HomeMy WebLinkAbout22-185WHEREAS, the County of Butte is a political subdivision of the State of California, with responsibility as a Local
Maintaining Agency (LMA) for levee and flood facility management of the Mudl-Sycamore Creek Levee System which is
part of the State Plan of Flood Control and is, willing to participate in, coordinate, and collaborate with other interested
parties in the maintenance and resiliency of Butte County flood management; and
WHEREAS, recognizing that the operation and maintenance of the State Plan of Flood Control facilities had been
chronically underfunded, the Legislature and Governor of the State of California provided funding for the Deferred
Maintenance Project under Section 6.10 of Senate Bill 826 (STATS. 2016, CHI. 23) which allocates a portion of funds to
LMAs; and
WHEREAS, the Department of Water Resources performed inspections on drainage pipes penetrating levees in
the Mud -Sycamore Creek Levee system andl identified 18 pipes to be repaired and three pipes that were eligible to be
replaced; and
WHEREAS, the County of Butte and the Department of Water Resources entered into a Project Agreement which
was executed on January 27, 2022; and
WHEREAS, repair work on 18 pipes has been completed; and
WHEREAS, the replacement of three pipes is scheduled for next summer which requires a budget increase.
NOW, THEREFORE, BE IT RESOLVED by the Butte County Board of Supervisors that pursuant and subject to alll the
terms and provisions of the Control Section 6.10 of the Budget Act of 2016, the funds awarded to the County of Butte by
the California Department of Water Resources for a State -Federal Flood Control System Modification Program project
titled: 2021-DMP-NA03-01 are hereby accepted.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Director of the Butte County Public Works Department is
hereby authorized and directed to sign a Funding Agreement and any amendments thereto with the California Department
of Water Resources and to sign requests for disbursements to be made under this Funding Agreement,
PASSED AND ADOPTED by the Butte County Board of Supervisors this 13t" day of December 2022, by the following
vote:

The California Department of Water Resources (Department), under the Deferred Maintenance
Project (DMP), is assisting Local Maintaining Agencies (LMAs) to address the aging levee pipe
penetrations that are past their design service life and may be a threat to the structural integrity
of the levees. Under DMP Phase -1, gravity drainpipes passing below the levee design freeboard
were inspected. The levee pipe penetrations that are listed in the Operation and Maintenance
Manuals and are necessary for the flood control function of the levees are eligible for
rehabilitation assistance under DMP Phase II.
Proactive Action to Extend Service Life of Aging CMP Pipes
Under DMP Phase II pipes with light to moderate structural defects will be rehabilitated with
Cured -in -place -pipe (CIPP) lining method. CIPP is a cost-effective proactive rehabilitation
method that prolongs the pipe's service life by up to 50 -years. DW R has reviewed Pipe
Inspection reports performed under DMP Phase I for Butte County Department of Public Works
(NA03). The pipes listed in Table 1 and shown on the attached map, are eligible for CIPP lining
rehabilitation under DMP Phase ll.
Roles and Responsibilities
The Department will assist NA03 in the rehabilitation of the identified pipes in Table 1 by placing
CIPP lining through these pipes with no NA03 cost -share. Currently, the Department has a
service contract with Michels Corporation that is available to CIPP-line for the selected pipes.
NA03 will be required to assume the following roles with no DWR cost share:
1) Provide access to the pipe;
2) Remove and reinstall trash racks, if any.
NA03 will be responsible for administering funding agreements and providing access for the
Phase I work.
Budget
Department pays 100% of the CIPP lining placement cost. NA03 pays 100% of cost associated
with performing their roles outlined above, there is no budget allocated to LMAs for this work.
Schedule
Anticipated completion of CIPP rehabilitation work is December 31, 2022.
Failed Pipes Replacement
Under DMP Phase II pipes with severe defects that can not be rehabilitated with CIPP-line will be
replaced. The pipes, listed in Table 2 and shown on the attached map, are eligible for
replacement under DMP Phase 11. This rehabilitation work will be implemented under two phases
as follows:

Phase II(a) - Design, Permitting, and Bid documents
The general scope of work for Phase 11(a) includes:
a. Preparation of plans, specifications, and estimate (PS&E).
b. Acquisition of environmental and regulatory permits.
c. verification/acquisition of necessary real estate rights.
d. Preparation of construction contract bid documents.
Roles and Responsibilities
NA03 will be the CEQA lead entity and the signatory of all environmental, and other regulatory
permits. Department, or its consultants, will prepare all necessary documents, with close
coordination with NA03, for NA03's signature.
Department, or its consultants, will prepare PS&E, environmental and other regulatory permit
documents, secure any required real estate rights, and prepare the construction contract bid
documents for the completion of tasks a, b, c, and d.
Phase li(b) - Construction
Under Phase II(b) NA03 will execute the construction of the rehabilitation works. Before
proceeding, NA03 and the Department will coordinate and agree on the eligibility and priority
of the rehabilitation work aligned with the funding availability. The general scope of work for
Phase II(b) includes:
a. Advertise and award of the construction contract using the bid documents prepared
under Phase II(a).
b. Construction of project, including any mitigations (if required by regulatory permits).
c. Construction contract administration and management, and construction oversight.
d. Prepare project construction close-out documents.
Roles and Responsibilities
For Phase II(b), NA03 will be the Project lead entity. In close coordination with the Department,
NA03 will award a construction contract, construct and closeout the project to complete the
tasks a, b, c, and d. The Phase ll(a) engineer of record will be responsible for providing
engineering support during construction phase.
Article A.I.A. OVERALL PROJECT BUDGET
Budget
a) Budget for Phase 11 (a): Department will perform its role outlined above with no LMA cost
share. NA03 pays 100% of cost associated with performing its roles outlined above.
b) Budget for Phase II(b): The reasonable cost of Phase II(b) is estimated to be $1,250,000.00
per the attached estimate. Department will pay 100% of Phase II(b) costs with no LMA
cost share.

Schedule
a) Anticipated completion of Phase 11(a) is December 31, 2023.
b) Anticipated completion of Phase II(b) construction and project close-out is December
21, 2024.
