HomeMy WebLinkAbout23-005RESOLUTION TO APPROVE THE CONVEYANCE OF REAL PROPERTY RIGHTS AFFECTING A PORTION OF COUNTY OWNED
REAL PROPERTY COMMONLY KNOWN AS 196 MEMORIAL WAY, CHICO, CALIFORNIA TO THE CITY OF CHICO
WHEREAS, the County of Butte (County) is the owner in fee of the real property identified as Assessor Parcel
Number 003-180-022, consisting of approximately 1.16 acres of land, commonly known as 196 Memorial Way, Chico,
California 95926 (Property); and
WHEREAS, the City of Chico (City) prepared the "Esplanade Corridor Safety and Accessibility Study" in 2016. The
outcome of that study identified the project scope of work, and the City subsequently applied for federal grant funding.
In 2017, the City was awarded $350K in Congestion Mitigation and Air Quality (CMAQ) funds, and $7.24M in Active
Transportation Program (ATP) funds. The City identified right of way needs to include construction of a roundabout at
Memorial Way and Oleander Avenue (Project); and
WHEREAS, the City requests that the County convey for no consideration approximately 7,148 square feet of the
Property in fee simple title to support the Project; and
WHEREAS, consistent with the direction the Department of General Services (Department) received from the
Butte County Board of Supervisors in closed session on July 26, 2022 and in support of the Project, the Department has
reviewed the City's request and finds that the proposed conveyance will not result in a detriment to the County's use of
the Property.
NOW, THEREFORE, BE IT RESOLVED that the Butte County Board of Supervisors hereby:
1. Approves the conveyance of the real property rights to the City pursuant to California Government Code Section
25365(a) and per the terms and conditions of the Donation Conveyance Agreement; and
2. Authorize the Director, General Services to execute all document necessary to complete the conveyance, including the
Grant Deed.
