HomeMy WebLinkAbout039-590-019 PRED24-0007 Letter to food facilities-AB1627May 15, 20024 TO: BUTTE COUNTY FOOD FACILITIES SERVED BY A WELL RE: ASSEMBLY BILL 1627, APPEAL OF SECTION 116283 On September 8, 2023, the Governor signed Assembly Bill 1627, which amended the California Safe Drinking Water Act by repealing Section 116283 of the Health and Safety Code. Section 116283 allowed permitted food facilities using a well to be exempt from public water system permits issued under the direction of the State Water Resource Control Board, Division of Drinking water (DDW). This exemption allowed food facilities to have local oversight of their water system through their food facility permit. Section 116283 has been repealed as of January 1, 2024, which could potentially require your food facility to become a public water system. To determine if your food facility is a public water system, we will need you to answer the questions on the attached page. Human consumption is defined as drinking, bathing or showering, hand washing, oral hygiene, or cooking, including, but not limited to, preparing food and washing dishes.
