Resolution No. 23-135 RESOLUTION AMENDING NON -LAND USE FEES IN THE MASTER FEE SCHEDULE FOR SERVICES PROVIDED BY THE COUNTY OF BUTTE FOR THE DEPARTMENT OF ADMINISTRATION, CLERK -RECORDER'S OFFICE, DEPARTMENT OF INFORMATION SYSTEMS, COUNTY LIBRARY, DEPARTMENT OF PUBLIC HEALTH, SHERIFF'S OFFICE, AND TREASURER - TAX COLLECTOR'S OFFICE WHEREAS, the Board of Supervisors established the Butte County Master Fee Schedule by Resolution on March 24, 2009, and has periodically amended the Fee Schedule over time; and WHEREAS, the Master Fee Schedule is a schedule of fees for services provided by the County that benefit individuals or businesses; and WHEREAS, pursuant to the provisions of the California Constitution and the laws of the State of California, the County of Butte is authorized to adopt and implement fees for services, provided however, that such fees do not exceed the estimated reasonable cost of providing such service; and WHEREAS, the County annually updates the Master Fee Schedule to increase and maintain clarity, consistency, transparency, and cost recovery; and WHEREAS, County Code section 3-331 allows periodic adjustments to user fees based on an increase in the cost of providing services; and WHEREAS, pursuant to County Code section 3-331 an increase in the cost of providing services for user fees is calculated by the net percentage increase in the Employment Cost Index (ECI) (Not Seasonally Adjusted, Total Compensation, State and Local Government, Index Number, All Workers) as published by the United States Department of Labor, Bureau of Labor Statistics; and WHEREAS, on October 25, 2022, the Board of Supervisors approved a resolution amending the Master Fee Schedule based on the net percentage increase in the ECI through the second quarter of 2022; and WHEREAS, the ECI in the second quarter of 2022 was 150.7 and increased to 158.1 in the second quarter of 2023, resulting in a net percentage increase of 4.91%; and WHEREAS, the Department of Administration, Clerk -Recorder's Office, Department of Information Systems, County Library, Department of Public Health, Sheriff's Office, and Treasurer -Tax Collector's Office request to apply the ECI increase of 4.91% to fees in their fee schedules; and WHEREAS, the Clerk -Recorder's Office, Department of Public Health, Sheriff's Office, and the Treasure -Tax Collector's Office request to remove and/or modify fees in their fee schedules; and WHEREAS, The Department of Public Health requests to add one (1) new laboratory test fee to their fee schedule; and WHEREAS, the Department of Administration, Clerk -Recorder's Office, Department of Information Systems, County Library, Department of Public Health, Sheriff's Office, and Treasurer -Tax Collector's Office list non -land use fees in their fee schedules; and WHEREAS, pursuant to County Code section 3-331, a fee mandated by another jurisdiction will be automatically adjusted to reflect the adjustments made to the fee by the other jurisdiction; and WHEREAS, pursuant to Government Code, non -land use fees shall be effective no sooner than 30 days following the final action on the adoption of the fee or charge or increase in the fee or charge; and WHEREAS, a public hearing was noticed twice in the Chico Enterprise -Record and Oroville Mercury -Register, 14 and seven (7) days prior to the date of this Resolution, to allow consideration and public comment on the proposed fee adjustments. NOW, THEREFORE, BE IT RESOLVED that the Butte County Board of Supervisors hereby adopt fees as delineated in Exhibit A (Non -Land Use) and amends the Butte County Master Fee Schedule to reflect the changes; and vote: BE IT FURTHER RESOLVED all fee adjustments shall become effective January 1, 2024.
