PER GOVERNMENT CODE SECTIONS 7522.56 AND 21224
WHEREAS, incompliance with Government Code section 7522.56, the Butte County Board ofSupervisors must
provide CalPERS this certification resolution when hiring a retiree before 180 days has passed since his or her retirement
date; and
WHEREAS, Linda Schulken (Cal PERS ID 7728603385) retired from the County of Butte County Counsel on
December 31, 2022 from the position of Paralegal Supervisor -Confidential; and
WHEREAS, Government Code section 7522.56 requires that post-retirement employment commence no earlier
than 180 days after the retirement date, which is June 28, 2023, without this certification resolution; and
WHEREAS, Government Code section 7522.56 provides that this exception to the 180 -day wait period shall not
apply if the retiree accepts any retirement -related incentive; and
WHEREAS, the Butte County Board of Supervisors, the County of Butte and Linda Schulken, certify that Linda
Schu/kenhas not and will not receive a Golden Handshake orany other retirement -related incentive; and
WHEREAS, the County of Butte hereby appoints Linda Schulken as an extra help retired annuitant to perform
specialized duties as Paralegal Supervisor -Confidential for the County of Butte as permitted under Government Code
section 21224, effective February 15,2O23;and
WHEREAS, the entire employment agreement appointment document between Linda Schulken and the County
ofButte has been reviewed bythis body and isattached herein; and
WHEREAS, oomatters, issues, terms or conditions related to this employment and appointment have been or
will beplaced onoconsent calendar; and
WHEREAS, the employment shall be limited to 960 hours per fiscal year; and
WHEREAS, the compensation paid to retirees cannot be less than the minimum nor exceed the maximum
monthly base salary paid to other employees performing comparable duties, divided by 173.333 to equal the hourly
rate; and
WHEREAS, the maximum monthly base salary for this position is $6/4376Oand the houdvequkm|ent�-�3714
and the minimurnnmonth|ybase salary for this position is$4,803.O7and the hour�equ�a|entia_'27.71;and

WHEREAS, the hourly rate to be paid to Linda Schulken will be $37,14; and
WHEREAS, Linda Schu|kenhas not and will not receive any other benefit, incentive cornpensat'oninlieu nf
benef�orother form mfcompensadoninadd�iontothis hourly pay rate, '
NOW, THEREFORE, BE0[RESOLVED that the Butte County Board ofSupervisors hereby certifies the nature of
"the appointment of Linda Schulken as described herein and detailed in the attached employment appointment
:-doounnentand that this appointment isnecessary tofill the critically needed position nfParalegal Supervisor -
Confidential 6o/the County of Butte by February 15, 2023 because the County Counsel's Office needs her knowledge
arid skills Uo help with special research projects and upcomingannua| assignments that she isfamiliar with.
