WHEREAS, this Board has received a request to abandon a portion of the public rights easement (RA2
under California Government Code Section 65402 as described below; and
WHEREAS, under Chapter 3 of Part 3 of Division 9 of California Streets and Highways Code (commencing with
Section 8320) this Board shall set a date, hour, and place for a hearing on the vacation request.
WHEREAS, the Planning Commission held a noticed public hearing and considered this abandonment request on
December November 18 2021, and December 9, 2021, and found the request consistent with the Butte County General
Plan asreflected byResolution PC21-17;and
WHEREAS, this Board initiates a proceeding to abaindon a portion of the public service easement right of way as
described imthe attached Exhibits Mand Band shown, amthe attached Exhibit[; and
NOW, THEREFORE, BE IT RESOLVED that the Butte County Board of Supervisors hereby:
Gives notice that atits regular meeting nnSeptember l3,20O2 at1OI0a.m_inthe Board Chambers, Butte County
Administration Building, 25 County Center Drive, OroviUe California, a hearing shall be held to hear all persons
interested in the abandonment of that certain portion of the public service easement located west of Fig Street
between Gold Avenue and Lakeland Boulevard in the Western Addition area north of the City of OnovU1e. The
easement to be vacated |sasfollows:
The JQ'public service easement between Lots 1and DJand the northern 10 portion nfthe 20 pub�lic
service easement between Lots 2 and g of Block 15 of the Western Pacific Addition to (]rov Ue, and
the southern 10' portion of the 20' public service easement betwee,n Lots 2 and 9 which is located in
the County of Butte, State of California, more particularly described in attached Exhibits A and B, as
shown unthe attached Exhibit C.
2. That a map showing the public service easement to be vacated is on file in the Office of the Butte County Department
of Public Works, 7 County Center Drive, Oroville, California 95965.
3. That after the hearing the Board intends to abandon said portions of the public service easement.
4. That this abandonment proceeding isbeing conducted under Chapter 3ofPart 3of Division 9ofthe California Streets
