We’ve have been in contact with the Assessor’s Office and their mapper has made the same conclusion, and you would be able to process a Lot Line Adjustment for the northern portion of 041-060-092 as normal. I have attached the Lot Line Adjustment Guide and Application, which has an application fee of $1,678.17. The attachment provides a list of all requirements needed for intake. There is no need to provide anything in your application regarding the Williamson Act Contract, as this has since been recorded in the file for the parcel. There may be a possible avenue to rescind the northern portion of 041-060-092 through Rule 6, Section G. Correction of Errors. After reviewing the contract, it appears that the northern portion of parcel 041-060-092 had not originally been included. [cid:image001.png@01DB9277.130379C0] After reviewing the Legal Description for this parcel, it does not appear that the portion north of the highway had been described in the contract. The contract does include two different acreages for this APN: 139.28ac & 133.21ac, but does not specify why two values are listed. I do not believe it is to exclude the northern portion as it is appears to be roughly twice as large as the difference between the two given values. There does appear to be other acreage inaccuracies on other APNs, so it is possible it is describing the northern piece with an inaccurate number. Here are the differences between the acreages in the contract compared to what our current records state for each piece. Contract: 041-060-092: 139.28ac / 133.21ac 041-330-010: 20.10ac 041-060-086: 47.63ac 041-120-081: 40.734ac Total: 247.74ac / 241.67ac Current: 041-060-092: 139.28ac – same value for first acreage given 041-720-009 (was 041-330-010): 20.10ac – same value 041-060-086: 52.3ac – ~12ac greater 041-120-081: 33.38ac – ~7ac lesser 041-060-034: 1.3ac – did not appear to be described in the legal description but was included in the map. This is also recorded flagged as a portion of this Williamson Act contract in our GIS layer. Total: 246.36ac At this point there are two different outcomes we foresee. If the northern portion of 041-060-092 had never been written into the contract, we can apply for a review before the LCA committee and the Board for approval to amend the contract. At this point a lot line adjustment would be possible without needing to wait nine years for the recission to follow through. Alternatively, if it is found that the northern portion is written into the contract, then we will still need to go through the standard recission process with the nine year expiration. For the Lot Line Adjustment involving 041-120-079 and the northern portion of 041-060-092, contingent to the absence of the Williamson Act contract for the northern portion of -092, a Lot Line Adjustment would be accepted by the Planning Division. Despite the difference in zoning (AG-40 & AG-160), this would be excepted for “better design”. We cannot make any guarantees on if zoning code will be amended to no longer allow this in the next nine years, but the above mentioned solution would not require this if the northern portion was never actually included. Under the circumstance that the 9-year expiration is required, we do not foresee any reason that zoning code would change to disallow the Lot Line Adjustment. I have attached the contract to this email. To move forward, you will need to find a private, licensed surveyor, engineer, really anyone who can read legal descriptions to verify the deeds for the parcels and which portions align with what is described in your contract. Due to some of the inconsistencies found with the acreages and APNs in the contract compared to our current records, we would like from the surveyor to essentially color-code the legal descriptions in the contract as well as on the map above/Assessor’s map to indicate which property lines each Legal Description is describing, and provide this back to the County. Based on that information we will know how we can move forward. The next meeting is scheduled for March, and which we can make if an application is provided by mid-late January.
