On September 16, 2021, Governor Newsom approved Assembly Bill 361 relating to Open Meetings and teleconferencing requirements. On October 13, 2021, staff and members discussed options and potential implications of the expiration of Executive Order N-29-20 and passage of AB 361. Beginning October 13, 2021, the CSGSA has approved Resolutions authorizing remote teleconference meetings in accordance with Government Code Section 54953 (e). A Resolution must be passed every 30 days to remain effective. Brown Act requires that all meetings of a legislative body of a local agency be open and public and that any person may attend and participate in such meetings; WHEREAS, the Brown Act allows for legislative bodies to hold meetings by teleconference, but imposes specific requirements for doing so; WHEREAS, on March 17, 2020, in order to address the need for public meetings during the present public health emergency, Governor Newsom issued Executive Order No. N-29-20, WHEREAS, on June 11, 2021, Governor Newsom issued Executive Order No. N-8-21, 30, 2021; and WHEREAS, these Executive Orders allowed legislative bodies to meet virtually as long as certain notice and accessibility requirements were met; and WHEREAS, the State Legislature amended the Brown Act through Assembly Bill No. 361 (AB 361) on September 16, 2021; and WHEREAS, AB 361 amended the Brown Act so that a local agency may use teleconferencing without complying with the regular teleconferencing requirements of the Act, where the legislative body holds a meeting during a proclaimed state of emergency and makes certain findings; and WHEREAS, Government Code section 54953 requires that the legislative body make additional findings every 30 days in order to continue such teleconferencing. NOW THEREFORE, the Corning Sub-basin Groundwater Sustainability Agency CSGSA hereby finds, determines, declares, orders, and resolves as follows: 1. That the foregoing recitals are true and correct and incorporates them by this reference. 2. The CSGSA finds, by a majority vote, the following: a. That there exists a proclaimed state of emergency; and b. State or local officials have imposed or recommended measures to promote social distancing. Period of Public Comment No comments were made. 7. Staff Reports Ms. Hunter reported groundwater level measurements are being taken this week in the northern Sacramento Valley and Department of Water Resources (DWR) is putting together a monthly monitoring grid to monitor drought conditions. Ms. Hunter further reported new InSAR data is now available showing subsidence conditions which can be viewed at DWRs California Groundwater Live webpage. Ms. Hunter shared she has sent an email to DWR indicating interest in the Technical Support Services program and requesting an application. The application would request services to conduct a geophysical study to better understand the sink hole areas forming near Stony Creek. Ms. Hunter stated the Facilitation Support Services (FSS) has concluded. A new FSS application can be submitted to request additional services and staff will work with the Tehama County GSA to explore options. Ms. Hunter reported on the status of the Proposition 1 GSP Development grant and the consultant contract with Montgomery and Associates. Mr. Carmon asked when the groundwater level measurements would be available; whereby, Ms. Hunter responded the measurements are generally available within a few weeks. Steven Gruenwald asked if staff could elaborate on the sink holes that were mentioned. Ms. Hunter responded that these are new developments that were Corning Sub-2 Dpsojoh!Tvc.cbtjo!HTBQbhf!8 5024033!Nffujoh!Nbufsjbmt reported to the Orland Unit Water Users Association manager, who then reached out to staff. DWR and staff were invited to visit a site, and the study being requested though the TSS program would be designed to better understand these features and what might be causing them. Discussion ensued. 8. Discussion on Legal Counsel to represent the CSGSA as needed Ms. Hunter introduced the item stating the CSGSA has previously relied on member agency counsel as needed, but it may be helpful to identify counsel, either a member agency counsel arrangement, or separate counsel to guide the CSGSA efforts. Mr. Carmon spoke in favor of using County Counsel; however, noting that some items may require outside counsel. Ms. Violich and Holly Dawley spoke of the arrangement utilized in Tehama County who contacts for services. Ms. Violich asked who the Glenn Groundwater Authority (GGA) has retained for counsel. Mr. Carmon responded that Valerie Kincaid provides services to the GGA and she has recently been retained by Glenn County to provide guidance on water-related issues. Ms. Violich suggested a default of engaging Glenn County Counsel as primary counsel and using special counsel as needed. Mr. Amaro agreed. Mr. Knight asked about funding to cover the services; whereby, Ms. Hunter noted there will be no grant funding available to cover these costs and funding would need to be determined. Direction was provided to staff to explore an arrangement with County Counsel and bring the item back to a future CSGSA meeting addressing this potential arrangement and costs (hourly rates). Discussion ensued. 