with the Commission. Condition No. 11: Safety during Project Construction Plan License Requirement: Sixty days prior to ground-disturbing activity related to new Project construction on or affecting National Forest System lands, the Licensee shall file with the Commission a Safety During Construction Plan approved by the Forest Service that identifies potential hazard areas and measures necessary to protect public safety. Areas to consider include construction activities near public roads, trails and recreation areas and facilities. Condition No. 12: Pesticide Use Restrictions on National Forest System Lands License Requirement: Pesticides may not be used to control undesirable woody and herbaceous vegetation, aquatic plants, insects, and rodents, undesirable fish, or other pests on National Forest System lands without the prior written approval of the Forest Service. The Licensee shall submit a request for approval of planned uses of pesticides. The request must cover annual planned use and be updated as required by the Forest Service. The Licensee shall provide information essential for review in the form specified. Exceptions to this schedule may be allowed only when unexpected outbreaks of pests require control measures that were not anticipated at the time the request was submitted. In such an instance, an emergency request and approval may be made. Condition No. 13: Erosion Control Measures Plan License Requirement: Sixty days prior to beginning any new construction or non-routine maintenance projects with the potential for causing erosion and/or stream sedimentation on or affecting National Forest System lands (including but not limited to planned recreation-related construction), the Licensee shall file with the Commission an Erosion Control Measures Plan that is approved by the Forest Service. The Plan shall include measures to control erosion, stream sedimentation, dust, and soil mass movement. Poe Hydroelectric Project, FERC Project No. 2107 Condition No. 3 Report Condition No. 22: Signs License Requirement: The Licensee shall consult with the Forest Service prior to erecting signs on National Forest System lands covered by the license. Prior to the Licensee erecting signs or advertising devices on National Forest System lands covered by the license, the Licensee must obtain the written approval of the Forest Service as to location, design, size, color, and message. The Licensee shall be responsible for maintaining all Licensee-erected signs to neat and presentable standards. Condition No. 23: Streamflow Part 2. Discretionary Out of Season Flow Events Below Poe Dam License Requirement: The Licensee shall prepare, maintain, and on an annual basis provide to the Commission, the Forest Service, and other interested governmental agencies, a record of any discretionary out-of-season flow events, identifying the affected reach, hourly discharge, the maximum flow magnitude, dates and duration, and cause of the event. In the event that the flow event potentially causes immediate biological effects, the licensee shall notify the Forest Service within 24 hours. Condition No. 33: Protection of Forest Service Special Status Species License Requirement: Before taking actions to construct new project features on NFS lands that may affect Forest Service special status species (i.e. Forest Service sensitive and/or management indicator species) or their critical habitat, the Licensee shall prepare and submit a biological evaluation (BE) for Forest Service approval. The BE shall evaluate the potential impact of the action on the species or its habitat. Where current information on population occurrence for some species is lacking (e.g. terrestrial mollusks and Pacific fisher) the Licensee shall perform necessary surveys prior to ground-disturbing activities, unless otherwise agreed to by the Forest Service. In coordination with the Commission, the Forest Service may require mitigation measures for the protection of the affected species. Condition No. 36: Land Management and Visual Resource Protection License Requirement: Within 60 days prior to any ground-disturbing activity on National Forest System lands, the Licensee shall file with the Commission a Visual Management Plan approved by the Forest Service. Poe Hydroelectric Project, FERC Project No. 2107 Condition No. 3 Report Pending Measures Condition No. 7: Fire Prevention, Response and Investigation Plan Actions completed in 2021: An initial draft Fire Prevention, Response, and Investigation, and Fuel Treatment Plan is in progress was submitted on September 9, 2019. Multiple reviewers were needed by both Forest Service and local/state fire agencies. There were significant revisions to the first draft, primarily related to moving the fuels treatment requirementsinto the Integrated Vegetation Management Plan. The final Fire Plan was filed with FERC on March 26, 2020. Proposed actions for 2022: Implement the Fire Prevention, Response, and Investigation, and Fuel Treatment Plan after FERC approval. Condition No. 23: Streamflow Part 5. Ramping Rates Actions completed in 2021: The Long-Term Ramping Rates Plan was developed in consultation with the Forest Service (approved the plan June 7, 2021) and State Water resources control board (approved the plan August 5, 2021). PG&E filed the final Long Term Ramping Rates Plan with FERC on June 30, 2021, and is awaiting approval. Proposed actions for 2022: Continue implementing interim ramping rates. Upon FERC approval, PG&E will implement the Long-Term Ramping Rate Plan as required. Condition Nos. 29 and 34: Integrative Vegetation Management Plan Actions completed in 2021: The Invasive Weed Management Plan will be combined with the Fuel Treatment Plan to be an Integrated Vegetation Management Plan (Plan). This combination and the requisite extension was requested from consulting agencies and FERC. A 12-month extension was approved by FERC on January 6, 2020. The draft Plan was submitted to the consulting agencies for review in August 2020. The