The proposal consists of installing (12) new antennas and associated support equipment on a 100' mono-pine. The equipment will be located on the ground within an enclosed 50'x 50' fenced space. Your relevant forms, submittal requirements, and the applicable fees have been submitted with this letter. Under the Telecommunications Act of 1996 (“Act”), you are required to take action on Vertical Bridge's application “within a reasonable period of time.” In a 2009 declaratory ruling, the Federal Communications Commission established a legal presumption that a “reasonable period of time” means 150 days to act on an application for a new wireless facility (the “shot clock”). Because the proposed facility seeks to locate a new personal wireless service facility, the County must take action on Vertical Bridge's application within 150 days. The shot clock begins to run the day the application is submitted. Here, the County must take final action no later than 150 days from today, or January 18th, 2023. Vertical Bridge respectfully requests that this application be approved and any requisite building permit be issued as soon as possible but no later than July 13thth, 2023. Standards have been set based on peer-reviewed scientific studies and recommendations from a variety of oversight organizations, including the National Council on Radiation Protection and Measurements (NCRP), American National Standards Institute (ANSI), Institute of Electrical and Electronics Engineers (IEEE), Environmental Protection Agency (EPA), Federal Drug Administration (FDA), Occupational Safety and Health Administration (OSHA), and National Institute for Occupational Safety and Health (NIOSH). Although the purview of the public safety of RF emissions by the FCC was established by the Telecommunications Act of 1996, these standards remain under constant scrutiny.
