HomeMy WebLinkAbout24-013BOARD OF SUPERVISORS COUNTY OF BUTTE, STATE OF CALIFORNIA Resolution No 24-013 A RESOLUTION OF THE BUTTE COUNTY BOARD OF SUPERVISORS TO ADOPT A NEGATIVE DECLARATION FOR THE NEAL ROAD RECYCLING AND WASTE FACILITY TRANSLOADING FACILITY PROJECT WHEREAS, the Butte County Department of Public Works (Project Applicant) proposed to construct an organic waste transloading facility that will assist with the loading of mixed organic waste into transfer trucks at the Neal Road Recycling and Waste Facility (NRRWF) that will be subsequently transported to an off -site composting facility; and WHEREAS, in September 2016, Governor Brown signed into law Senate Bill (SB) 1383 (Lara, Chapter 395, Statutes of 2016), establishing methane emissions reduction targets in a statewide effort to reduce emissions of short-lived climate pollutants in various sectors of California's economy; and WHEREAS, the proposed project responds to SB 1383 which requires 50 percent reduction in the level of statewide disposal of organic waste from the 2014 level by 2020 and a 75 percent organic waste reduction by 2025; and WHEREAS, the project site is approximately 0.5-acre, within a parcel spanning 190 acres total, with 140 acres permitted for the disposal of solid waste, located at 1023 Neal Road, Paradise, California, in unincorporated Butte County (Assessor's Parcel Number 040-600-082); and WHEREAS, source -separated mixed organic waste will be transferred off -site for composting from a transloading facility located on the compacted intermediate cover of NRRWF Landfill Module 4; and WHEREAS, an Initial Study and Negative Declaration were completed pursuantto California Environmental Quality Act (CEQA) guidelines; and WHEREAS, a Notice of Intent to Adopt a Negative Declaration for the NRRWF Transloading Facility Project was prepared and advertised September 22, 2023 for public review and comment through October 23, 2023 at the Butte County Public Works Department, 7 County Center Drive, Oroville, CA 95965; and WHEREAS, the Initial Study and Notice of Intent to Adopt a Negative Declaration were referred to various affected public and private agencies, County departments, and referral agencies for review and comments. NOW, THEREFORE, BE IT RESOLVED, that the Butte County Board of Supervisors hereby takes the following actions and makes the following finding: 1. Adopts the Initial Study and Negative Declaration with the following findings: i. An Initial Study was completed in compliance with CEQA. Said study identified no significant environmental effects. ii. The Board of Supervisors has considered the Negative Declaration, together with comments received during the review process. The Negative Declaration was circulated for public review, from September 22 to October 23, 2023. No comments were received regarding the adequacy of the Negative Declaration. iii. On the basis of the whole record before the Board of Supervisors, the Board finds that there is no substantial evidence that the proposed NRRWF Transloading Facility Project will have a significant effect on the environment. The custodian of the record is the Department of Public Works. The location of the record is 7 County Center Drive, Oroville CA 95965. iv. The Initial Study and Negative Declaration reflects the independent judgment and analysis of Butte County, which is the Lead Agency.
