HomeMy WebLinkAbout42201 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 Ordinance No. 4220 AN ORDINANCE OF THE COUNTY OF BUTTE AMENDING ARTICLE XIII.5, ENTITLED "CHILDREN AND FAMILIES COMMISSION" OF CHAPTER 2, ENTITLED "ADMINISTRATION" The Board of Supervisors of the County of Butte ordains as follows: Section 1. Section 2-100.00 is amended to read as follows: Section 2-100.00 - Established authority. Pursuant to section 130100 of division 108 of the Health and Safety Code of the State of California, there is established the Butte County California Children and Families Commission (the "Commission"). The general purpose of the Commission shall be to promote, support and optimize the early development of children from the prenatal stage to five (5) years of age through the creation and implementation of an integrated, comprehensive and collaborative system of information and services to enhance early childhood development pursuant to the "California Children and Families First Act of 1998," Health and Safety Code section 130100. and following (the "Act"). Section 2. Section 2.100.20 is amended to read as follows: Section 2-100.20 - Purpose. The Commission is part of a state-wide effort to create a seamless system of integrated and comprehensive programs and services, and a funding base for the system with program and financial accountability, for the purpose of 1 1 2 3 4 5 6 7 8' 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 promoting, supporting and optimizing the early development of children from the prenatal stage to five years of age. It is the intent of this ordinance to implement within the county a collaborative system of information and services, functioning as a network that promotes accessibility to these resources from any entry point into the system. It is further the intent of this ordinance to emphasize local decision making, to provide for greater flexibility in designing delivery systems, and to eliminate duplicate administrative systems. In administering this ordinance, the Commission shall use outcome -based accountability to determine future expenditures. Section 3. Section 2-100.30 is amended to read as follows: Section 2-100.30 - Membership. (a) The Commission shall be composed of nine (9) members appointed by the board of supervisors. The membership shall include the following: (1) The director of the Butte County Public Health Department, or their designee. (2) The director of the Butte County Department of Employment and Social Services, or their designee. (3) The director of the Butte County Department of Behavioral Health, or their designee. (4) One (1) member of the board of supervisors chosen from 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 its members. (5) Five (5) members, appointed by the board of supervisors chosen from the following groups, with the intent that representatives from as many groups as possible will serve on the Commission: a. Recipients of project services as set forth in the county strategic plan; b. Educators specializing in early childhood development; C. Representatives of a local organization for prevention or early intervention for families at risk; d. Representatives of community-based organizations that have the goal of promoting nurturing and early childhood development; e. Representatives of local school districts; f. Representatives of local medical, pediatric, or obstetric associations or societies; g. Representatives of a local child care resource or referral agency, or a local child care coordinating group. (b) Those commissioners appointed by the board of supervisors shall be appointed by a majority vote of the board of supervisors. Commissioners appointed by the hoard of 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 supervisors may be removed from office by a majority vote of the board of supervisors favoring such removal. (c) Commission members may receive reimbursement for reasonable expenses incurred in attending commission -related functions as authorized by policies established by the Commission. (d) The board of supervisors may appoint up to two (2) alternate members to the Commission through the process used for appointment of the regular Commissioners. Alternate members have the same roles and responsibilities as regular Commissioners, and shall attend and participate in all Commission meetings. Alternate members shall, except as otherwise noted in this section, have the same benefits and privileges as regular Commission members, including, but not limited to, those which provide for the reimbursement of authorized expenses and coverage under policies of liability insurance. When all regular members of the Commission are present, alternate members shall not vote or take any action on a Commission matter. In the absence of a regular Commissioner, including due to recusal, an alternate member shall have the authority to vote and take action. The process for selecting alternates to serve as voting members is established in the Commission's bylaws and policies. The term of alternate 4 1 2 3 4 5 6 7 8 9'' 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 members appointed by the board of supervisors shall be consistent with the term of regular members. Section 4. Section 2-100.40 is amended to read as follows: Section 2-100.40 - Term of office. The Directors of the Butte County Departments of Public Health, Employment and Social Services, and Behavioral Health shall be