95926, EHCE23-00063, Surfacing Sewage
Dear John Scott:
Butte County Public Health, Environmental Health Division (EH) has determined that
there are code violations present on the property at the above referenced location.
Specifically, the violations include:
Chapter 19-7C Prohibitions
(1.) No person shall treat or dispose of wastewater in any manner other than by an
approved on-site wastewater system, community wastewater system, public sewer
system or other method meeting the standards set forth in this chapter and the On-
Site Wastewater Manual.
(4.) No person shall construct, operate or maintain an on-site wastewater system or
community wastewater system that does not comply with the applicable requirements
specified in this chapter, the Construction Permit, the Operating Permit, and the On-
Site Wastewater Manual.
(10.) No person shall maintain or operate a non-discharging wastewater system,
such as a holding tank, composting toilet, or vault privy, except for non-residential and
non-commercial limited-use applications, such as agricultural storage buildings and
primitive-type picnic grounds, campsites, and recreation areas where on-site
wastewater systems are not feasible, as determined by the LEA. Portable toilets may
be used, on a temporary basis, for community events and at construction sites. Said
non-discharging wastewater systems shall meet the specifications for maintenance
and operation in the On-Site Wastewater Manual.

A site inspection was completed on Monday July 17, 2023. The result of the inspection
revealed that the septic tank area had an open cleanout with minimal standing effluent
around the septic tank area. There was no running water or effluent at the time of the
inspection. Facility operator, John Scott, stated that the septic tank has been pumped
and required repairs are being assessed. Operator required to clean, cap, and lime the
surfacing area.
In order to bring the property into compliance with EH Code and avoid further
enforcement actions, you are hereby requested to take the following abatement or
correction actions:
1. Cease and desist all surfacing.
a. Connect/cap cleanouts
b. Clean surfacing area
c. Lime all wet/moisture areas
d. Consult a certified installer for repairs
It is the county’s goal to obtain voluntary compliance with the local Wastewater
Ordinances and the California Health and Safety Code. You should know that Butte
County has an active Enforcement Program that provides an effective means of
enforcement if voluntary compliance is not obtained. Enforcement may be pursued
through the issuance of citations, fines, and recording of a Notice of Violation including
a description of the action necessary to abate the violation. You have ten (10) days to
voluntarily respond to this notice.
