IMPACT REPORT FOR GENERAL PLAN 2840AND UPPER RIDGE COMMUNITY PLAN
WHEREAS, the purpose of the General Plan 2040 (GP 2040) Update is to ensure that Butte County continues to
make progress tnvxairdtheoonnnnunit/svisionforhsfuture,asdescdbedindheGenera|P|an,uvhi1eaccnmmting
for the substantial chainges that have occurred since General Plan 2830 was adopted and address State
legislative requirements such asclimate change and adaptation, fire hazards and environmental justice; and
WHEREAS, the GP204Dprocess included comprehensive community engagement plan that included the
following workshops, meetings and outreach devoted to:
�
Identifying the breadth and geognmpNc scope of environmental justice issues facing
unincorporated communities in Butte County, confirming where impacted communities are
located and how toengage with them.
� Accepting input on proposed policies to address safety, resilience, housing, and environmental
justice issues in, the county; and
WHEREAS, the GP 2040 process includes an, update to the Butte County General Plan Settings & Tre,nds Report;
and
WHEREAS, the <5P 2040 process includes on update to the Butte County Climate Change Vulnerability
Assessment: and
WHEREAS, aduly notice public hearing was held bvthe Board mfSupervisors omMarch D,2O22,regarding the
QpperRidge Community Plan inwhich they reviewed and considered the information inthe administrative
record, reports, all oral and written testimony, and recommendation from the Planning Commission, and
accepted the Upper Ridge Community Plan; and
WHEREAS, the Butte County Board of Supervisors was provided with the complete contents of the Final
Environmental Impact Report (FEUR) (March 2023), includ'ing the Butte County General Plan Diraft Environmental
WHEREAS, the Butte County Planning Commission held a noticed public hearing on March 9, 2023 and
recommended certification of the Final Elft, adoption of General Plan 2040, GP 2040 Action Plan, and the Upper
Ridge Community Pian to the Board of Supervisors; and
WHEREAS, the Butte County Board of Supervisors held a noticed public hearing on March 28, 2023 regarding
certification of the Final EIR, adoption of General Plan 2040, GP 2040 Action Plan, and the Upper Ridge
Community Plan; and
WHEREAS, the County compiled with the requirements of the California Environmental Quality Act (CEQA Public
Resources Code Sections 21000-211178.1) recommending certification of the Butte County General Plan 2040
FEIR; and
WHEREAS, the DEIR (State Clearinghouse Number 2022100151) was made available on January 6, 2023, to
members of the Planning Commission, Board of Supervisors, state and local agencies, GP2040 Stakeholders,
other interested groups and individuals, and the public. The DEIR and Notice of Completion (NOC) were provided
to the State Clearinghouse for distribution to state agencies. The notice of public hearing was established in four
local newspapers of general circulation to be begin a 45 -day public review and comment period from January 6,
2023 to February 21, 2023, on the adequacy of the DEIR; and
WHEREAS, in conjunction with the release of the DEIR for the GP 2040 Update the Planning Commission met
on January 26, 2023, and received public comment on the DEIR, in accordance with Butte County Environmental
Review Guidelines; and
WHEREAS, on March 2, 2023, a FEIR was released for the public's review. The FEIR included responses to all
comments received on the DEIR. Including comments provided at the January 26, 2023 Planning Commission
meeting; and
WHEREAS, the Butte County Board of Supervisors has reviewed and considered the information in the FEIR
described above, FEIR administrative record, staff report, and all oral and written testimony presented to the
Board of Supervisors.
NOW, THEREFORE, BE IT RESOLVED, that the Butte County Board of Supervisors certify the FEIR for the
following reasons:
1. Notice of the Butte County Board of Supervisors hearing on the GP 2040 environmental review
documents was given as required by law and the actions were conducted in accordance with CEQA, and
the State CEQA Guidelines.
2. All individuals, groups and agencies desiring to comment were given adequate opportunity to submit
oral and written comments on the environmental review documents. These opportunities for comment
meet or exceed the requirements of CEQA.
3. All comments submitted during the public review and comment period on the DEIR were responded to
adequately.
4. The Butte County Board of Supervisors was presented with all of the information described in the recitals
and has considered this information in adopting this resolution.
5. The FEIR (a) has been completed in compliance with the intent and requirements of CEQA and the State
CEQA Guidelines, (b) reflects the independent judgement and analysis of the County of Butte, and (c)
has been presented to andi reviewed and considered by the Board of Supervisors in its deliberations
regarding the adoption of GP 2040 Update.
PASSED AND ADOPTED by the Butte County Board of Supervisors this 28t" day of March, 2023 by the following
vote:
AYES: Supervisors Connelly, Durfee, Ritter, Teeter and Chair Kimmelshue