standing members of the Commission with no term of office. The member of the Board of Supervisors shall be chosen through the Board's committee assignment process. The remaining members shall serve for a term of three (3) years. The terms of the remaining members shall be staggered. At the conclusion of a term, a member may be appointed to a new term. Section 5. Section 2-100.50 is amended to read as follows: Section 2-100.50 -- Establishment of trust fund. There is established a trust fund to be known as the First 5 Butte County Children and Families Commission Trust Fund. The monies allocated to this fund shall be expended only for the purposes authorized by the Act and in accordance with the Commission's strategic plan.. Section 6. Section 2-100.60 is amended to read as follows: Section 2-100.60 - Bylaws. The Commission shall adopt and amend bylaws on matters that the Commission deems necessary or convenient for the conduct of Commission activities. Procedures for the conduct of Commission business not 5 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 specified in this ordinance shall be contained in bylaws adopted by the Commission. Section 7. Section 2-100.70 is amended to read as follows: Section 2-100.70 - Powers and duties. The Commission shall exercise the following powers and duties: (a) County Strategic Plan. The Commission shall adopt, after, conducting at least one (1) public hearing, a county strategic plan for the support and improvement of early childhood development within the county, and submit the county strategic plan to the California Children and Families Commission. (1) The county strategic plan shall be consistent with, and in furtherance of the purposes of the California Children and Families First Act (Health and Safety Code section 130100 et seq.), and any guidelines adopted pursuant to subdivision (b) of Health and Safety Code section 130125. (2) The county strategic plan shall, at a minimum, include the following: a description of the goals and objectives proposed to be attained; a description of the programs, services and projects proposed to be provided, sponsored or facilitated; and a description of how 6 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 measurable outcomes of such programs, services and projects will be determined by the Commission using appropriate reliable indicators. (3) The Commission shall, on at least an annual basis, periodically review the county strategic plan and revise it as necessary and appropriate. In that regard, the Commission shall conduct at least one (1) public hearing prior to adopting any recommendation to revise the plan. (4) The Commission shall measure the outcomes of its programs through the use of applicable, reliable indicators and review that information on a periodic basis as part of the public review of its county strategic plan. (b) Annual Audit and Report. The Commission shall prepare and adopt an annual audit and report pursuant to Health and Safety Code section 130150. The written report shall assess the Commission's performance during the preceding fiscal year, including, at a minimum, the manner in which funds were expended, the progress toward and the achievement of program goals and objectives, and the measurement of specific outcomes through appropriate reliable indicators. 7 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 The Commission shall conduct at least one (1) public hearing prior to adopting the audit and report and shall transmit them to the California Children and Families Commission and the State Controller's Office by November 1. (c) State Annual Report. The Commission shall conduct at least one (1) public hearing on each annual report prepared by the California Children and Families Commission pursuant to subdivision (b) of Health and Safety Code Section 130150. (d) Other Functions. The Commission shall perform such other functions as required by applicable state law or regulations, and shall carry out all of its functions in accordance with applicable laws and regulations, including the Ralph M. Brown Act. Section 8. Section 2-100.80 is amended to read as follows: Section 2-100.80 - Advisory committees. Pursuant to Health and Safety Code section 130145, the Commission has established two standing advisory committees: the Executive Committee; and the Strategic Plan & Evaluation Advisory Committee (SPEAC). The Committees are discussed in the Policy Manual, Part I Governance, Section 11 Committees. Section 9. Severability. If any provision of this Ordinance or the application thereof to any person or circumstances is for any reason held to be invalid by 8 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 a court of competent jurisdiction, such provision shall be deemed severable, and the invalidity thereof shall not affect the remaining provisions or other applications of the Ordinance which can be given effect without the invalid provision or application thereof. Section 10. Effective Date and Publication. This Ordinance shall take effect thirty (30) days after the date of its passage. The Clerk of the Board of Supervisors is authorized and directed to publish this ordinance before the expiration of fifteen (15) days after its passage. This Ordinance shall be published once, with the names of the members of the Board of Supervisors voting for and against it, in a newspaper of general circulation published in the County of Butte, State of California.
