Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special
conditions set forth below: Dildeep Singh Kaile is hereby granted an Administrative Permit to construct a service station addition to the existing Forest Ranch Market in the southern portion of the 1.74-acre parcel located at 15456 Forest Ranch Way, Forest Ranch, CA 95942. The service station will encompass an above ground fuel storage tank, 2 dispensers/pump stations, trash
enclosure and various site improvements with a 920 square foot canopy coverage.
I. GENERAL REQUIREMENTS, CONDITIONS, AND RESTRICTIONS:
1. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including
Butte County Code Sec. 24-208.
2. The terms and conditions of this Permit shall run with the land and shall be binding upon and to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee.
3. Neither the applicant, nor any agent nor representative of the applicant shall intentionally
omit or misrepresent any material fact in connection with the application. Any alleged
material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke the Permit.
4. The approved use shall be developed and maintained in substantial conformance with the
approved site plan and operations plan on file with the Butte County Planning Division.
Minor changes to the plans may be allowed subject to the approval of the Director of Development Services, if found to be in substantial conformance to the approved project.
II. CONDITIONS OF APPROVAL:
1. All outdoor lighting shall be located, adequately shielded, and directed such
that no direct light falls outside the property line, or into the public right-of-
way per Butte County Code Section 24-67 and as illustrated in Figure 24-67-1 (Inadequate and Adequate Shielding) and Figure 24-67-2 (Light Source Not Directly Visible Outside Property Perimeter).
2. The following measures shall apply to all development activities on the project site. Dust generated by the development activities shall be kept to a minimum
and retained on-site. Follow the air quality control measures listed below:
Control Dust
a. During clearing, grading, earth moving, excavation, or transportation of cut or fill materials, water trucks or sprinkler systems are to be used to prevent dust from leaving the site and to create a crust after each day’s
activities cease.
b. During construction, water trucks or sprinkler systems shall be used to keep all areas of vehicle movement damp enough to prevent dust from leaving the site. At a minimum, this would include wetting down such areas in the later morning and after work is completed for the day and
whenever wind exceeds 15 miles per hour.
c. Soil stockpiled for more than two days shall be covered, kept moist, or treated with soil binders to prevent dust generation.
d. On-site construction vehicles shall be limited to a speed of 15 mph on unpaved roads.
e. Haul vehicles transporting soil into or out of the property shall be
covered.
f. Existing roads and streets adjacent to the project shall be cleaned at least once per day if dirt or mud from the project site has been tracked onto these roadways, unless conditions warrant a greater frequency.
g. Other measures may be required as determined appropriate by the
BCAQMD or Department of Public Works in order to control dust.

h. Post a publicly visible sign with the telephone number and person to contact regarding dust complaints. This person shall respond and take corrective
action within 24 hours. The telephone number of the Butte County Air
Quality Management District shall be visible to ensure compliance with BCAQMD Rule 200 & 205 (Nuisance and Fugitive Dust Emissions).
Other Construction Practices
i. Maintain all construction equipment in proper tune according to
manufacturer’s specification.
j. Idling time shall not exceed to 10 minutes for any diesel engine.
k. Where feasible, give preference to utilizing the following equipment: Electric equipment, Substitute gasoline-powered for diesel-powered equipment, alternatively fueled construction equipment on site such as
compressed natural gas (CNG), liquid natural gas (LNG), propane, or
biodiesel, or equipment that has Caterpillar pre-chamber diesel engines, as practical. Diesel construction equipment meeting the CARB’s 1996 or
newer certification standard for off-road heavy-duty diesel engines may be utilized.
l.Construction workers shall park in designated parking area(s) to help reduce
dust emissions.”
3.The applicant shall obtain all necessary Building and Environmental HealthPermits.
4.All signage associated with the facility shall be consistent with the
requirements provided in Chapter 24, Article 20 (Signs).
5.Noise standards shall be regulated pursuant to Chapter 41A, Noise Control,of the Butte County Code.
6. Obtain necessary encroachment permits from the Butte County Public Works
Department before beginning construction.
7.The applicant shall obtain all necessary Building and Environmental Health
Permits.
8.Obtain a Hazardous Materials Plan from the Butte County Public Health
Department, Environmental Health Division prior to operation/issuance of building
permit.