plan was finalized with the agencies and submitted to FERC on December 28, 2020. The Integrated Vegetation Management Plan calls for comprehensive surveys for invasive weeds and rare plants to be completed in the first year following approval of the plan. Treatments for invasive weeds identified during those surveys will begin the Poe Hydroelectric Project, FERC Project No. 2107 Condition No. 3 Report following year. Prior to any treatments of NFSL, PG&E will submit for approval FS-2100 forms (Pesticide Use Proposals). At this time PG&E anticipates receiving FERC approval of the Plan in 2022 and would initiate treatments in 2023 at the earliest. If FERC approval is not received in time to complete comprehensive surveys in 2022, the schedule would be pushed out by one year. Proposed actions for 2022: PG&E is waiting for FERC approval of the Plan. Once approved, PG&E will implement the Plan. If FERC approval is not received in time to initiate botanical surveys for rare plants and invasive weeds, implementation of the plan will be postponed to 2023. Condition No. 31: Heritage Resources Actions completed in 2021: On November 4, 2021, PG&E submitted a draft Historic Properties Management Plan (HPMP) to the Forest Service, State Historic Preservation Officer (SHPO), and tribes for concurrent review. On December 12, 2021, PG&E filed the Final HPMP for formal FERC and Forest Service approval. After filing for approval, SHPO provided comments. Proposed actions for 2022: PG&E has addressed SHPOs comments and submitted the revised HPMP for their approval. Once obtained, PG&E will file supplemental information with FERC for approval. If the Forest Service or tribes provide comments, PG&E will work to address them and file the revised plan with FERC. Condition No. 35: Bald Eagle Management Plan Actions completed in 2021: PG&E is still awaiting FERC approval of the Bald Eagle Management Plan. Annual monitoring will continue until plan approval. In 2021, there was no nesting observed. Proposed actions for 2022: Monitoring of the Poe bald eagle nest territory is ongoing.Once approved, PG&E will implement the Bald EagleManagement Plan. Condition No. 37: Road Management Plan Actions completed in 2021: The updated draft Plan was submitted to the Forest Service in April 2020 and the Forest Service submitted comments in May 2020. PG&E, in consultation with the agencies, coordinated a joint field trip on October 28, 2020, to complete a visual assessment of the road conditions. The Road Management Plan was then revised to incorporate earlier comments and the 2020 Road Assessment Report was updated to reflect comments from the field trip. The updated documents were submitted to the Forest Service for Poe Hydroelectric Project, FERC Project No. 2107 Condition No. 3 Report comments in November 2020. On December 15, 2020, PG&E submitted the updated Road Management Plan to the Forest Service for formal approval. The Forest Service approved the Plan on December 16, 2020. The Road Management Plan was submitted to FERC for approval on December 29, 2020. Proposed actions for 2022: Once FERC approves plan, PG&E will implement the plan as approved by FERC. Implemented Measures Condition 10: Water Temperature Monitoring Actions completed in 2021: Water Temperature was monitored at the six sites identified in the Poe Water Temperature Monitoring Plan (2019). The monitored extended from April through October 2021. The data collected was processed as required in the monitoring plan and is documented in the 2021 Annual Data Report. Proposed actions for 2022: Continue monitoring of water temperature. Condition No. 23: Streamflow Part 3. Sediment Management in the North Fork Feather River Actions completed in 2021: The 2020 baseline monitoring surveys (as required in the Plan) were postponed to 2021 due to the North Complex Fire, which limited access to the sites and created unsafe working conditions. The goal of the 2021 fine sediment survey was to characterize baseline conditions and describe fine sediment deposits. The survey was completed in December 2021 and the results were documented and submitted to the regulatory agencies in January 2022. On October 21, 2021, the US Forest Service stated that ‘if unfavorable conditions persist, PG&E could: (1) conduct these baseline surveys in 2022, with a report produced in 2023, or (2) include a second year of baseline monitoring, as already allowed for in the Plan. Because the October 24, 2021, flood occurred between the date of aerial photographic survey and the field survey, following discussions with the US Forest Service it was determined that the 2021 was conducted under unfavorable conditions, and so an additional baseline survey is required in 2022. Proposed actions for 2022: PG&E will conduct baseline surveys in 2022. Poe Hydroelectric Project, FERC Project No. 2107 Condition No. 3 Report Part 4. Streamflow Measurement Actions completed in 2021: The 2021 Draft Streamflow Data Report was sent to the Forest Service January 24, 2022. Proposed actions for 2022: Forest Service has not provided comments. If PG&E does not receive any comments by April 1, 2022, then PG&E will distribute finalize the report and distribute it. Condition No. 26: Poe Interagency Recreation River Flow Management Plan MOU Actions completed in 2021: The Poe Interagency Recreation River Flow Management Plan (PIRRFMP) MOU has been approved and was submitted to FERC on September 29, 2020. The Recreation River Flow Management Plan was approved by FERC on February 28, 2022. Proposed actions for 2022: Implement the River Flow Management Plan as approved by FERC. Condition No. 28: River Flow Information Actions completed in 2021: PG&E continued to make all streamflow data available to the public, and PG&E submitted the Draft Streamflow Data Report for 2021 on January 24, 2022. Within 60 days following such consultation, the Licensee shall file with the Commission evidence of the consultation with any recommendations made by the Forest Service.
