The proposed project is a request for a tentative parcel map for a subdivision of one parcel into ten lots. The project site is unaddressed, located approximately 4.8 miles east of the City of Oroville, Assessor's Parcel Number: 079-330-002. The existing parcel is approximately 54.2 acres in size, undeveloped, and zoned RR-5 (Rural Residential, 5-acre minimum). The project proposes future residential development on each resultant lot served by LOAPUD and SFWPA utility connections. LAFCo was not involved in the pre-development process so our comments/observations were not previously solicited. As to process, the basic path I would expect is: (NOTE: I have attached the Cooperative Environmental Review Agreement (CERA) executed by County/SFWPA/LOAPUD/LAFCo in 2005 that details the process agreed upon) 1. County initiates CERA. 1a PRED meeting solicits preliminary comments from affected agencies (SFWPA, LOAPUD, LAFCo). 2. TSM application submitted to County. 3. County circulates TSM app to affected agencies (LAFCo, districts, etc.) for review. 4. Comments received, project evaluated, CEQA completed, conditions applied. (CEQA must include in the project description the annexation proposal) 5. Project to Planning Commission for approval. 6. If approved, proponent requests LOAPUD to initiate annexation to District. 7. LOAPUD approves/disapproves proposal relying on the CEQA documents from the TSM approval, and then submits annexation application to LAFCo. 8. LAFCo reviews and approves/disapproves annexation relying on the CEQA documents from the TSM approval. 9. Annexation condition met and TSM proceeds towards recordation. LAFCo does not consider annexations of vacant, developable lands for utility services without an approved corresponding development project (TSM) for two reasons: To ensure that all development plans/conditions are known to LAFCo before allowing a permanent utility issues from the public and affected agencies have been addressed and resolved. So that the applicant only completes one CEQA document, completed by County for all subsequent actions. The County is the lead agency. .ATTENTION: This message originated from outside Butte County. Once LAFCo receives a complete application, our process takes approximately 60-90 days. Cost estimate based on what I know at this time, will be approximately $3,000 filing fees + Sphere fees (54 ac x $500/ac) $27,000 + State BOE fee $1,500. I hope this helps you successfully navigate. The owner of the property, Allan Birkholz, would like to subdivide the property into 10 five-acre parcels per the attached map. The intent is for each parcel to be served with sewer connected to LOAPUD’s system, and water connected to South Feather Water and Power Agency.
