HomeMy WebLinkAbout23-078RESOLUTION AUTHORIZING THE GRANT OF A NON-EXCLUSIVE EASEMENT FOR UNDERGROUND UTILITY LINE
PURPOSES AFFECTING COUNTY OWNED REAL PROPERTY IN CHICO
WHEREAS, the County of Butte (County) owns real property identified as Assessor's parcel number 006-240-052,
with a portion using physical address 540 Cohasset Road in Chico, California (Property); and
WHEREAS, on October 27, 2020, the Board of Supervisors approved a license agreement for the Chico Housing
Action Team (CHAT) to occupy this portion of the Property for the purpose of delivering site improvements and emergency
shelter services; and
WHEREAS, on April 27, 2021, the Board of Supervisors approved the agreement titled Project Delivery and
Operations for Emergency Shelter Units, now known as Everhart Village (Project), as well as an amendment to the license
with CHAT extending the term to 2036, enabling CHAT use of the Property to manage the Project; and
WHEREAS, in order for the Project to be successful, the Project requires new utilities. Therefore, the County
desires to grant to Pacific Gas and Electric Company (PGE) a non-exclusive easement on the Property for the construction,
installation, use and continued maintenance of a new utility line for the Project; and
WHEREAS, once construction of the new line is complete, the recording of the Easement Deed will constitute a
covenant and will run with the land for the benefit of PGE.
NOW, THEREFORE, BE IT RESOLVED that the Butte County Board of Supervisors hereby:
Approve the conveyance of non-exclusive real property easement rights over a portion of County
owned real property to PGE.
Authorize the Director of General Services to execute all documents necessary to facilitate the
conveyance including the Easement Deed.
