HomeMy WebLinkAbout23-117BOARD tF 11RS COUNTY OF BUTTE, STATE OF CALIFORNIA Resolution No. 23-117 RESOLUTION DECLARING THE LEASE OF REAL PROPERTY FROM THE UNITED STATES OF AMERICA, ACTING THROUGH THE DEPARTMENT OF AGRICULTURE, FOREST SERVICE TO THE COUNTY WHEREAS, the St. John's Communication site in the County of Glenn, State of California, Sec. 7, T. 18 N., R. 7. W., Mt. Diablo Meridian, located in the Mendocino National Forest (Property), is an integral part of the County's Information System structure; and WHEREAS, the United States of America, acting through the United States Department of Agriculture, Forest Service (Lessor) is owner of the Property; and WHEREAS, in January 1977 the Lessor, issued the County, a non-exclusive, Special Use Permit (Permit) for a portion of the Property to construct and operate a vault and tower (Facility) for communication purposes; and WHEREAS, the Permit was amended in 1979 and 2017, respectively, and the Lessor now desires to issue a new Lease, waiving rent for the next five (5) years, for a term commencing upon full execution expiring December 31, 2050; and NOW, THEREFORE, BE IT RESOLVED that the Butte County Board of Supervisors hereby adopts this resolution as declaration of its support of the Facility and intent to execute the Lease for the Property. vote: PASSED AND ADOPTED by the Butte County Board of Supervisors this 10th day of October 2023, by the following AYES: Supervisor Connelly, Durfee, Ritter, Teeter and Chair Kimmelshue NOES: None ABSENT: None ABSTAIN: None ATTEST: Andy Pickett, Chief Administrative Officer and Clerk of the Board of Supervisors By__ I , C�A' Deputy Board of Supervisors
