HomeMy WebLinkAbout24-022A RESOLUTION OF THE BUTTE COUNTY BOARD OF SUPERVISORS TO ADOPT AN INITIAL STUDY AND MITIGATED NEGATIVE DECLARATION FOR THE CENTRAL HOUSE ROAD BRIDGE REPLACEMENT PROJECT WHEREAS, the Butte County Department of Public Works (Project Proponent) proposes to replace an existing narrow sub -standard bridge with a modern reinforced concrete structure across Wyman Ravine; and WHEREAS, the California Environmental Quality Act (CEQA) requires environmental analysis of all projects not categorically exempt from analysis and may affect the environment; and WHEREAS, an Initial Study and Mitigated Negative Declaration were completed according to CEQA guidelines; and WHEREAS, a Notice of Intent to Adopt a Mitigated Negative Declaration for the Central House Road Bridge Replacement Project was prepared and advertised on December 8, 2023, for public review and comment through January 9, 2024, through the State Clearinghouse (SCH No 2023120182) and at the Butte County Public Works Department, 7 County Center Drive, Oroville, CA 95965; and WHEREAS, the Initial Study and Notice of Intent to Adopt a Mitigated Negative Declaration was referred to various affected public and private agencies, County departments, and referral agencies for review and comments. NOW, THEREFORE, BE IT RESOLVED, that the Butte County Board of Supervisors takes the following actions and makes the following finding: 1. Adopts the Initial Study and Mitigated Negative Declaration with the following findings: An Initial Study was completed in compliance with CEQA. Said study identified that although the proposed project could have a significant effect on the environment, there will not be a significant effect in this case because revisions in the project have been made by or agreed to by the project proponent. A Mitigated Negative Declaration was prepared. ii. The Board of Supervisors has considered the Mitigated Negative Declaration and comments received during the review process. The Mitigated Negative Declaration was circulated for public review from December 8, 2023, to January 9, 2024. No comments were received regarding the adequacy of the Mitigated Negative Declaration. iii. Based on the whole record before the Board of Supervisors, the Board finds no substantial evidence that the proposed Central House Road Bridge Replacement Project will significantly affect the environment. The custodian of the record is the Department of Public Works. The location of the record is 7 County Center Drive, Oroville, CA 95965. iv. The Initial Study and Mitigated Negative Declaration reflects the independent judgment and analysis of Butte County, which is the Lead Agency.
