Dear Butte County Local Government Official,
The Butte County Department of Development Services has received an application for a
finding of “Public Convenience or Necessity” within your jurisdiction, area, or district. The
Butte County Board of Supervisors, by Resolution No. 95-89, has delegated the authority to
the Department of Development Services to approve exceptions to the ABC’s prohibition
on granting new alcohol licenses in areas that have undue concentrations of existing
licenses.
For the ABC License Type 20 Off Sale Beer and Wine application (MISC24-0013), there is
an overconcentration in the census tract (as shown on ABC-245 there are two (2) licenses
allowed and currently four (4) existing). The existing Off-Sale ABC Licenses (type 20 and
21 in Census Tract 0017.03 are:
The “Public Convenience or Necessity” process provides local government input into the
state liquor licensing process. State law limits the offering of new licenses in geographical
areas defined as areas of high crime, or in areas of “undue concentration” of existing retail
liquor outlets. However, the law also states that these restrictions may be waived in specified
circumstances when the local jurisdiction or ABC makes a determination that the applicant
license proves that the proposed outlet would serve “Public Convenience or Necessity”.
Attached for your review and comment is the Procedure for Determining Public Convenience
or Necessity, Board Resolution 95-89, and vicinity map.
In making your determination consider your role in the district, or area as it pertains to
alcohol consumption, higher than average crime, specific problems with alcohol in the past,
or any other negative impacts to the community an additional off-site beer and wine license
(Type 20) may create.
