HomeMy WebLinkAbout23-009A RESOLUTION OF THE BUTTE COUNTY BOARD OF SUPERVISORS ADOPTING COUNTY INITIATED AMENDMENTS TO BUTTE COUNTY CODE CHAPTER 24. (ZONING ORDINANCE): 1) ARTICLE II — LAND USE TABLES 2) CHILD CARE FACILITIES (SECTION 24-159), and 3) DEFINITIONS (SECTION 24- 304) TO BECOME COMPLIANT WITH SB 234 (SKINNER) WHEREAS, on October 26, 2010, Butte County adopted a new General Plan, including a new General Plan Land Use Map; and, WHEREAS, prior to the adoption of the new General Plan, Butte County embarked on a comprehensive update to the Butte County Zoning Ordinance ("Zoning Ordinance Update"), being a part of the overall Butte County General Plan 2030 project directed by the Board of Supervisors also referred to as "Meeting Series #8", which involves a comprehensive update to the existing Butte County Zoning Ordinance; and, WHEREAS, on September 27, 2012, the Planning Commission made recommendations to the Board of Supervisors, and on November 6, 2012, the Board of Supervisors adopted the Zoning Ordinance Update under Ordinance #4050, and Certified a Supplemental Final EIR under County Resolution 12-123; and, WHEREAS, from time -to -time County -initiated Amendments to the General Plan and Zoning Ordinance and their corresponding Official Maps are required to address a variety of needed updates including but not limited to corrections, legal compliance, and other issues that arise; and, WHEREAS, at a noticed public hearing on December 8, 2022, the Planning Commission recommended that the Board of Supervisors adopt the CEQA common sense exemption (CEQA guidelines Section 15061 (b) (3)) and approve Code Amendment CA21-0001 (Resolution No. PC 22-21); and, WHEREAS, the Board of Supervisors held a noticed public hearing on January 24, 2023; and, WHEREAS, the California State Legislature made findings and amended Health and Safety Sections 1596.72 and 1597.30 through the passage of SB 234 (Skinner) in support of the expansion of Family Daycare facilities; and, WHEREAS, this Zoning Code Amendment serves the citizens, and parents of Butte County by improving access, availability and by right approvals of Family Daycare Homes, Large in zones which permit residential uses; and, WHEREAS, the Butte County Board of Supervisors makes the following findings pursuant to Chapter 24, Article VI, Division 4, Section 24-275 — Findings and' decision: 1. Notice of the Board of Supervisor hearing on the Zoning Ordinance Amendments was given as required by law. 2. In accordance with the California Environmental Quality Act (CEQA) find the amendments to the Zoning Ordinance exempt pursuant to CEQA Section 15061 (b)(3), 3. The Board of Supervisors was presented with all of the information described in the recitals and has considered this information in adopting this resolution. 4. The proposed Adoption of the Amendments are consistent and compatible with the General Plan and any applicable community or specific plan as provided by Government Code Section 65,860. 5. The proposed Adoption of the Amendments is internally consistent with other applicable provisions of the Zoning Ordinance. 6. The proposed Adoption of the Amendments is in the public interest, and protectsthe health, safety, and welfare of the County. NOW, THEREFORE, BE IT RESOLVED, that the Butte County Board of Supervisors hereby takes the following actions: 1. Adopt the common sense (Section 15061 (b) (3)) determination, finding the project exempt from CEQA. 2. Adopt the attached Ordinance amending Chapter 24, (Zoning Ordinance) making text amendments to Article 11 - throughout, Article IV (Division 1, 24-159) and Article VII (Division: 1, 24-304), PASSED AND ADOPTED by the Butte County Board of Supervisors this 24th day of January, 2023, by the following vote: AYES: Supervisors Connelly, Durfee, Ritter, Teeter and Chair Connelly NOES: None ABSENT: None NOT VOTING: None lod Kim �S "mel ue, Chair Butte Count, Board of Supervisors ATTEST: Andy Pickett, Chief Administrative Officer and Clerk of the Board of Supervisors By: Deputy
