Pursuant to the provisions of Chapter 53-34 C. of Butte County Code and the special conditions set forth below, MAGALIA COMMUNITY CHURCH is hereby granted approval for a temporary RV Park/basecamp to house a maximum of four (4) residential trailers each housing families directly affected by the Camp Fire. The RV Park/Basecamp will serve as temporary Camp Fire residential/employee housing on a 7.6-acre parcel located at 13700 Old Skyway Road, Magalia, CA 95954. The property is zoned Rural Residential 5 acre minimum (RR-5). The RVs will be dry camping with wastewater met through Alpine Toilet and Septic services (each RV pumped as needed). Power is provided by Pacific Gas & Electric, and water is provided by Del Oro Water Company. I. GENERAL REQUIREMENTS, CONDITIONS, AND RESTRICTIONS: 1. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-251. 3. The terms and conditions of this Permit shall run with the land and shall be binding upon and to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 4. Neither the applicant, nor any agent nor representative of the applicant shall intentionally omit or misrepresent any material fact in connection with the application. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke the Permit. 5. The approved use shall be developed and maintained in substantial conformance with the approved site plan and operations plan on file with the Butte County Planning Division. Minor changes to the plans may be allowed subject to the approval of the Director of Development Services, if found to be in substantial conformance to the approved project. II. CONDITIONS OF APPROVAL: Butte County Department of Development Services. 6. The residential use of recreational vehicles and temporary dwellings is limited to vehicles and dwellings not on a permanent foundation and used to house families displaced by the Camp Fire and laborers working in support of the Camp Fire recovery effort during the effective period of Chapter 53 of Butte County Code. 7. Vehicles used for residential purposes and any permanent structures shall be located outside of required setbacks as established in Chapter 24 of the Butte County Code. 8. Vehicles used for residential purposes shall be located outside of the boundaries of any recorded easements. 9. Each space in the recreational vehicle park shall be clearly identified and a locational map shall be clearly displayed near the entrance of the site. 10. The recreational vehicle, basecamp feature, or temporary dwelling shall be connected to an approved source of water meeting one (1) of the following criteria: a. Public water supply; b. Existing well provided that it has been approved by the Department of Public Health, Environmental Health Division as safe for domestic consumption; or; c. Other water source as approved by the Department of Public Health, Environmental Health Division. 11. The recreational vehicle, basecamp feature, or temporary dwelling shall be connected to an approved sewage disposal system meeting one (1) of the following criteria: a. Public sewer system; b. Existing on-site sewage disposal system that has been approved by the Department of Public Health, Environmental Health Division to be intact, adequately sized, and functioning following the disaster; c. Temporary holding tank with a contract with a umping company for regular pumping. A copy of the contract shall be provided to the Department of Public Health, Environmental Health Division; or d. Other method of sewage disposal approved by the Department of Public Health, Environmental Health Division. 12. The recreational vehicle, basecamp feature, or temporary dwelling shall be connected to an approved source of electricity meeting one (1) of the following criteria: a. Permitted electrical service hook-up; or b. Other power source approved by the Director of Development Services. 13. Adequate off-street parking shall be available for residents and guests on the property. All parking areas shall conform to the applicable requirements of Butte County Code section 24-91 et seq. [Parking and Loading]. Parking located over any grass surface shall be regularly mowed to a maximum height of three inches to reduce the potential for fire. 14. All areas occupied by recreational vehicles and/or basecamp features and access aisles, driveways, and roads shall have an all-weather surface capable of supporting a forty thousand (40,000) lb. load that will allow for ingress and egress of fire apparatus to within one hundred fifty (150) feet of all units and a vertical clearance of no less than fifteen (15) feet. 15. Driveways and aisles shall have a minimum width of twenty-five (25) feet. 16. A County Encroachment permit must be obtained for all new and existing driveway approaches to publicly maintained roads as specified in the County Improvement Standards. 17. Adequate artificial exterior lighting shall be provided for all walkways, driveways, parking areas, sanitary facilities, storage areas, and recreational facilities. All exterior lighting shall comply with all requirements of Chapter 24, Division 4. – Outdoor Lighting (Section 24-62 et. seq.) of the Butte County Code. Exterior lighting shall be located, adequately shielded, and directed such that no direct light falls outside the property line, or into the Public right-of-way. Flashing, flickering, or other lighting that is distracting or may be confused with traffic or emergency signals is prohibited. 18. The applicant shall use best management practices to control fugitive dust from unpaved roads, driveways and the parking area that may be generated by vehicular traffic accessing the site. Best management practices include, but are not limited to, reducing vehicular speed, the regular application of water as a dust suppressant, or the application of a dust palliative in accordance with the manufacturer’s recommendation. 19. There shall be no outdoor storage or accumulation of wrecked or dismantled vehicles or parts thereof, discarded items, junk, or inoperable machinery. 20. This permit shall expire and have no further force or effect on December 31, 2023, unless an extension or modification is approved by the Butte County Board of Supervisors. 21. Building permits are required for the installation of these structures including but not limited to: foundation support/attachment, attachment of units to each other, State approval of the pre-manufactured units, utilities, etc. 22. The applicant shall comply with all applicable requirements of Butte County Code. This temporary administrative permit may be subject to additional requirements from Butte County Fire, Butte County Public Works, Butte County Environmental Health, the State . .. Housing and Community Development Department, and the State Regional Water Quality Control Board. 23.If any utilities are installed to serve these temporary RV's or Trailers, building permits willbe required. Butte County Fire Department/Cal Fire 24.Construction, installation, or development of buildings and/or roads, driveways, gates and bridges on parcels/lots shall comply with the current adopted California Fire Code and current Butte County Improvement Standards, whichever is stricter. 25.Provide an address sign. Contrasting color background and posted at the street mainentrance and on the main or first building encountered. 26.Submit a site plan showing space numbers and location of utility shut offs. 27.Provide gate combination or alternate mean of access to site. 28.Tents in excess of 400 square feet or canopies (open on all sides) exceeding 700 square feet must be State Fire Marshal approved and installed in accordance with the California Fire Code. Dated: 11../z./ 1-1- Applicant Approved by: Mark Michelena Zoning Administrator 12/5/2022 Camp Fire Temporary Recreational Vehicle Park (ADM19-0152) at APN: 066-470-033 for the Magalia Community Church Reclamation Plan: The RV's that are currently on-site are planned to be removed from the property prior to December 31, 2023. The electrical and water delivery system is planned to remain once the RV's are gone. We have no plans to remove the electric and water from the site. The grounds are dirt and gravel and the natural state of the land. There is no other reclamation foreseen to return the site to the pre RV Park state. Doreen
