PROJECT DESCRIPTION: A pre-application review of a monopole cell tower 100’ in height with an additional 8’ lightning rod; with Verizon Wireless as
the first tenant. Located on a ten-acre parcel. A single-family residence is located 30’ south of Burdick Road, situated in the middle of the parcel.
There are several small sheds located on parcel as well. The tower area will be enclosed with a 75’ x 75’ x 8’ tall privacy fence.
PROJECT LOCATION: The project site is located at 3171 Burdick Road, Durham (APN: 039-250-007) on the south side of Burdick Road, approximately
two miles west of downtown Durham. ZONING: AG-20 (Agriculture 20 – acre minimum) GENERAL PLAN DESIGNATION: AG (Agriculture)
Departments Comments
Planning Division Land Use, Zoning, & Permitting Greater than 1,000 feet from any residential zone. 24-181 3.
1. Agriculture 20-acre minimum Zoning: AG-20; New Monopole permitted with an approved
Conditional Use Permit.
2. Must meet application requirements of Telecommunications Ordinance 24-180 A. 1-23.
3. Must meet application requirements of 24-180 B.:
Projects in agriculture zones shall, prior to submitting an application
for a proposed facility, submit a site plan of the proposed facility to
the Butte County Agricultural Commissioner for comment and send a
notification letter to all aerial agricultural applicators registered in
the county informing them of the proposed site location and tower height.
No hearing on an application for a proposed facility in any agriculture
zone will be scheduled, nor shall any permit for any such facility be
issued without proof that the Butte County Agricultural Commissioner and
all aerial agricultural applicators registered in the county have been
notified, as specified above.
4. Must meet Agriculture Zone specific requirements: 24-182. A.
5. Height of the array exceeds the allowed 100’: either reduce the height to conform with the standard,
or recommend an exception showing justifiable need to the Planning Commission to permit the
lightning rod at a 108’ height. Refer to 24-181 B. 1.: “The review authority may approve
additional height based upon justifiable need.”
6. Setbacks: Show a minimum setback distance equal to the total height of the facility (including the
lightning rod). At present the plans show a 100’ setback. In addition, measure the setback from the
edge of the tower, not the center.

Public Works The project takes direct from Burdick Road, a County-maintained Road, and will not contribute substantially to traffic in its operational status. The project is not within the MS4 area and is outside any
incorporated municipality’s sphere of influence. As such, the following tentative conditions of approval are
anticipated for this project.
1. Prior to issuance of grading and building permits, obtain an encroachment permit and improve all
driveway approaches to publicly maintained roads as specified in the county improvement
standards (S-31) and the terms of the encroachment permit.
2. Prior to initiating any ground-disturbing activity that is to occur within the County right of way (if
applicable) for the proposed utility pole, obtain an encroachment permit from the Butte County
Department of Public Works.
3. Coverage under the stormwater Construction General Permit (CGP) will be required by the State
Water Resources Control Board if the project results in ground disturbance, including clearing,
excavation, filling, and grading of one or more acres or disturbs less than one acre but is part of a
larger common plan or development that disturbs more than one acre in total. Coverage under this
General Permit must be obtained from the State Water Resources Control Board prior to starting
construction. If coverage under the CGP is required, engineering plans shall show the Waste
Discharge Identification (WDID) number on the title sheet of the plans and a copy of the Storm
Water Pollution Prevention Plan (SWPPP) shall be provided to the Land Development Division of
the Public Works Department. Submit with improvement or grading plans the estimated areas to be
disturbed to the Department of Public Works for consistency with the SWPPP.
4. Show all easements of record on the site improvement plans.

Environmental Health 1. Site plan must show location of existing septic system and well specifying setbacks to project location and
any required easements. Operator must submit a Hazardous Materials Business Plan to California
Environmental Report System within 30 days of storing hazardous materials on-site in reportable
quantities.

Cal Fire Fire has reviewed all submitted documents for the proposed communication tower located on APN 039-250-007.
This project is located within the Local Responsibility Area (LRA) and is not within a Fire Hazard Severity Zone. Butte County is the Fire Department having jurisdiction and would like to provide the following comments. In addition to this memo, Trakit has been updated.
1. Supply a Knox Box Key box or lock for fire access. California Fire Code Sec. 506.1

In the agriculture zones (AG, AS), the Zoning Administrator (for Administrative and Minor Use Permits),
and the Planning Commission (for Conditional Use Permits, and appeals) may approve a reduced setback requirement if; a. The facility is located adjacent to an existing structure such as a barn, rice dryer, or other existing facility such that the facility will blend with the surrounding area; or b. Adjacent property owners consent in writing to a reduced distance, no less than the minimum setback
required by the applicable zone. Additional setback modifications may be permitted, as described in Subsection 3. below. A. Agriculture Zones. All facilities in AG and AS zones shall comply with the following standards. 1. The review authority may require that tower or pole facilities be painted from a height of ten (10) feet
above the ground to the top of the facility with alternating aviation orange and white stripes and have a flashing or steady burning light installed on the top that is shielded from the ground to prevent visual impacts, unless the applicant can demonstrate that such measures are not required to ensure compatibility with established air navigation practices in the immediate area. 2. All obstruction lighting shall be visually inspected on a regular basis to ensure proper operation. Any
lighting failure or malfunction that affects a top light or flashing light regardless of its position on the tower
shall be reported immediately to the Department of Development Services and remedied in a timely
manner. 3. Facilities are encouraged to be located to ensure compatibility with established or anticipated future air navigation practices in the immediate area, as well as to minimize the disruption of agricultural land, provided all other applicable site development standards are met.
