HomeMy WebLinkAbout23-143►OARD OF SUPERVISORS AUNTY OF BUTTE, STATE OF CALIFORNIA Resolution No. 23-143 A RESOLUTION OF THE BUTTE COUNTY BOARD OF SUPERVISORS AMENDING THE LAND USE MAP OF THE COUNTY'S GENERAL PLAN FROM RURAL RESIDENTIAL TO PLANNED UNIT DEVELOPMENT AT CERTAIN REAL PROPERTY OFF CRANE AVENUE, 500 FEET EAST OF MELROSE DRIVE, IN THE UNINCORPORATED AREA OF BUTTE COUNTY, ONE MILE SOUTHEAST OF THE CITY OF OROVILLE; ASSESSOR PARCEL NUMBER 079-150-001 WHEREAS, Estom Yumeka Maidu Indians of the Enterprise Rancheria (Applicant) proposes a General Plan Amendment, Rezone, and Development Plan (PUD21-0002) to develop twelve single-family residential dwellings, site improvements, and access road on 64.1 acres at a certain real property off Crane Avenue, 500 feet east of Melrose Drive, in an unincorporated area of Butte County, approximately one mile southeast of the City of Oroville; Assessor Parcel Number: 079-150-001; and WHEREAS, the proposed General Plan Amendment encompasses the entire 64.1-acre parcel and would amend the County's General Plan land use map from Rural Residential (RR) to Planned Unit Development (PUD); and WHEREAS, the General Plan Amendment was filed in accordance with Butte County Code Chapter 24, Article VI, Division 5 (General Plan Amendments); and WHEREAS, an Initial Study and Mitigated Negative Declaration were completed for the project in compliance with the California Environmental Quality Act and circulated for public review and comment for 30 days starting May 25, 2023, through June 23, 2023; and WHEREAS, said applications were referred to various affected public and private agencies, County departments, and referral agencies for review and comments; and WHEREAS, at a noticed public hearing on September 28, 2023, the Planning Commission recommended that the Board of Supervisors adopt the Mitigated Negative Declaration and approve this General Plan Amendment (Resolution No. PC23- 17); and WHEREAS, the Board of Supervisors held a duly noticed public hearing on November 7, 2023, and has considered public comments received and a report from the Planning Division. NOW, THEREFORE, BE IT RESOLVED that the Butte County Board of Supervisors hereby: Adopts the Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program with the following findings: 1. The Initial Study was completed in compliance with the California Environmental Quality Act. Said Study identified significant environmental effects and included mitigation measures to mitigate such effects below significant levels. 2. The Board of Supervisors has considered the Mitigated Negative Declaration, together with comments received during the review process. 3. On the basis of the whole record before the Board of Supervisors, including the environmental document and any comments received, there is no substantial evidence that the project, with mitigations here attached as Exhibit A, would have a significant effect on the environment. The custodian of the record is the Department of Development Services. The location of the record is 7 County Center Drive, Oroville, CA 95965. 4. The Mitigated Negative Declaration reflects the independent judgment and analysis of the County, which is the Lead Agency. II. Adopts the General Plan Amendment, as shown in Exhibit B, with the following findings in Butte County Code Article VI, Division 5, section 24-275: 1. The proposed General Plan Amendment is in the public interest. 2. The proposed General Plan Amendment is consistent and compatible with the rest of the General Plan. 3. The potential effects of the proposed General Plan Amendment have been evaluated and have been determined not to be detrimental to the public health, safety, or welfare. 4. The proposed General Plan Amendment has been processed in accordance with the applicable provisions of the California Government Code and CEQA. PASSED AND ADOPTED by the Butte County Board of Supervisors this 71h day of November 2023 by the following vote: AYES: Supervisor Connelly, Durfee, Ritter, Teeter and Chair Kimmelshue NOES: None ABSENT: None NOT VOTING: None Tod Kimmelshue, Chair Butte Coun Board of Supervisors ATTEST: Andy Pickett, Chief Administrative Officer and Clerk of the Board of Supervisors Deputy EXHIBIT A Mitigation Monitoring and Reporting Program Enterprise Rancheria Housing Project Mitigation Monitoring and Reporting Program MITIGATION MONITORING AND REPORTING PROGRAM In accordance with the California Environmental Quality Act (CEQA), Butte County (County) prepared a Mitigated Negative Declaration (MND) that identifies adverse impacts related to the Enterprise Rancheria Housing Project (Project). The MND also identifies mitigation measures that would reduce or eliminate these impacts. Section 21081.6 of the California Public Resources Code (PRC) (§ 15091(d) and 15097 of the State CEQA Guidelines) requires public agencies "to adopt a reporting and monitoring program for changes to the project which it has adopted or made a condition of project approval in order to mitigate or avoid significant effects on the environment." A mitigation monitoring and reporting program (MMRP) is required for the Project because the MND for the project identified potentially significant adverse impacts related to construction and implementation activities, and mitigation measures have been identified to mitigate those impacts. PURPOSE OF MITIGATION MONITORING AND REPORTING PROGRAM This MMRP has been prepared to ensure that all required mitigation measures are implemented and completed according to schedule and maintained satisfactorily during project implementation as adopted by the County, as required. The MMRP may be modified by the County during Project implementation, as necessary, in response to changing conditions or other refinements. The attached Mitigation Monitoring and Reporting table has been prepared to assist the responsible parties in implementing and documenting required mitigation measures. The table identifies individual mitigation measures, implementation timing/schedule, responsible person/agency for implementing the measure, implementation, and verification action, and provides space to confirm implementation of the mitigation measures. The numbering of mitigation measures follows the numbering sequence of the MND. ROLES AND RESPONSIBILITIES Unless otherwise specified herein, the County is ultimately responsible for ensuring that mitigation measures are implemented according to the specifications provided for each measure and for demonstrating that the action has been successfully completed. At its discretion, the County may delegate implementation responsibility or portions thereof to a licensed contractor or professional. In most instances, the applicant is responsible for funding and implementing the measures. The County will be responsible for the overall administration of the MMRP and for 1 ENTERPRISE RANCHERIA HOUSING PROJECT MITIGATION MONITORING AND REPORTING PROGRAM verifying that County staff and/or the construction contractor has completed the necessary actions for each measure. The County will designate a project manager to oversee the MMRP during construction. The County project manager is responsible for the following duties: • Ensure that routine inspections of the project site are conducted by appropriate County staff; check plans, reports, and other documents required by the MMRP; and conduct report activities. • Serve as a liaison between the County and the site manager regarding mitigation monitoring issues. • Complete forms and maintain reports and other records and documents generated by the MMRP. • Coordinate and ensure corrective actions or enforcement measures are taken, if necessary.