9. Corning Subbasin Groundwater Sustainability Plan a. Receive update on Corning Subbasin Groundwater Sustainability Plan Annual Report and plan to fund the Annual Report b. Discussion on Corning Subbasin Groundwater Sustainability Plan implementation and next steps Ms. Hunter reported that the Consultant Team is working on the Corning Subbasin Annual Report task and is on track to have it submitted to DWR by April 1, 2022, the statutory deadline. Ms. Hunter further stated, the question remains on funding the Annual Report. The grant will cover the majority of the cost; however, approximately $11,000 will be the responsibility of the GSAs. Ms. Hunter asked if the member agencies could discuss with their agency and confirm willingness for each to fund up to $2,000 of this task. Discussion ensued with general agreement that the member Corning Sub-3 Dpsojoh!Tvc.cbtjo!HTBQbhf!9 5024033!Nffujoh!Nbufsjbmt agencies would split the cost of the CSGSA share of the Annual Report Development. Members will confirm with their individual agencies. Ms. Hunter introduced Item 9.b stating this item carries over from previous discussions to give an opportunity for further discussion on transitioning from the planning phase to implementation. Ms. Hunter further stated the Groundwater Sustainability Plan is open for a 75- day public comment period on the SGMA portal. The comments are available to review in real-time and will be important to consider during implementation, annual reports, and five-year updates. Ms. Hunter encouraged member agencies to allocate funding to support the CSGSA as they develop 2022/2023 agency budgets, as a funding mechanism is not yet in place to support GSP implementation. Mr. Knight asked how much should be allocated, whereby, Ms. Hunter suggested a future agenda item to discuss the budget item in more detail and recommended reviewing the GSP implementation chapter that includes draft budgets. Discussion ensued. Del Reimers spoke regarding the fee mechanism being discussed in Tehama County at $0.29 per acre and a lack of support when the item was discussed publicly. He encouraged the CSGSA to include dry land property owners in the discussions when considering fees. He spoke in favor of fees on irrigated grounds. 10. Workshop: Funding Mechanisms Ms. Hunter introduced the item noting that members requested an agenda item to begin discussing potential mechanisms to fund GSP implementation. Discussions were started in February 2022 and the meeting packet included past presentations to the CSAB by the Consultant Team, letters provided by interested stakeholders, and excerpts from the GSP Implementation Chapter. Mr. Amaro spoke in favor of a well fee, considering the size of the well, and noted the complication in gathering the data to support the fee. Another suggestion mentioned was based on irrigated acres. Ian Turnbull suggested tying general plan zoning designations to potential fees. The zones and associated parcels are already defined. Discussion ensued considering Williamson Act lands, planning and zoning, potential for development and associated benefits, and land use mapping (Land IQ, Agricultural Commissioner data). Considerations on irrigated or non-irrigated lands, user groups, tiered mechanisms, different fee structures for different areas, and volumetric charges were also discussed. It was clarified that each GSA will develop its own funding mechanism and discussions will need to take place on how the GSAs will split the shared costs. It was decided to leave this item on future agendas to continue discussion and to invite Land IQ to provide a presentation to the CSGSA. 11. *Consider providing comments to Glenn County on Draft Glenn County Water Well Drilling Permits and Standards Mr. Carmon stated the County if looking for comments Water Well Drilling Permits and Standards. The GGA has a committee that is providing comments. One item being considered is changing the spacing requirement to be based on well casing size rather than extraction. Brian Mori asked how stakeholders could be more involved and receive a copy of the latest draft of the ordinance. He commented that the map that is mentioned is not available, which makes it difficult to make comments. He also had questions relating to the definition of solid casing and spoke to the importance of a data driven approach. Mr. Carmon responded the draft ordinance \[the draft shown during this meeting\] has been sent to the individuals on the drought taskforce list. Specific comments and suggestions can be shared at the drought taskforce meetings or emailed to drought@countyofglenn.net. The data to create the map is being handled in house at this point, and Ms. Hunter shared some of the past work through the Countys Water Advisory Committee Basin Management Objective revision process that may inform the ordinance map that is being developed. Discussion ensued. 12. Corning Subbasin Advisory Board Report Mr. Gruenwald asked about GCID water supply for this year. Mr. Amaro mentioned there are discussions happening this week to learn more about the supplies. Mr. Knight noted, GCID does not plan to have a well program at this time. Landowners may pump their own wells. Ms. Dawley noted they are in unprecedented times and there is not physically enough water in the system to provide for all beneficial uses. This is a Shasta Critical year and hopefully more information will be available soon. The public is welcome to attend GCID Board meetings. Discussion on Legal Counsel to represent CSGSA as needed As the GSA moves forward, it is important to consider formalizing an arrangement for Legal Counsel to represent the CSGSA on an as-needed basis. At the March 9, 2022 meeting, there was general consensus to request Glenn County, County Counsel to provide these services and consult with outside counsel as needed. Staff reached out the County Counsel who indicated due to the expertise required in the topics the GSA will likely face, County Counsel may not be the most appropriate choice, as the County currently contracts with outside counsel to consult on water-related matters. Instead, County Counsel suggested seeking the services of an experienced water attorney. Additional updates may be provided, potential options will be explored, and direction may be provided to staff. 9. Corning Subbasin Groundwater Sustainability Plan a. Discussion on Corning Subbasin Groundwater Sustainability Plan implementation and next steps The Corning Subbasin GSP was submitted to DWR on January 28, 2022 and posted by DWR on February 7, 2022 initiating a 75-day public comment period. The comment period ends April 23, 2022. No comments have been received.
