After review of the materials, we find that the most expeditious entitlement process to realize your goal of a 9-hole golf course is through a Rezone, Minor Use Permit, and Grading Permit. A Pre-Development Meeting is recommended as well. Pre-Development Meeting: This is a review of your project by Butte County Fire, Environmental Health, Public Works, Planning, the Agricultural Commissioner’s Office, and the Building Division. The meeting, with your attendance, is held on a Wednesday in the early afternoon. The fee for the Pre-Development Meeting is: $1,471.58 (flat). At the conclusion of the meeting, you can expect draft conditions as would be applied to your project through submission for the entitlements. Zoning: Your parcels are located in the Heavy Industrial (HI) and Light Industrial (LI) zoning districts. The Recreation Commercial Overlay (-REC) from the Butte County Zoning Ordinance Chapter 24-40 permits, through a Rezone Application, a golf course with an approved Minor Use Permit. Fees: The Rezone application fee is $12,152.42 (retainer). The Minor Use Permit fee is: $3,748.95 (flat fee). This assumes application for the Rezone and Minor Use Permit concurrently, with one CEQA document. If the Rezone and Minor Use Permit are applied for separately, the fee for the Minor Use Permit, with its own CEQA document is: $10,552.20. The associated CEQA document for the combined application for the Rezone, and Minor Use Permit, could be used for the required Grading Permit. Process: The Rezone, Minor Use Permit, and Grading Permit application types are discretionary and would be heard at the five-member Planning Commission Hearing Body. There is no guarantee of approval based on successful submission of application materials and payment of the fee(s). The projects are publicly noticed prior to the public hearing. CEQA: The California Environmental Quality Act is applied to the project, and would encompass biological, traffic, drainage, flooding, and other environmental impacts pursuant to CEQA. City of Chico Sphere of Influence: The project area resides within the City of Chico Sphere of Influence. This is an area of expected growth of the City. Staff will circulate the project to the City of Chico for their comment. Other Concerns: Portions of the parcels are located in the 100-year Flood Zone and 200-year Chico Flood Zone. A separate grading permit would be required through the Public Works Department. Building permits would be required for structures. Wastewater permits would be needed through the Regional Water Quality Control Board, Butte County Department of Public Health, Environmental Health Division. There is also a 50-foot riparian buffer from the high-water mark of Butte Creek, located in the southeastern portion of the project area. Structures are not allowed within this area, unless an approved Minor Use Permit is obtained (24-77 C. 1.). This list of concerns is not meant to be exhaustive as more details may become evident as the project is reviewed by staff.
