863 FINANCING PROGRAM, AND AUTHORIZING THE DIRECTOR OF GENERAL SERVICES FINALIZE AND EXECUTE THE
AGREEMENT AND AMENDMENTS WITHIN THE APPROVED PROJECT BUDGET.
WHEREAS, the State of California has established a lease revenue bond financing program to construct and
renovate adult local criminal justice facilities through the SB 863 Adult Local Criminal Justice Facilities Construction
Financing Program ("Program"); and
WHEREAS, on August 11, 2015 the Butte County Board of Supervisors authorized the Board Chairman, in
Resolution No. 15-106, to submit an application for State bond financing under the Program for the Jail Program, Inmate
Treatment, Capacity and Replacement Housing Project (the "Project"); and
WHEREAS, on January 5, 2023, the County released an Invitation for Bids for construction of the Project using a
design -bid -build delivery method, and the proposal period closed on February 16, 2023; and
WHEREAS, the County received three responsive bids from Bobo Construction - $37,127,948, Broward Builders -
$35,046,000, and Slater & Son - $32,999,000; and
WHEREAS, on February 21, 2023, Butte County issued a Notice of Intent to Award to Slater & Son, Inc.; and
WHEREAS, on February 23, 2016, the Board, in Resolution No. 16-026 appropriated to the Project the sum of Four
Million Four Hundred and Forty -Five Thousand Dollars ($4,445,000) including matching funds derived from the value of
the land and staff time, and the remainder derived from Jail Impact Fees, Sheriff Impact Fees, and Local Assistance for
Rural and Small County Law Enforcement funds; and
WHEREAS, the Department of Finance (DOF) will consider a request to approve the award of the County's
agreement for the construction of the SB 863 Project. The DOF requires as a prerequisite to its action the County first
conditionally approve the award of the County's agreement for the construction of the Project; and
WHEREAS, staff recommends the Board approve the conditional award of a construction contract to Slater & Son,
Inc., contingent upon Department of Finance approval.
NOW, THEREFORE, BE IT RESOLVED that the Butte County Board of Supervisors hereby conditionally awards to
Slater & Son, Inc. for the maximum price of Thirty -Two Million Nine Hundred and Ninety -Nine Thousand Dollars
($32,999,000) conditioned upon receipt of the State funding identified above and the State approval to proceed with
construction of the project.
BE IT FURTHER RESOLVED that the Butte County Board of Supervisors authorizes that the matching funds are
derived from the value of staff time, and not from the value of the land, and the remainder derived from Jail Impact Fees,
Sheriff Impact Fees, and Local Assistance for Rural and Small County Law Enforcement funds, as noted in the updated
chart below:
