On January 3, 2025, the Department of Development Services approved the Urban Lot Split on the above referenced property. Please work with your surveyor or engineer and contact the Butte County Public Works Department to complete the conditions of approval and record the parcel map. Public Works is located at 7 County Center Drive, Oroville, CA 95965. You have 24 months (January 6, 2027) after approval to record the map prior to map expiring. You may apply for a map extension a minimum of thirty (30) days prior to the expiration date. Enclosed is a copy of the Conditions of Approval and Approved Plat. CONDITIONS OF APPROVAL Miller APN 040-030-113, Project # MISC24-0010: The project is an urban lot split under SB9. The existing parcel is 2.27 acres, zoned VLDR, and
contains a single-family residence on proposed Parcel B, Parcel A is vacant. The resultant parcel
sizes will be 1.36 acres (Parcel A) and 0.91 acres (Parcel B). The project is located at 260 Speedway
Ave. approximately 300 feet south of the City of Chico’s city limits, Assessor Parcel Number: 040-
030-113. The properties are served by Cal-Water and existing onsite individual septic tank and leach
line systems.
Butte County Public Works
A. COUNTY SURVEYOR
1. Map Recordation: Prior to map recordation:
a. The applicant shall submit to the County Surveyor for review and approval a final map
pursuant to Subdivision Map Act Section 66444-66450.
b. The applicant shall prepare a Supplemental Data Sheet for all information not affecting record title interest. The Supplemental Data Sheet shall contain a statement that the additional information, conditions of approval, or comments are for informational purposes only and are not intended to affect record title interest. Additional information may include but is not limited to building setback lines, flood hazard zones, seismic lines and setbacks, leach field-free areas, and usable sewage disposal areas.
c. The applicant shall identify all easements of record on the final map and shall provide deeds establishing all existing and proposed easements and rights of way on the property.
d. The applicant shall pay in full any and all delinquent, current, and estimated taxes and assessments as specified in Article 8 of Chapter 4 of Division 2 of Title 7, of the California
Government Code commencing with Section 66492. A tax certificate is to be provided to the County Surveyor prior to recording.
e. The applicant shall submit a Preliminary Title Report that has been prepared within 6
months of the map recordation date.
f. The applicant shall provide deeds establishing property boundaries.
g. The applicant shall provide copies of all lot and boundary closures (calculation showing
error of closure).
h. The applicant shall pay the recording fees in effect at the time the final map and related documents are recorded.
i. The parcel map shall contain a certificate by the engineer or surveyor responsible for the preparation of the map that states that all monuments are of the character and occupy the positions indicated, or that they will be set in such positions on or before ninety (90) days from the date of recordation, per Butte County Code of Ordinance Section 20-109.5. The certificate shall also state that the monuments are or will be sufficient to enable the survey to be retraced.
B. STREETS
2. Prior to issuance of building permits, the applicant shall obtain an encroachment permit to improve
all new driveway approaches to publicly maintained roads as specified in county Improvement Standard S-31 and the terms of the encroachment permit and improvement permit, and for temporary traffic control to manage vehicles entering and exiting the site during construction. As
part of the encroachment permit, the applicant shall submit road and drainage improvement plans
to the Public Works Department for the encroachment improvements. Adequate sight distance at the intersection of the project access and public roads shall be provided. Right-of-way required for
construction of road approach and roadside drainage shall be provided.
C. SOILS, DRAINAGE, FLOODING
3. Comply with Butte County Code Section 26-23:
a. The applicant shall not increase the water surface elevation of the base flood more than one (1) foot at any point, nor shall the applicant increase the base flood elevation
in a manner which adversely affects any neighboring property.
b. The lowest floor elevation of new and substantially improved residential structures shall be elevated above the highest adjacent grade at least one (1) foot higher than
the depth number specified in feet on the official map (at least three (3) feet if no depth number is specified).
4. Comply with Butte County Code Section 26-24: Prior to building permit issuance, the applicant
shall comply with all provisions of Butte County Code Section 26-24.
5. Comply with Butte County Code Section 26-25:
i. Prior to map recordation, show or note the existing regulatory flood plain on the map.
ii. Adequate drainage shall be provided so as to reduce exposure to flood hazards.
iii. All public utilities and facilities shall be located so as to minimize or eliminate flood damage.
Butte County Building Division 6. Any proposed built elements may require a building permit. Butte County Fire Department 7. Construction, installation, or development of buildings and/or roads, driveways, gates, and bridges
on parcels/lots shall comply with the current adopted California Building Standard Codes, Butte County Improvement Standards, and all other applicable State and County Codes, ordinances and regulations, in effect at the time of application.
