HomeMy WebLinkAbout23-047RESOLUTION AUTHORIZING THE TEMPORARY CLOSURE OFKOQNTOSHAVENUE TOVEHICULAR TRAFFIC JUST EAST OF WHEREAS, California Vehicle Code section 21101/4 allovvm the tenmpmrary closure of a road by resolution of the Board ofSupervisors where the road isnot needed for vehicular traffic; and WHEREAS, the Butte County Department of Public Works has responded to numerous resident -driven compWrits about illegal dumping a1the end mfMcIntosh Avenue; and WHEREAS, the County of Butte desires to continue to improve health and safety issues on McIntosh, Avenue just east of its intersection with Diarnond Avenue due to illegal activity along this portion of the road; end Whereas, the following conditions exist, meeting the requirements of California Vehicle Code section 21101.4: 1 The Butte County Sheriffs Office supports the closure of McIntosh Avenue 'msT east of its intersection with Diamond Avenue due twserious and continual illegal dumping; 2. McIntosh! Avenue iunot designated asathrough highway orarterial street; 3. Vehicular and pedestrian traffic contributes to serious and continival illegal dumping on McIntosh Avenue; and 4. The closure will not substantially adversely affect traffic flow, safety on the adjacent streets orin the surrounding neighborhoods, the operation of emergency vehicles, the performance of municipal or pu�lic utility services, or the delivery of freight by commercial vehicles in the area of McIntosh Avenue. WHEREAS, the road closure is exempt from CEQA pursuant to CEQA Guidelines section: 15301(c); and WHEREAS, notice of the proposed temporary road closure and of the time and place of the hearing on, the proposed closure has been given hmthe manner and atthe time required by Vehicle Code 21181'4(c) and, asbeen served by mail on the owner of each property adjoining the street proposed for temporary closure. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors hereby authorize,s and directs the closure of McIntosh Avenue to vehicular traffic approximately juist east of its interse,ction with Diamond Avenue, subject to further direction and action bwthe Board ofSupervisors, effective from April 25,2O23,through October 25,2O24.
