Dear Larry and Merrily,
On Friday, November 3, 2020, the Department of Development Services made the finding
that the Lot Line Adjustment on the above referenced property is exempt from
environmental review, and approved the project subject to the conditions on the attached
page.
Should you chose to appeal the decision of the Dept. of Development Services, please
submit your appeal, in writing, together with the appeal fee of $674.00, to the Department
of Development Services, 7 County Center Drive, Oroville, California 95965, prior to 4:00
p.m. on Friday, November 13, 2020.
Please contact Bill Bridgnell (530.538.7266) of the Butte County Department of Public
Works to complete the requirements to record the Lot Line Adjustment. The conditions of
approval must be met within thirty-six (36) months from the date of approval by the
Department of Development Services or the approval will be considered null and void.

CONDITIONS OF APPROVAL
Larry Jendro and Merrily Stover, APNs 03-170-083, -091 and -092 Project # LLA20-0007:
A Lot Line Adjustment (Planning File # LLA20-0007) between three parcels (APN: 030-170-083
(Parcel 1), APN 030-170-091 (Parcel 2) and APN: 030-170-092 (Parcel 3)). Existing parcel
sizes are 0.52 acres (Parcel 1), 1.12 acres (Parcel 2) and 1.36 acres (Parcel 3). Resultant
parcel sizes will be 0.62 acres (Parcel 1), 1.65 acres (Parcel 2) and 0.62 acres (Parcel 3). All
three parcels are located on Cabana Drive, in the Thermalito area. Parcel 1 is located at 45
Cabana Drive, Parcel 2 is located at 21 Cabana Drive and Parcel 3 is located at 42 Cabana
Drive. The parcels are zoned VLDR (Very Low Density Residential 1 acre minimum).
1. Deeds and plats (if required) with the appropriate checking fee shall be submitted to the
Department of Public Works, Land Development Division, for checking and approval
prior to recordation and shall contain the notes specified below.
2. Provide documentation from a title company of the applicant's choice verifying any deed
of trust affected has been partially re-conveyed or modified to reflect the lot line
adjustment and to prevent the creation of any additional lot or parcel.
3. Prior to recordation of deeds, provide documentation verifying payment of taxes as
required by Subsection (d)(4)a of Section 20-95.1 of the Butte County Code and as
specified in Article 8 of Chapter 4 of Division 2 of Title 7 of the Government Code,
commencing with Section 66492.

(To be placed on any deed to effect lot line adjustment)
The purpose of this deed is to effect a lot line adjustment as approved by the Butte County
Department of Development Services on ___________________. The above described lands are to
be combined with and become a part of those lands as described in the deed to
___________________________ as filed for record in Butte County Official Records at Serial
Number _____________ Book __________ Page _______. No additional lots or parcels are created
hereby. The scope of review of said lot line adjustment was limited as specified in Government Code
Section 66412(d), and approval of it does not constitute assurance that future applications for
building permits or other land use entitlements on the modified lots or parcels will be approved by
the County of Butte.
