Please work with your surveyor or engineer and contact the Butte County Public Works Department to complete the conditions of approval and record the parcel map. Public Works is located at 7 County Center Drive, Oroville, CA 95965. You have 24 months after approval or conditional approval to record the map prior to map expiring. You may apply for a map extension for an additional 24 months. Map extensions should be filed a minimum of thirty (30) days prior to the expiration date. If you are required to expend $236,790 or more to construct, improve, or finance the construction or improvement of public improvements outside the property boundaries of the tentative map, excluding improvements of public rights-of-way that abut the boundary of the above referenced property and that are reasonably related to the development of that property, each filing of a final map authorized by Government Code Section 66456.1 shall extend the expiration of the approved or conditionally approved tentative map by 48 months from the date of its expiration. Sincerely, Tristan Weems, AICP Senior Planner CC: Kim Hunter and Jessica Hankins, Public Works Attachments: Conditions of Approval ATTACHMENT A CONDITIONS OF APPROVAL Catomerisios APN 018-010-092, Project # MISC23-0005: An Urban Lot Split (Planning File # MISC23-0005) of one (1) parcel APN: 018-010-092. The project site is located at 84 Centennial Avenue, Chico CA 95928, approximately 0.2 miles west of Chico Canyon Road in an unincorporated area of Chico, Butte County. Assessor Parcel Number: 018- 010-051. The zoning is VLDCR (Very Low Density Country Residential), the general plan designation is VLDR (Very Low Density Residential). Existing parcel size is 0.73 acres. The resultant parcel sizes are approximately 0.438 and 0.292 acres. Cal Fire/Butte County Fire 1. Construction, installation, or development of buildings and/or roads, driveways, gates, and bridges on parcels/lots shall comply with the current adopted California Fire Code and current Butte County Improvement Standards, whichever is stricter. 2. Prior to building construction, provide an all-weather access of at least 10 feet wide for residential, and 20 feet wide for commercial, and vertical clearance of 15 feet that will allow for ingress and egress and accommodate a 40,000-pound fire apparatus to within 150 feet of all structures. 3. Place a note on a separate document, which is to be recorded concurrently with the Parcel or Final map, or on an additional map sheet stating, “Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the time of permit issuance and maintained continuously thereafter. 4. The Parcel is less than 1000’ of a fire hydrant. The applicant may forego hydrant installation and payment shall be made into the hydrant fund at the current rate per lineal foot of street frontage. Must be prior to recordation of the Parcel or Final map. City of Chico Public Works 5. Provide a 15-foot wide accessway that provides access to both parcel 1 and parcel 2. This 15-foot wide accessway is to be taken off of Centennial Avenue. Butte County Public Works A. COUNTY SURVEYOR 6. Map Recordation: Prior to map recordation: a. The applicant shall submit to the County Surveyor for review and approval a final map pursuant to Subdivision Map Act Section 66444-66450. b. The applicant shall prepare a Supplemental Data Sheet for all information not affecting record title interest. The Supplemental Data Sheet shall contain a statement that the additional information, conditions of approval or comments are for informational purposes only and are not intended to affect record title interest. Additional information may include but is not limited to building setback lines, flood hazard zones, seismic lines and setbacks, leach field free areas and usable sewage disposal areas. c. The applicant shall show all easements of record on the final map and shall provide deeds establishing all existing and proposed easement and rights of way on the property. d. The applicant shall pay in full any and all delinquent, current and estimated taxes and assessments as specified in Article 8 of Chapter 4 of Division 2 of Title 7, of the California Government Code commencing with Section 66492. A tax certificate is to be provided to the County Surveyor prior to recording. e. The applicant shall submit a Preliminary Title Report that has been prepared within 6 months of the map recordation date. f. The applicant shall provide deeds establishing property boundaries. g. The applicant shall provide copies of all lot and boundary closures (calculation showing error of closure). h. The applicant shall pay the recording fees in effect at the time the final map and related documents are recorded. i. The parcel map shall contain a certificate by the engineer or surveyor responsible for the preparation of the map that states that all monuments are of the character and occupy the positions indicated, or that they will be set in such positions on or before ninety (90) days from the date of recordation, per Butte County Code of Ordinance Section 20-109.5. The certificate shall also state that the monuments are or will be sufficient to enable the survey to be retraced. B. STREETS 