Project Description
William Hambleton has submitted an application to Butte County for a Parcel Merger (Planning
File # MER24-0004) to combine two (2) parcels: APN 059-089-002, 0.16 acres (Parcel A), and
APN 059-089-001, 0.16 acres (Parcel B), totaling 0.32 acres. The parcels are located at 17131 &
171335 Manzanita St, in Stirling City. Parcel A is developed with a single-family dwelling, and
Parcel B is undeveloped. The parcels have a Medium Density Residential General Plan land use
designation and are zoned MDR (Medium Density Residential).
Site Characteristics
• The parcels have a General Plan land use designation of Medium Density Residential and
are zoned MDR (Medium Density Residential).
• APN 059-089-001 is developed with a legal nonconforming pre-existing church.
• APN 059-089-002 is undeveloped.
• Neither parcel shows existing septic systems with CSA 082 across Manzanita St.
Parcel Creation Information
The Public Works Land Development Division has cleared the parcels for creation status and
legality and has reviewed and approved the merger certificate language.
Parcel A was created by deed (Book 71, Page 291), in 1903.
Parcel B was created deed (Book 74, Pages 149 & 150), in 1904.

This project is exempt from the requirements of the California Environmental Quality Act (CEQA)
under Section 15305(a) of the CEQA Guidelines (Class 5). This exemption includes minor
alterations in land use limitations with an average slope of 20 percent and where the project
would not result in any changes in land use or density, including minor lot line adjustments that
do not result in the creation of any new parcels.
Public Comments
Notification of the project was sent to 33 adjacent property owners and published in the Paradise
Post.
No public comments were received.
Actions for Consideration
Staff recommends that the Director of Development Services take the following action:
I. Find that the project is categorically exempt from environmental review under Section
15305 of the California Environmental Quality Act (CEQA). A Class 5 exemption consists
of minor alterations in land use limitations in areas with an average slope of less than
20%, which do not result in any changes in land use or density, including minor lot line
adjustments that do not result in the creation of any new parcels.
II. Approve Merger (MER24-0004) for William Hambleton APN 059-089-001 & 059-089-002
subject to the following findings:
A. The proposed Merger is consistent with the requirements of Butte County Code
Section 20-180.3.
B. The subject parcels were created in conformance with the Butte County
Subdivision Ordinance and California Subdivision Map Act.
Appeals
Any interested person may appeal the decision of the Director of Development Services by filing
a notice of appeal with the Clerk of the Board of Supervisors within ten (10) calendar days as
provided in Sections 20-180.3 (h) and 20-66 of Butte County Code. A notice of appeal must be
accompanied by the appeal fee specified in Section 3-43 of the Butte County Code.
