HomeMy WebLinkAbout23-010Resolution No. 23-010 A RESOLUTION OF THE BUTTE COUNTY BOARD OF SUPERVISORS ADOPTING A TEXT AMENDMENT TO BUTTE COUNTY CODE CHAPTER 24. (ZONING ORDINANCE) ARTICLE VII, DIVISION 1, SECTION 24-304. ALLOWING FOR SEPARATE, DETACHED DWELLING UNITS UNDER THE `MULTIPLE -FAMILY DWELLING' LAND USE DEFINITION WHEREAS, on October 26, 2010, Butte County adopted a new General Plan, including a new General Plan Land Use Map; and, WHEREAS, prior to the adoption of the new General Plan, Butte County embarked on a comprehensive update to the Butte County Zoning Ordinance ("Zoning Ordinance Update"), being a part of the overall Butte County General Plan 2030 project directed by the Board of Supervisors also referred to as "Meeting Series #8", which involves a comprehensive update to the existing Butte County Zoning Ordinance; and, WHEREAS, on September 27, 2012 the Planning Commission made recommendations to the Board of Supervisors, and on November 6, 2012, the Board of Supervisors adopted the Zoning Ordinance Update under Ordinance #4050, and Certified a Supplemental Final EIR under County Resolution 12-123; and, WHEREAS, at a noticed public hearing on December 8, 2022, the Planning Commission recommended that the Board of Supervisors adopt the CEQA common sense exemption (CEQA guidelines Section 15061 (b) (3)) and approve Zoning Code Amendment ZCA22-0002 (Resolution No. PC 22-26); and, WHEREAS, the Board of Supervisors held a noticed public hearing on January 24, 2023; and, WHEREAS, the ability for property owners to develop parcels that permit 'Multiple -Family Dwellings' is greatly increased with the addition of separate, detached dwelling units, serving our region with needed housing stock; and, WHEREAS, the Butte County Board of Supervisors makes the following findings pursuant to Butte County Code, Chapter 24, Article VI, Division 4, Section 24-275 — Findings and decision: 1. Notice of the Board of Supervisors hearing on the Zoning Ordinance Amendment was given as required by law. 2. In accordance with the California Environmental Quality Act (CEQA) find the amendment to the Zoning Ordinance is exempt pursuant to CEQA Guidelines Section 15061 (b) (3) -Common Sense Exemption. 3. The Board of Supervisors was presented with all the information described in the recitals and has considered this information in adopting this resolution. 4. The proposed Adoption of the Amendment are consistent and compatible with the General Plan and any applicable community or specific plan as provided by Government Code Section 65860. 5. The proposed Adoption of the Amendment is internally consistent with other applica,ble provisions of the Zoning Ordinance. 6, The proposed Adoption of the Amendment is in the public interest, and protects the health,, safety, and welfare of the County. 7. The proposed Adoption of the Amendment would enhance the availability of multiple housing types and support the Housing Element and attainment of Regional Housing Needs Assessment (RHNA)l goals within the unincorporated area of the County. Board of Supervisors hereby takes the following actions: 1. Adopt the common sense (Section 15061 (b) (3)) determination, finding the project exempt from CEQA. 2. Adopt the attached Ordinance amending Chapter 24, (Zoning Ordinance) making text amendments to Article V11 (Division 1, 24-304).