7. City Street Standards: Pursuant to Butte County General Plan Policy CIR-P6.5, the applicant shall construct street and associated improvements, including roads, curb, gutter, and sidewalk, in conformance with City of Chico design standards, if the City of Chico requires them. 8. Driveway Approach: Prior to development, obtain an encroachment permit, submit road and drainage improvement plans, if required by the City of Chico, to the Public Works Department, and improve all new and existing driveway approaches to publicly maintained roads as specified in county Improvement Standard S-31B and the terms of the encroachment permit and improvement permit. Adequate sight distance shall be provided. C. SOILS, DRAINAGE, FLOODING 9. Stormwater Quality Management. The project is within the MS4 Area and is therefore subject to the following MS4 conditions: a. Construction Phase: Prior to any soil disturbance and prior to issuing a grading, building, and improvement permits, the applicant shall submit an erosion and sediment control plan (ESCP) to the Public Works Department for approval. BMPs included in the ESCP must be in accordance with Section 50-19 of County Code, and/or consistent with the California Stormwater Quality Association BMPs. Revisions to an approved ESCP must be resubmitted for Department of Public Works approval prior to commencing with site work. A Storm Water Pollution Prevention Plan (SWPPP) developed pursuant to the CGP may be submitted in lieu of the ESCP. Add a note on a map sheet that states: “Development activities resulting in soil disturbance shall submit an erosion and sediment control plan (ESCP) to the Department of Public Works for approval. ESCP shall contain appropriate site-specific construction site BMPs.” b. Post Construction: Prior to issuance of improvement permits, implement post-construction Best Management Practices (BMPs) consistent with State Water Resources Control Board Order 2013-0001-DWQ to control the volume, rate, and potential pollutant load of stormwater runoff, including, but not limited to, requirements to minimize the generation, transport and discharge of pollutants. Develop and submit a Post Construction Stormwater Management Plan (PCSMP) that identifies BMP stormwater treatment system(s) designed to reduce or eliminate stormwater pollutant discharges through the construction, operation and maintenance of source control measures, low impact development design, site design measures, stormwater treatment system(s) and/or hydromodification measures. Design and sizing requirements shall comply with the Post- Construction Stormwater Management Program (section E.12) requirements of State Water Resources Control Board Order 2013-0001-DWQ (as amended under 2018-0001-EXEC). Regulated projects are defined in State Water Resources Control Board Order 2013-0001-DWQ and are generally considered as new and redevelopment projects on public or private land that fall under the planning and permitting authority of the and are within the MS4 area that create or replace greater than or equal to 5,000 square feet of impervious area, excluding: a) detached single family residences that are not part of a common plan of development; b) interior remodels; c) routine maintenance or repair; or d) a Linear Underground/Overhead Utility Projects unless the project has a discrete location of that has 5,000 square feet or more of newly constructed contiguous impervious area. c. Post Construction: Prior to improvement plan approval, regulated projects shall submit a Stormwater Facilities Operations and Maintenance (O&M) Plan that identifies the operations, maintenance, and inspection requirements of all stormwater Best Management Practices (BMPs) treatment system(s) and hydromodification measures identified in the approved PCSMP. All public and private stormwater treatment system(s) and hydromodification measures shall be protected, inspected, and maintained to ensure continuous and fully effective performance as designed. A maintenance and inspection schedule for both dry and wet season BMPs shall be in writing, and a record shall be kept that includes the dates of inspection or maintenance, whether BMPs were inspected or maintained, a description of any maintenance activity, and the name of the inspector or maintenance foreman. The owners or operators of facilities required to implement post-construction BMPs shall enter into a written maintenance agreement with the County or other formal maintenance entity such as a County Service Area or Homeowners Association for maintenance of such features. Regulated projects shall grant site access to Butte County or other formal maintenance entity for the sole purpose of implementing and performing measures in the O&M plan for the installed stormwater treatment system(s) and hydromodification measures. FEES 10. Mitigation Fees a. Prior to issuance of building permits, pay all applicable mitigation fees in place at the time of issuance. b. Prior to map recordation, pay drainage impact fees per Article XI, Chapter 3 of Butte County Code. c. Pay all applicable assessments established by affected assessment districts, in full. The project is located in County Service Area 24.
