Dear Mr. Ginno:
Plans for the above referenced project have been routed to the Department of Public Works for review of
compliance with Butte County Code Sections 26-12 and 26-23 (available on line at
http://municipalcodes.lexisnexis.com/codes/butteco/). Based on our initial review of the information
provided, the Department of Public Works has determined that your parcel is located within a Federal
Emergency Management Agency (FEMA) designated floodplain. As a federally designated floodplain,
special rules and regulations apply and an additional county development permit is required to construct a
structure within the floodplain.
The requirements of construction within a floodplain are set forth in Article IV, Section 26 of Butte County
Code. Code Section 26-23 requires demonstration that encroachments by a building or other structure
will not result in any increase in water surface elevations on neighboring properties. The necessary
information is normally provided by a registered professional engineer.
In addition to the requirements of Code Section 26-23, one or more of the following may apply per County
Code Section 26-12:
1. Drainage plans and calculations shall be submitted to and approved by the Department of
Public Works. Engineering plans shall detail existing drainage conditions and specify how
storm water runoff will be either detained or retained onsite and/ or conveyed to the
nearest natural drainage channel or publicly maintained facility. Engineering calculations
shall show there is no increase in peak flow runoff leaving the property.
2. Deed 30 feet of right-of-way from the physical centerline of Miller Avenue along the entire
property frontage.
3. The construction of an enclosure for containers used to hold solid waste and/or recyclable
materials for collection.
Please submit sufficient information to the Land Development Division of the Public Works Department, 7
County Center Drive, Oroville, CA 95965 that demonstrates compliance with County Code Sections 26-12
and 26-23. If construction plans and/or engineering analysis are required, submit information in duplicate
in accordance with County Improvement Standards (available on line at
http://www.buttecounty.net/publicworks/divisions/landdevelopment/impstd.html) along with a $700.00
minimum plan checking deposit.
